Re: Request to Authorize the Retention of Special Counsel to Represent the County of
Hawaii in Litigation Matters Pending before the Hawaii Labor Relations Board
Dear Chair Kanuha and Council Members:
Transmitted herewith for the Council's approval are two resolutions regarding the above-
captioned matter. Pursuant to Section 6-5.5, Hawai`i County Charter(2012), the Office of the
Corporation Counsel respectfully requests this communication and resolutions be placed on the
agenda for the August 3, 2016, meeting of the Hawai`i County Council.
The Office of the Corporation Counsel seeks Council approval to retain the services of
special counsel to represent the County's interest in litigation matters pending before the Hawai'i
Labor Relations Board.
We further request an executive session to discuss this matter.

RE: Resolution No. 566-16 : A RESOLUTION AUTHORIZING THE EMPLOYMENT OF A
PRIVATE ATTORNEY AS PART OF AN INTERGOVERNMENTAL AGREEMENT WITH THE
STATE OF HAWAII, THE CITY AND COUNTY OF HONOLULU, THE COUNTY OF KAUAI,
AND THE COUNTY OF MAUI TO REPRESENT THE PUBLIC EMPLOYER IN COLLECTIVE
BARGAINING MATTERS RELATING TO LITIGATION OF UNION PROPOSALS.
Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter be placed onto the next Council agenda for review. However, in the event this request
is denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.
