SUBJECT: Proposed Amendments to Bill No. 151; Relating to Appointment of
Community Development Plan Action Committee Members.
Please find attached proposed amendments to Bill No. 151. The proposed amendments are illustrated
below in Ramseyer format with respect to the contents of Bill No. 151 (material to be deleted is
bracketed and stricken, material to be added is underscored). A draft copy of proposed Bill No. 151,
Draft 2, is attached with the amendments incorporated therein.
Bill No. 151 is amended by amending SECTION 2 of the bill, to read as follows:
"SECTION 2. Chapter 16, article 3, section 16-5, Hawai`i County Code 1983
(2005 Edition, as amended), is amended by amending subsection (a) to read as
follows:
"(a) The CDP action committee shall consist of nine members. All members
shall have a primary residence in the area covered by the CDP. The
members shall be appointed by the mayor and [ •- . :::'• ••- -
be subject to confirmation] confirmed by the council[-1f],provided that if a
position remains vacant for more than three months, a person to fill the
position may be appointed by a council member who represents the area
encompassed by the respective CDP, [and the appointment shall be] subject
to confirmation by the council. Prior service as a member of a CDP steering
committee shall not disqualify an individual from serving on the CDP action
committee."

AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 3, SECTION 16-5 OF THE
HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO
APPOINTMENT OF COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEE
MEMBERS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose.
The purpose of this ordinance is to ensure timely appointment of community development
plan action committee members by allowing respective council members to fill vacancies subject
to confirmation by the council, in the event the mayor does not do so in a timely manner.
SECTION 2. Chapter 16, article 3, section 16-5, Hawai`i County Code 1983 (2005 Edition,
as amended), is amended by amending subsection (a) to read as follows:
"(a) The CDP action committee shall consist of nine members. All members shall have a
primary residence in the area covered by the CDP. The members shall be appointed by the
mayor and [approved by the County council.] confirmed by the council, provided that if a
position remains vacant for more than three months, a person to fill the position may be
appointed by a council member who represents the area encompassed by the respective
CDP, subject to confirmation by the council. Prior service as a member of a CDP steering
committee shall not disqualify an individual from serving on the CDP action committee."
SECTION 3. If any provision of this ordinance, or the application thereof to any person or
circumstance, is held invalid, such invalidity shall not affect other provisions or applications of
the ordinance which can be given effect without the invalid provision or application, and to this
end the provisions of this ordinance are declared to be severable.
SECTION 4. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need
not be included.
SECTION 5. This ordinance shall take effect upon its approval.
