Please find attached proposed amendments to Bill No. 154, Draft 2. The proposed amendments are illustrated below in Ramseyer format with respect to the contents of Bill No. 154, Draft 2 (material to be deleted is bracketed and stricken, material to be added is underscored). A draft copy of proposed Bill No. 154, Draft 3, is attached with the amendments incorporated therein. 1. SECTION 1 of Bill No. 154, Draft 2, is amended to read as follows: "SECTION 1. Article III, section 3-2 of the Hawai`i County Charter(2014), is amended to read as follows: "Section 3-2. Composition and Terms. There shall be a county council composed of nine members. One member shall be elected from each of nine districts. The terms of the council members shall be two years and shall begin at twelve o'clock meridian on the first Monday of December after their election. The terms of the council members shall not exceed [si*] five consecutive two-year terms. Candidates shall be elected in accordance with the election laws of the state, insofar as applicable." Comm. SECTION 5 of Bill 154, Draft 2, is amended to read as follows: "SECTION 5. Each person who is duly reelected to serve as council member in the 2016 elections, whether that be in the primary election or general election, shall be eligible to serve [up to five additionatwol yearterms of office . ithm whether these preN ious eouneil teFms were held consecutively of otherwise,.] no more than five consecutive two-vear terms exclusive of any previously served non-consecutive terms." MW/dh An. AN ORDINANCE TO INITIATE AN AMENDMENT TO ARTICLE III, SECTION 3-2 OF THE HAWAII COUNTY CHARTER (2014), RELATING TO COUNTY COUNCIL TERMS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Article 111, section 3-2 of the I lawai`i County Charter (2014), is amended to read as follows: "Section 3-2. Composition and Terms. There shall be a county council composed of nine members. One member shall be elected from each of nine districts. The terms of the council members shall be two years and shall begin at twelve o'clock meridian on the first Monday of December after their election. The terms of the council members shall not exceed [€e ] five consecutive two- year terms. Candidates shall be elected in accordance with the election laws of the state. insofar as applicable." SECTION 2. Charter material to be repeated is bracketed and stricken. New material is underscored. When revising, compiling, or printing these charter provisions for inclusion in the Charter of the County of Hawaii, the reviser need not include the brackets, bracketed and stricken material, and underscoring. SECTION 3. If any provision of this ordinance or the application thereof to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or applications of the ordinance, which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are severable. SECTION 4. Upon adoption of this ordinance, this Council, by appropriate resolution, shall provide that this amendment be submitted to the electorate of I-Iawai'i County for approval in the 2016 general election. SECTION 5. Each person who is duly reelected to serve as council member in the 2016 elections, whether that be in the primary election or general election, shall be eligible to serve no more than five consecutive two-year terms exclusive of any previously served non-consecutive terms. SECTION 6. Upon approval of the charter amendment proposed in this ordinance by a majority of voters voting on this legislation in the 2016 general election, as duly certified, this ordinance shall take effect at twelve o'clock meridian on December 5, 2016, and shall apply to the terms of all council members duly elected in the 2016 elections, whether that be in the primary election or general election, and any election thereafter.
