Please find attached a proposed amendment to Bill No. 150. The proposed amendment is illustrated below in Ramseyer format with respect to the contents of Bill No. 150 (material to be deleted is bracketed and stricken, material to be added is underscored). A draft copy of proposed Bill No. 150, Draft 2, is attached with the amendment incorporated therein. Bill No. 150 is amended by amending SECTION 2 of the bill, to read as follows: "SECTION 2. Chapter 16, article 3, section 16-5, Hawaii County Code 1983 (2005 Edition, as amended), is amended by amending subsection (b) to read as follows: "(b) The members shall serve staggered terms of four years. Upon the initial appointment of the committee, three members shall serve for a term of two years,three members for a term of three years, and three members for a term of four years. When the term of a member expires, the member may. at the discretion of the member, continue to serve until a successor is appointed. Members whose terms expire may not be reappointed for at least two years however, members appointed for one year or less may be reappointed for an additional term without the passage of two years' time. Existing vacant positions shall be filled before filling any position occupied by a member whose term has expired but who is willing to continue serving until their position is filled. Dote APR 4.891011$ Hawaii County Is An Equal Opportunity Provider And Employer AN ORDINANCE AMENDING CHAPTER 16, ARTICLE 3, SECTION 16-5 OF THE HAWAUI COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO COMMUNITY DEVELOPMENT PLAN ACTION COMMITTEE MEMBERSHIP AND TENURE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAPI: SECTION 1. Purpose. The purpose of this ordinance is to modify the terms of membership and tenure for community development plan action committees to provide for better continuity of membership and to allow interested members the opportunity to serve for a longer period of time. SECTION 2. Chapter 16, article 3, section 16-5, I lawai'i County Code 1983 (2005 Edition, as amended), is amended by amending subsection (b) to read as follows: "(b) The members shall serve staggered terms of four years. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are declared to be severable. SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed material, and underscoring need not be included. SECTION 5. This ordinance shall take effect upon its approval. 2
