RESOLUTION NO. 604 16
A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAII,THE CITY
AND COUNTY OF HONOLULU,TIlE COUNTY OF KAUAI,ANI) THE COUNTY OF
MAUI FOR COST SHARING IN EXPERT WITNESS CONSULTATION SERVICES
WITH MATTERS RELATING TO TIlE BARGAINING UNIT 11 INTEREST
ARBITRATION.
WHEREAS, Ilawai`i Revised Statutes Section 46-7 requires that County departments
obtain the consent of the Council to enter into agreements with the federal or state governments
respecting action to be taken pursuant to any of the powers granted by law to furnish, expend,
and receive any funds or other assistance in connection with projects being or to be undertaken
pursuant to those powers; and
WHEREAS, pursuant to I Iawai'i Revised Statutes Chapter 89-2, "public employer"
includes the governor in the case of the State and the respective mayors in the case of the
counties and any individual who represents one of these employers or acts in their interest in
dealing with public employees; and
WHEREAS. the Collective Bargaining Agreements for Bargaining Units 1, 2. 3, 4, 10,
11, 12, 13, and 14 are set to expire on June 30, 2017; and
WHEREAS, the State of Ilawai`i,the City and County of IIonolulu. the County of Kaua`i,
the County of Maui, and the County of Ilawai`i (hereinafter"Public Iirnployer") are currently
engaged in the process of negotiating new Collective Bargaining Agreements for Bargaining Units
1, 2, 3,4, 10, 11, 12, 13, and 14, set to expire on June 30, 2017; and
WHEREAS,pursuant to Il:awai`i Revised Statutes Section 89-11, all bargaining units may
proceed to interest arbitration; and
WHEREAS, an arbitration relating to Bargaining Unit 11 (firefighters) is currently
scheduled for hearing in December 2016; and
WHEREAS, the State of Ilawai'i, the City and County of Honolulu, the County of Kauai,
and the County of Maui have expressed intent to retain the expert services of Patrick Kilbourne of
Berkeley Research Group, LLC, for the purpose of consulting and providing support services to the
Public Employer at the BU 11 interest arbitration; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in
accordance with Iiawai'i Revised Statutes Section 46-7, the Mayor of the County of Hawaii is
authorized to execute, on behalf of the County, an intergovernmental agreement with the State of
Hawai`i, the City and County of Honolulu, the County of Kauai. and the County of Maui to
retain the services of a private attorney to represent the Public Employer; and
BE IT FURTHER RESOLVED that the intergovernmental agreement with the State of
Ilawai`i, the City and County of IIonolulu, the County of Kaua`i, and the County of Maui is
hereby consented to and approved; and
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Director of Human Resources, Mayor William P. Kenoi, and Deputy Corporation
Counsel Christopher P. Schlueter.
