Good afternoon everyone and thank you for the opportunity
to request a denial of this application on behalf of our
neighborhood. In the accompanying folder, you will find a
short history of our reasons for requesting a denial of this
rezoning and letters opposing the rezoning from
Mrs. Margie Gushiken, 41 Punahele
Mrs. Kapuaokalani Andrade, 49 Punahele

Quoting the "Hawaii County General Plan... Housing Sec. 9.1
Introduction and Analysis Housing provides more than just
shelter from the natural elements. A person's home is not
only a place of security and comfort, but also a place for
entertainment and recreation. Housing also allows a person
• to express his/her individual living styles by providing a
place from which one can seek a psychological, sociological,
economic and aesthetic balance... The placement or
settlement patterns of these residential lands and the form
of housing are major influences on the environment and
aesthetic setting of the island... In the social and human
realm, adequate housing is one of the primary factors that
provides a person a sense of satisfaction and well being. For
most families, it is a major expenditure of the household
income and represents, in varying degrees, long term
commitments to a place and/or community. In turn, these
commitments contribute to a community's sense of well
being and stability..."
In 1977, as a single parent of 2 children, I found a
wonderful, family oriented neighborhood and a home for us
that I could afford. We settled in among the other families
in a safe, stable and peaceful environment close to schools,
amenities and my job.

• HCCC was a quiet and much smaller, different operation
then. It became another "neighbor". As a police officer, I
had a good relationship with their personnel both off and on
duty.
I believe that necessary development is acomponent of
p
progress in successful and positive community growth. It
should be approached in the same manner a child is raised
by their parents - responsibly and with considerable,
thoughtful planning and respect. However, unlike the
human element of parent and child, a parking lot is "set in
cement" like any development and mistakes are almost
impossible to rectify.
In 1979 and again in 1987, Mr. and Mrs. George Gushiken
and I were successful in blocking the original rezoning
request for a road on the "subject property" The Owners of
the "subject property , which sits between Mrs. Gushiken's
and ours, are now seeking rezoning to a parking lot and
possibly another commercial venture.
November 17, 1994, before the Planning Commission, I
repeatedly stated a Wiki Wiki Mart type business wasn't
acceptable and would oppose the development on that basis.
Commissioner Sally Rice cautioned me at one point saying
that once commercial is approved they could do anything. I
said that I trusted Dr. Takase's word and his
responsibility as a developer. Now I know better.
Commercial is carte blanche for whatever the developer
wants to do and it's forever!
In the Resource folder, you will find an accounting of events
that are the bases for our request for denial.
The original rezoning application is signed by Howard
Ainsley, former Administrator of Hilo Medical Center. It is a
proposal for a parking lot restricted to employees of 72

• Puuhonu Place, commonly known as Punahele Surgery
Center. Now, it appears to be an application for commercial
zoning which might, as an apparent afterthought, include a
parking lot that was previously so urgent!
Thomas and Louisa Yamauchi, 73 Punahele, submitted a
support letter citing that the "visitors need parking and this
would prevent them from parking in our yards and
driveways". The only "visitors" are to the HCCC on
weekends and providing transport at any time bail is made,
sentences served, day or night and weekends - in on
Fridays by 6PM and out on Sundays around 6PM.
HCCC's two driveways are on either side of the proposed
commercial lot. Their traffic alone is a substantial burden on
Punahele. Their parking is also inadequate for both staff,
attorneys, visitors and other professionals. Nothing in the
application, the Memorandum of Agreement or any of the
• meetings with Mr. Fuke mentions the possible addition of
HCCC parking.
25+ vehicles with a minimum of 2 possibly even 4 or more
trips, traveling on Punahele to and from the proposed
parking lot, actually may translate to 50 or possibly 100
vehicle trips every day. We know from experience that
rezoning conditions can be and have been violated.
Therefore, the applicant's request for an unrestricted
rezoning condition means we could have a repeat of the
Surgery Center or worse -7 eleven, a cocktail lounge, etc.
I'm sorry, but I thought for decades that they didn't have
enough parking for their staff and now it's not apparently a
compelling concern. Still, patients at the Surgery Center are
being asked to sign a "pro parking lot petition.
What's the real reason for the rezoning?
Initial landscaping plans for the Surgery Center gave us a
continuous planting buffer zone for both dust/exhaust

