Schutte DATE: July 30, 1991 ('Puesday) PLACE: Councilroom TIME: 1:30 p.m. CALL TO ORDER STATEMENTS REFERRALS Comm. 2671: CHANGE OF ZONE 91-7 (Bill 461) APPLICANT: PLANNING DIRECTOR INITIATED WITH THE CONCURRENCE OF DESMOND TWIGG-SMITH REQUEST: VILLAGE COMMERCIAL (CV-10) TO OPEN (O) TMK• 7-6-3.18 HOLUALOA 1 AND 2, NORTH KONA From Planning Commission Chairman Pro Tem Mike Luce, dated July 5, 1991, submitting a bill to change the district classification for 38,112± square feet of land from a Village Commercial-10,000 square foot (CV-10) to an Open zoned district located to the south of the Mamalahoa Highway-Old Government Road intersection, Holualoa 1st and 2nd, North Kona. States, the zoning amendment would essentially be an exchange or even swap of land area for another CV zoning by the applicant in the general area of Holualoa Village. Comm. 2673: GENERAL PLAN AMENDMENT - AWAKE'E (Res. 345) From Council Chairman Russell S. Kokubun, dated July 8, 1991, submitting a resolution requesting the Planning Director to conduct a study to redesignate the land at Awake'e from Resort and Medium Density Urban to Open. States, the Board of Land and Natural Resources and the State Legislature have approved the land exchange between the State lands at Maniniowali and North Kona Development Group's existing holding at Awake'e. States, the General Plan amendment would be appropriate in light of the land exchange. Hayashi, dated June 27, 1991, acknowledging receipt of Bill 186, relating to Development Agreements, which was sent to him for review and comments. Informs his office is coordinating review of the bill and will be responding as they are able to evaluate the comments. Comm. 2675: ANNUAL PROGRESS REPORT CHANGE OF ZONE ORDINANCE NO. 88-92 APPLICANT: TAIYO HAWAII COMPANY, LTD. TMK: 7-5-10: 8 AND 57 [R594) Copy of letter to Patrick T. Kubota, Project Manager, Taiyo Hawaii Company, Ltd., from Planning Director Norman K. Hayashi, dated July 8, 1991, acknowledging receipt of their annual progress report in compliance with Condition N of Change of Zone Ordinance No. 88-92. Hayashi, dated July 10, 1991, acknowledging receipt of Pacific Hawaiian, Ltd.'s timetable, as requested, for the submittal of plans for Final Plan Approval review relative to Change of Zone Ordinance No. 84-11. States that, while not required as a condition of approval, he would appreciate the applicant keeping his office informed of the status of the proposed development on a regular basis; however, should they find that the applicant has not complied with the conditions of approval in a timely manner, rezoning of the property to its original or more appropriate designation may be initiated. Hayashi, dated July 16, 1991, responding to his letter of June 18, 1991 informing that, due to medical problems, he is not able to comply with conditions of Ordinance No. 89-106 in a timely manner and, therefore, requested an extension of time in which to construct a residence on the subject property. States, a two-year time extension to comply with Condition B of the ordinance is granted and that any future request for time extension will have to be submitted to the Council.
