COUNTY OF HAWAII - •� `''"`''� • STATE OF HAWAII <br /> .•1,rf 0 N/•� <br /> BILL NO. 154 <br /> (DRAFT 2) <br /> ORDINANCE NO. <br /> AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE III, SECTION 3-2 <br /> OF THE HAWAII COUNTY CHARTER (2014), RELATING TO COUNTY COUNCIL <br /> TERMS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Article III, section 3-2 of the Hawai`i County Charter (2014), is <br /> amended to read as follows: <br /> "Section 3-2. Composition and Terms. <br /> There shall be a county council composed of nine members. One member shall be <br /> elected from each of nine districts. The terms of the council members shall be two years <br /> and shall begin at twelve o'clock meridian on the first Monday of December after their <br /> election. The terms of the council members shall not exceed [four consecutive] six <br /> twoyear terms. Candidates shall be elected in accordance with the election laws of the <br /> state, insofar as applicable." <br /> SECTION 2. Charter material to be repealed is bracketed and stricken. New <br /> material is underscored. When revising, compiling, or printing these charter provisions <br /> for inclusion in the Charter of the County of Hawai`i, the reviser need not include the <br /> brackets, bracketed and stricken material, and underscoring. <br /> SECTION 3. If any provision of this ordinance or the application thereof to any <br /> person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br /> applications of the ordinance, which can be given effect without the invalid provision or <br /> application, and to this end, the provisions of this ordinance are severable. <br /> SECTION 4. Upon adoption of this ordinance, this Council, by appropriate <br /> resolution, shall provide that this amendment be submitted to the electorate of Hawai`i <br /> County for approval in the 2016 general election. <br /> SECTION 5. Each person who is duly reelected to serve as council member in <br /> the 2016 elections, whether that be in the primary election or general election, shall be <br /> eligible to serve up to five additional two-year terms of office without regard for how <br /> many terms that person has already served as a council member, whether those previous <br /> council terms were held consecutively or otherwise. <br />