• mitigation and privacy from the traffic at the Surgery
Center. It actually exacerbated the safety issue with errant
drivers crashing through the replacement fence as illustrated
in the photo folder before you - Ex.2. This was the second
Toyota to hit while reversing but without making to the
chain link fence. Every day, Coke, Hawaiian Waters, Suisan,
Fire Department ladder truck/rescue unit, Office Depot
vehicles travel that same traffic pattern as that Toyota.
That's not the kind of surprise that I would like to find in my
home anytime!
The subject property was used as an illegal parking lot by
the Center's employees, patients, HCCC guards with
permission from Dr. Takase (which they told us and police),
HCCC visitors, lunch, cell phone conversations, "talking
story", picnics in diesel trucks running engines for 30 to 60
minutes as they sat in the lot in air conditioned comfort
while we got their exhaust, and trucks with bed full of
• household garbage parked for hours in the hot sun. HCCC
weekenders waited in vehicles engaging in activities better
suited to a hotel room, drank beer, smoked the last
marijuana joint, urinated and littered along the fences
bordering both Gushiken and Reis homes. Most reverse
parked with their exhaust facing our homes. This was
24/7/365 until we complained yet again.
The Gushikens and us were now bordered on 3 sides of our
homes, by parking lots!
For 22 years, the Takases have been adamant about the
parking shortage. In testimony before the previous County
Council we were labeled by Surgery Center physicians as
"selfish" for not giving up our homes for the parking lot and
that's why, Hilo has "no doctors".
The medical/professional office building has always housed a
• lunch shop with lots of people coming from off the property
to buy food and eat in their vehicles in the Center's parking

lot. How does this affect the parking shortage? And
suddenly, they don't want to be restricted to a rezoning
condition of being only a parking lot and might do another
"commercial venture" -say marijuana dispensary?
The proposed Memorandum of Agreement was initiated by
Sidney Fuke and written by Gerald Takase, part owner of the
"subject property even though I explained that mitigation of
a parking lot wasn't possible in our situation.
He initially set an escrow fund figure of $10,000 for 10 years
and a system where we could report infractions that we
couldn't settle if parking rules were violated. If disputed, the
fund could be used to retain an attorney to resolve the
issue. When, several months later, he transmitted the MOA
to Mrs. Gushiken and me by mail, the amount was $5,000
and 5 years. This agreement was contingent on us
supporting the rezoning. We would never sign such an
• agreement. We know, again from experience that, no
matter how many times we "complain" about the violations,
there will be little relief until the next complaint unless there
is change. The applicant wants "no restrictions" on his
future development.
22 years later, we're still policing violations. I am a retired
Police Major, and have no wish to nor should anyone else be
compelled to continue "policing" others' violations.
Developers need to be TRUSTED AND RESPONSIBLE to "do
the right thing" or don't do it at all!
The Takases got their building approved and built with
safeguards by the County to hopefully protect our
neighborhood and our quality of life. I believe it to be unfair
for the Takases to overreach and try to change the deal they
agreed to after they received the benefits. It's an
Ordinance! It's the law!

