Re: Operating Budget
Pursuant to Sections 10-15 and 10-16 of the County Charter, 2% of real property tax
revenues, (including penalty and interest) must be transferred from the General Fund to
the Public Access/Open Space, and Natural Resources Preservation(PONC) Fund, and
.25% of these tax revenues must be transferred to the Public Access/Open Space, and
Natural Resources Preservation Maintenance Fund. Real property tax interest revenues
are expected to exceed the amount budgeted for FY 2015-16, requiring additional funds be
transferred into the PONC and PONC Maintenance accounts in order to maintain
compliance.
Enclosed is a bill for an Ordinance amending the Operating Budget by appropriating
$80,000 to the Public Access/Open Space, and Natural Resources Preservation Fund, and
$10,000 to the Public Access/Open Space, and Natural Resources Preservation
Maintenance Fund.
In order to ensure that the transfer may be done by the deadline as required by the County
Charter, we are requesting that this bill be waived from the Finance Committee and to
breach deadline to place it on the April 20, 2016 Council Agenda. If there are any

A. REQUEST:
To amend the FY 16 General Fund operating budget by increasing revenues and appropriations by the
following:
Increase Real Property Tax Interest estimated revenues by $90,000
Increase appropriation Transfer to Public Access/Open Space Preservation Fund by $80,000
Increase appropriation Transfer to Public Access/Open Space Preservation Maintenance Fund by $10,000
B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED):
Real property tax interest revenues are expected to exceed the amount budgeted, which would then cause
the budgeted appropriations for the transfers to the Public Access/Open Space Preservation Fund and the
Public Access/ Open Space Preservation Maintenance Fund to be insufficient.

RE: Bill No. 195 : AN ORDINANCE TO AMEND ORDINANCE NO. 15-57 AS
AMENDED, THE OPERATING BUDGET FOR THE COUNTY OF HAWAII FOR THE
FISCAL YEAR ENDING JUNE 30, 2016 RELATING TO THE TRANSFER OF FUNDS TO THE
PUBLIC ACCESS, OPEN SPACE AND NATURAL RESOURCES PRESERVATION FUND.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawai`i, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
