Your Committee on Planning, to which was referred Bill No. 169, reports as follows:
Bill No. 169, transmitted by Mayor William P. Kenoi via Communication No. 755 dated March 14,
2016, amends Section 25-8-33 (City of Hilo Zone Map), Article 8, Chapter 25 (Zoning Code) of the
Hawaii County Code 1983 (2005 Edition), by changing the district classification from Family
Agricultural—Two Acres (FA-2a) to Family Agricultural-One Acre (FA-1a) at Ponahawai, South Hilo,
Hawai`i, covered by Tax Map Key: 2-5-040:042. The applicants are Francis H. and Martha A. Rodillas,
and the subject parcel covers 2.724 acres. The applicants propose to subdivide the property into two
parcels for family.
The Windward Planning Commission, at its duly held public hearing on March 3, 2016, recommended
approval of this bill.
Mr. Chung asked the applicants to comment on the fair share contribution in Condition L.
The applicants asked the Council to waive the fair share assessment because the cost of installing a fire
hydrant and extending the water line exceeds the total cost of the fair share assessment.
Mr. Chung asked Planning Director Duane Kanuha whether he had any comments, and also whether
there is precedent for the Council waiving a fair share assessment
Director Kanuha stated there was not any precedent of which he was aware, and it would be an action to
be taken by the Council.
Mr. Chung asked Director Kanuha how he would prefer to proceed.
Director Kanuha said the applicant's cost relating to water is not included as a fair share component. The
department has considered in the past lumping the fair share assessment based on what the main impacts
of the components are, based on the area of the specific project roadway improvements, and offset the
other components. In this case, the fair share component to support fire facilities is $620.58, which is far
outweighed by the cost to install the fire hydrant. Reallocation of the fair share costs has been done
before.
Mr. Chung stated his preference for moving forward and said he would prepare an amendment.

Mr. Kanuha stated he appreciated the comments by Mr. Chung and agreed with moving the bill forward.
Ms. Wille, who had previously stated she would prefer a postponement, said she concurred with moving
the bill forward. She asked a question in terms of supporting fair share for parks and recreation due to
concern from constituents regarding park availability. She stated disapproval with waiving fair share
fees for parks and recreation infrastructure.
Ms. Eoff said her understanding is that the applicant will work with Mr. Chung and Director Kanuha to
come up with improvements if deemed appropriate.
Your Committee on Planning is in accord with the purpose and intent of Bill No. 169, and recommends
passage on first reading.