You have the power to preserve our unique lifestyle. Please
visit the site on a regular work day. See the situation and
the negative impact that anything commercial, including a
parking lot will have on the neighborhood and our quality of
life!
This is our home, not just a place to park our car!

urge the Planning Commission to deny Komohana '79s request to rezone
the area to the rear of our propertied from residential to neighborhood
commercial.
The rezoning would definitely bring mo_re' traffic to an already congested
area on Komohana with a hazardous ingessjegress access. Komohana Street
presently has_ upwards of several hundreds of vehicles passing the
proposed reponing area which is immediately to the rear and Puna side
of our residential properties. Consider the noise and exhaust fumes
from the vehicles starting up and accelerating to leave the parking
lot of such a commercial venture.
• Further, such businesses (to be cost effective) would be required„ to open
as some in operationythrough 10 PM or later each day. Consider the
additional noise from customers and vehicles in the area.
•
After closing, the businesses would probably appreciate the added
security lighting brings and may possibly adopt some similar to
the present Medical Center, which are orange and offer maximum
lighting for lower costs. On any given evening, pass the Center
and observe the area lit and imagine having an orange glow cast
into the bedrooms of your residences every night, all night.
The bedrooms of our residences will also face the proposed rezoning
area.
Consider also, that our residences already are faced- with the Hawaii
Correctional Facility which causes some noise and traffic in the
area.
With the influx of additional traffic, pedestrians, etc. , how
will our already tenuous privacy and quality of life be threatened:
This may appear to be an overreaction to the proposal, but I ask
each ot you::to place yourselves in our homes and imagine our
distress at this prospect. Burglaries, robberies and street people
have now become a way of life in Hilo. 1 believe that, if the
proposal is approved, we, the "Neighborhood" will suffer the
consequences or have to pay by reducing the "quality ot our lives"
• for someone else to make a profit.

Further, Mother Nature may also protest the development. Several
years ago, the property in question was: bulldozed ostensibly to
permit taro farming. Shortly thereafter, when no planting appeared,
we had extremely heavy rains twice within a six month period. All
of our residential properties were plagued by heavy water runoff
of flood proportions that swept through our properties causing
minor damages. I urge caution in view of
g the already heavy land
clearingand construction - Komohana
that has taken place above Street
after the flooding. How will the increased clearing of those lands
and that to the rear of us affect future water runoff/management.
In closing, please consider the presence of the ubiquitous 7-tleven
just up the street and all of
the commercial area of downtown that
surely deserves some support and not a competitiv4 commercial
venture in the middle of a residential and established neighborhood.

Subject: Rezoning Application (REZ 14-000175)—Kilo Medical Center

As you may be aware,this application has been deferred at the applicant's request to
enable the applicant and/or the landowner to discuss and hopefully reach an understanding with
• two (2) adjoining property owners (Ms. Cheryl Reis and Mrs. Marjorie Gushiken). Although
considerable progress has been made to identify and-address their concerns, a memorandum of
understanding unfortunately could not be consummated.
The discussions were essentially between Ms.Reis,the spokesperson for both property
. owners, and this office. Based on these discussions,the proposed mitigations to address or
• mollify their concerns are outlined in the attached draft of a Memorandum of Agreement
("MOA"). This MOA was developed by the landowner and subsequently shared with Ms. Reis.
However, no progress has been made since then, and the MOA regrettably remains
unconsummated as of this date. There is no telling whether one can or will ever be reached.
Accordingly,the applicant respectfully requests that your office finalize your review of
the pending application and schedule it for your meeting of July 7,2016. During the interim,
however,the applicant will continue to see whether a MOA can still be reached.
•
Notwithstanding the absence of an executed MOA,the applicant is still prepared to
accept most of the conditions outlined in the draft MOA. If the request were favorably
considered,the applicant understands that there May be an issue regarding the appropriateness of
incorporating some of the conditions outlined in the draft MOA as part of the rezoning
ordinance. Given that,the applicant would like to note that:
a Proposed conditions (A-2 to A-4)relate to design and not use restrictions and thus
could be deemed appropriate in the rezoning ordinance;
b. Restricting the site for only parking and prohibiting uses otherwise permitted in the
CN zoning may be questionable. As such,the applicant would be willing to accept a
condition where,prior to issuance of Plan Approval for any non-parking lot use,the
• Windward Planning Commission be asked to provide comments on the new use and
recommend appropriate mitigation(such as setback,hours of use,landscaping, etc.)
for the Planning Director's consideration;

c. The applicant/landowner is still prepared to adhere to proposed condition A-5 relating
to constructing additional landscaping barriers along the common boundaries of all
parties; and
d. Finally,with respect to proposed condition B,that would be applicable only if a MOU
is executed. Nevertheless,the applicant and landowner intend to earnestly and
responsibly comply with the terms of all conditions of the rezoning ordinance so as to
obviate the need for the neighbors to pursue their independent enforcement.

