COUNTY OF HAWAII •' \_ •- STATE OF HAWAII RESOLUTION NO. 526 16 A RESOLUTION ACCEPTING THE DONATION FOR PARK PURPOSES OF LOT 2-A-1-A IDENTIFIED AS TAX MAP KEY: (3) 7-7-008:030, SITUATED AT PAHOEHOE 3RD AND 4TH AND LA'ALOA 1ST,NORTH KONA,COUNTY AND STATE OF HAWAII FROM THE ISLAND OF HAWAII YMCA. WHEREAS, The Island of Hawai`i YMCA, a Hawaii nonprofit corporation (hereinafter referred to as"YMCA"), is the owner of Lot 2-A-1-A identified as Tax Map Key: (3) 7-7-008:030, situated at Pahoehoe 3rd and 4th and La'aloa 1St, North Kona, County and State of Hawaii, consisting of approximately 6.356 acres, more or less, as described on Exhibit"A" attached hereto and delineated on Exhibit"B"attached hereto (hereinafter referred to as "Parcel"); and WHEREAS, YMCA is desirous of donating the Parcel to the County in the public interest for the County to use for park purposes; and WHEREAS,the County plans to hold and use the Parcel for park purposes; and WHEREAS, YMCA has offered in writing to donate the Parcel to the County for park purposes as stated above, and has provided the County with a copy of the recorded deed whereby it acquired its interest in the Parcel; and WHEREAS, such donation has been approved by the Planning Department, Department of Public Works, Department of Water Supply, Department of Environmental Management, and the Real Property Tax Division; and WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter provides that the Council, on behalf of the County of Hawai`i, may accept gifts or donations of real property; WHEREAS, Section 2-162.2 of the Hawaii County Code provides that the Council of the County of Hawaii may accept donations of real property not derived from a community benefit assessment or a condition of land use approval upon a finding that such donation is in the public interest; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII,that in accordance with Section 2-162.2 of the Hawai`i County Code,that it is in the public interest and for the benefit of the County of Hawai`i to accept the donation of the Parcel. BE IT FURTHER RESOLVED that in accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, the County of Hawai`i accepts the donation of the Parcel from The Island of Hawai`i YMCA, being Lot 2-A-1-A identified as Tax Map Key: (3) 7-7-008:030, situated at Pahoehoe 3`d and 4th and La'aloa 1st,North Kona, County and State of Hawai`i, consisting of approximately 6.356 acres, more or less, as described on Exhibit"A" attached hereto and delineated on Exhibit"B"attached hereto. BE IT FURTHER RESOLVED that a letter of appreciation and a copy of this resolution be sent to The Island of Hawai`i YMCA, P. O. Box 7067, Kamuela, Hawaii 96743, acknowledging this generous donation. BE IT FINALLY RESOLVED that this resolution shall take effect upon adoption thereof and that the County Clerk shall transmit a copy of this resolution to (1) the Honorable William Kenoi, Mayor of the County of Hawai`i; (2)the Department of Parks and Recreation; 2 (3) the Department of Public Works; (4) the Department of Finance; and (5) Office of the Corporation Counsel.
