Testimony By: Dexter Yamada, Robert Kline
Position: Oppose, with Recommendations
Chair Kanuha,and Members of the Hawaii County Council:
I am Dexter Yamada, President of KYD Inc, doing business as K Yamada Distributors. Robert Kline is KYD's Senior Account
Executive. Our company is a locally founded,family run business in Kalihi. KYD, Inc. began in the 1940's as a florist and
a supplier of florist supplies. In 1958 we evolved into the packaging company we are today and later expanded into a
distributor of many other fine products. KYD, Inc and its sister company, Hawaii Foam Products, LLC provide jobs to
about 90—100 men and women and contribute much to Hawaii's economy in the form of payroll and taxes.
We recognize that we are an Oahu-based company and therefore appreciate inclusion in the proposed HIPSI
Stakeholders Task Force. However,we are opposed to this proposal which seems to be an attempt to ban polystyrene
foam (PS foam) containers through a different process. Instead, we recommend that the Task Force focus on updating
the 2009 Zero to Waste Plan.
Discussion about Producer take-back programs must be based on fact-based research, financial assessment and analysis
of applicability to Hawaii Island. We understand there is resistance to include WTE in this discussion. However,
alternative energy projects, Hu Honoa and BioEnergy Hawaii, and the compost facility will contribute to landfill
diversion, and put trash to good use for usable agricultural material and energy production. States such as Minnesota,
Washington State, Connecticut, New York, Massachusetts and California include waste to energy as part of Solid Waste
Management methods. (Ameripen 2013)
Specifically we oppose the following:
1. Exploration of legislation requiring retailer and producer take-back program
The Zero—to-Waste Plan has little discussion about packaging; polystyrene foam is mentioned once in reference
to packaging peanuts and the list of locations that collect it for reuse.
There is reference that "Retailers should be required to take back items that don't have a place for
disposal on the island and send them back to the manufacturer." The Zero to Waste Plan for take-back laws

pharmaceuticals should go back to the pharmacists, and fluorescent lights and mercury batteries to retailers.
(Zero to Waste Plan, page 41) PS foam is not hazardous or made of toxic materials.
There are no known used food packaging take-back programs in the EU because of public health and sanitation
risks. Any Hawaii discussion of packaging take-back programs must involve the State and County Health
agencies to ensure public health safety.
There is a major movement in the U.S.toward Sustainable Materials Management(SMM). SMM is a
systematic approach to the materials in the waste stream. It seeks to reduce the environmental impacts over
the life of the material; starting at the extraction point of natural resources, to supply chain activities, product
design,delivery to consumers, and ultimately to end-of-life decisions. Decisions will be made about packaging
and product design, material usage,transportation systems, refrigeration systems, recycling options,etc.

2. Assumption that alternative packaging and products are environmentally friendly and will reduce packaging
and product waste from entering the ocean and harming marine life.
Words such as compostable, biodegradable and sustainable product and packaging sound good for the
environment. However, how does the higher use of pulp, plant material, water,electricity and carbon
footprint for transport to Hawaii measure in terms of environmental friendliness and depletion of viable
resources? Comparatively, PS foam products use fewer resources for manufacturing and its carbon footprint is
much less because it is locally produced.
All packaging and products, including compostables,are harmful to marine life when it is carelessly disposed and
enters the ocean.
A strong and sound litter management program, such as Malama 808, is a practical way to reduce such waste
from migrating to the ocean.
Further Recommendations:
1. Representatives from Hu Honua and BioEnergy Hawaii should also be part of this discussion as they will have
impact on land fill diversion and solid waste management.
2. KYD, Inc's representative on the Task Force should include a KYD designate in addition to Dexter Yamada as
he may not be able to attend some of the meetings.
We are willing to participate in further discussions on this matter. Thank you for the opportunity to testify.
