SUBJECT: Proposed Amendments to Bill No. 153; An Ordinance Amending Article II'iy
Section 3-18 of the Hawai`i County Charter (2014), Relating to the Office of '
the Legislative Auditor.
Please find attached proposed amendments to Bill No. 153. The proposed amendments are
illustrated below by Ramseyer format with respect to the contents of Bill No. 153 (material to be
deleted is bracketed and stricken, material to be added is underscored). A draft copy of proposed
Bill No. 153, Draft 2, is attached with the amendments incorporated therein.
1. Bill No. 153 is amended by amending SECTION 1 of the bill, to read as follows:
"SECTION 1. Article III, section 3-18 of the Hawai`i County Charter (2014),
relating to the Office of the Legislative Auditor, is amended by amending subsection (d)
to read as follows:
"(d) The legislative auditor shall conduct or cause to be conducted:
(1) The annual financial audit of the county, as required in Article X,
Financial Procedures, Section 10-13, Post-audit.
(2) Performance and/or financial audits of the funds, programs, services, and
operations of any county agency, executive agency, or program, as set
forth by the legislative auditor in an annual audit plan that shall be
transmitted to the county council and the mayor and filed with the county
clerk as a public record. The audit plan shall not disclose in advance which
specific agencies, funds, programs, services, or operations have been
selected for an audit in the coming year.
(3) Follow-up audits and monitoring of responses to audit recommendations
by audited entities."

2. Bill No. 153 is amended by adding a new SECTION 2 to read as follows below. The new
language I propose to add to subsection (g) of section 3-18 is bolded.
"SECTION 2. Article III, section 3-18 of the Hawai`i County Charter (2014), relating to
the Office of the Legislative Auditor, is amended by amending subsection (g) to read as follows:
(g) The legislative auditor shall conduct or cause to be conducted all audits in
accordance with government auditing standards, and shall set forth final audit
findings and recommendations in written reports, copies of which shall be
transmitted to the county council and the mayor, filed with the county clerk
as public records, made available for public inspection at the office of the
legislative auditor, and posted on the county website."
3. The existing SECTION 2 in Bill 153 is renumbered"SECTION 3", to read as follows:
"SECTION [2] 3. New Charter material is underscored. When revising,
compiling, or printing these charter provisions for inclusion in the Charter of the
County of Hawai`i, the reviser need not include the underscoring."
4. The existing SECTION 3 in Bill 153 is renumbered "SECTION 4", to read as follows:
"SECTION [X] 4. If any provision of this ordinance, or the application
thereof to any person or circumstance, is held invalid, such invalidity shall not
affect other provisions or applications of the ordinance, which can be given effect
without the invalid provision or application, and to this end, the provisions of this
ordinance are severable."
5. The existing SECTION 4 in Bill 153 is renumbered"SECTION 5", to read as follows:
"SECTION [4.] 5. Upon adoption of this ordinance, this Council, by
appropriate resolution, shall provide that this amendment be submitted to the
electorate of Hawai`i County for approval in the 2016 general election."
6. The existing SECTION 5 in Bill 153 is renumbered "SECTION 6", to read as follows:
"SECTION [SI] 6. Upon approval of the charter amendment proposed in this
ordinance by a majority of voters voting on this legislation in the 2016 general
election, as duly certified, this ordinance shall take effect at twelve o'clock
meridian on December 5, 2016."

BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Article III, section 3-18 of the Hawai`i County Charter(2014),
relating to the Office of the Legislative Auditor, is amended by amending subsection (d)
to read as follows:

person or circumstance, is held invalid, such invalidity shall not affect other provisions or

SECTION 5. Upon adoption of this ordinance, this Council, by appropriate
