RESOLUTION NO. 5 42 16
RESOLUTION AUTHORIZING THE OFFICE OF HOUSING AND
COMMUNITY DEVELOPMENT TO AWARD FUNDS TO THE HABITAT
FOR HUMANITY WEST HAWAI'I, INC.
WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii
County Code (2005 Edition as amended) states, Grant awards in excess of $25,000
to nonprofit organizations shall specifically identify the organization receiving the
grant funds and the purpose for which the grant funds shall be used in an ordinance
or resolution ; and
WHEREAS, Chapter 2, Article 25, Section 2-136(5) of the Hawaii County
Code states "nonprofit organization" means an organization organized for other than
profit-making purposes and which has a current 501(c)3 tax-exemption from the
Internal Revenue Code ("IRS"); and
WHEREAS, the Habitat for Humanity West Hawai'i, Inc. (HFHWH) has a
current 501(c)(3) tax-exemption from the IRS for the purpose of building and
rehabbing homes for low income families and, therefore, qualifies as a nonprofit
organization as defined above; and
WHEREAS, the Office of Housing and Community Development wishes to
provide $336,000 to HFHWH; and
WHEREAS, the funds will be used to supplement the construction of four (4)
homes for low income families, at the Kamakoa Nui Affordable Workforce Housing
Project, in Waikoloa, Hawai'i; and
WHEREAS, HFHWH has more than sufficient experience with building homes for low income
families and meets all criteria of an eligible organization pursuant to Chapter 2, Article 25, Section 2-
137(6) of the Hawaii County Code;
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I, in accordance with
Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County Code, the Office of Housing and
Community Development is authorized to provide funds of $336,000 to HFHWH to supplement the
construction of four (4) homes as indicated above.
BE IT FINALLY RESOLVED, that the County Clerk shall transmit a copy of this resolution to
the Office of the Mayor and the Office of Housing and Community Development.
