THE MARINE LIFE CONSERVATION DISTRICT &
THE PURCHASE OF ADJACENT PROPERTY FOR OPEN SPACE
SEPTEMBER 2015
* Wai'Opae tidepools is a popular destination for both tourists & residents for its
exquisite snorkeling within the Marine Life Conservation District (MLCD).
* Access to the MLCD with its beautiful coral gardens and snorkeling is currently
through the private roads of Vacationland subdivision & along private oceanfront
property. Parking & access is currently generously allowed by the subdivision, and
the provision of alternative access on publicly owned property is long overdue.
* The MLCD was established in 2003 by the State to protect the fisheries and diverse
coral. It extends about Y2 mile along the shoreline, starting in the Vacationland
subdivision and extending along the Vacationland Land Trust property.
* Prohibited activities within the MLCD:
o Fish for, take, or injure any marine life.
o Take, damage or alter any sand, coral, or other geological features.
o Anchor or moor any vessel. -
o Conduct commercial activities, including commercial tours, dive groups,
sightseeing tours, hikes, or guided services. -
* Signs clearly marking the boundaries of the MLCD were damaged during storm
Iselle, but will be replaced soon. Fishing and gathering is, allowed outside of the
MLCD.
PURCHASE OF THE VACATIONLAND LAND TRUST PROPERTY:
It currently is still private property.
* Purchase of the property would not alter the boundaries, or the currently
allowed uses, of the MLCD.
* The property is 322 acres (258 acres of usable land) and borders the Vacationland
subdivision, Kapoho Kai Drive, and Hwy 137, including over 3,000 ft. of shoreline, the
majority of which borders the MLCD.
* Current access to the property and the south side of the tide pool lagoon is via a
foot trail off the end of Kapoho Kai Dr. This trail on the property has become a
popular way to access the lagoon and the tide pools. There is also a rough 4-wheel
drive road, and then a walking trail, off Hwy 137 (the red road).
* The property is currently rated #1 for purchase by the County under the auspices of
the PONC program (Public Access, Open Space and Natural Resources Commission). A
grant for half the assessed purchase price, up to $1 .33M, was awarded by a State
Legacy Land Grant. /w�4' I

* Once purchased, the vision for the property could include:
o Increased public access options to snorkeling and fishing/gathering. (There
is an existing rough road off Hwy 137 (the red road) through the property.
It forks, with the northern road heading towards the lagoon area and the
southern road towards fishing/gathering access south of the MLCD.)
o Stewardship of the land including the restoration of native habitat and the
reduction of invasive species.
o Preservation of culturally important lands and burial sites.
o Protection of endangered species and native birds.