•
WHEREAS, GELOCAG is the owner of Tax Map Key: (3)2-3-035:018,which is situated
between the Reis and Gushiken properties; and
WHEREAS, GELOCAG is seeking to rezone said lot to be used as a parking lot for the
benefit of the ASSOCIATION OF APARTMENT OWNERS of the Puuhonu Professional
Building's employees and staff; and
WHEREAS, in order to support the rezoning which is being smelt,Mrs_Reis and Mrs.
Gushiken would like to see conditions placed on the property to assure its reasonable use; and
WHEREAS,to ensure compliance with these terms, an escrow fund will be set up that
may be used to remedy.any suct:violations-of the conditions.
NOW, REFORE,:tliep.arties agrees follows: _
A. That the following conditions shall be incorporated for its use:
1) Use of-tlie"subject property; in-spite of its CN zoning,shall be restricted to . .. ... .

. boundaries. Said barrier shall be installed prior to the subject site's use as
a parking lot.

B. In order to ensure compliance with the above conditions, GELOCAG and AOAO
of Puuhonu Professional Building, its successors or assiPns,shall create an
escrow fund of$5,000.00, which funds could be used by Mrs. Reis/Mrs.
Gushiken to ensure enforcement with the above conditions, should attempts to
correct or enforce the conditions set forth above not be complied with.

C. An Administrator of the fund,to be mutually selected, shall be named who will be
• responsible for taking the complaints,insuring reasonable compliance, and if it is
determined that noncompliance is taking place,may authorize the use of the fund
to ensure compliance with the above conditions,to include legal action to ensure

D. Should the funds be depleted because of noncompliance by GELOCAG or AOAO
of Puuhonu Professional Building,its successors, assigns,tenants,staff or
employees,where the Administrator has authorized the use of the escrow fund to
ensure compliance,the fund will be replenished to its $5,000 limit.
E. This agreement shall continue for a period of ten(10)years or until Mrs. Reis or
Mrs. Gushiken,their heirs or assigns,no longer have an interest in the property,
whichever comes first.

Members of the Commission:
My name is Marjorie Gushiken and I am 87-years-old. I live at
51 Punahele Street, TMK 2-3-025-017, adjacent to the subject
property 2-3-035-018. My family has lived here for over 45
years.
I am writing this letter to testify against the re-zoning of
Parcel 18 from residential to commercial. I strongly object to
having a parking lot next to my home.
At one point in time, said lot was cleared of brush and used as
a baseyard for development of the Ainako Sewer Project. During
the two year period, my family was subjected to toxic exhaust
fumes and disturbing noise from constant vehicular traffic. My
health was seriously compromised by causing me to suffer daily
headaches and requiring me to be under doctor' s care.
• Subsequently, employees and staff of the Puuhonu Professional
Building as well as staff and inmates from Hawaii Community
Correctional Center started using said property as an illegal
parking lot. Again my family was subjected to exhaust fumes from
people reverse parking and disturbances from vehicular traffic.
In addition, we were fearful for our safety as inmates, their
visitors and anyone parking there, could look directly into my
home. We had no privacy from anyone else who used the illegal
parking lot because it was convenient. There was drinking and
other disturbances going on with no one to monitor these illegal
activities. I understand that there is a proposal from the
owners, GELOCAG, but I know that what they propose will not be
feasibly enforceable.
I believe that I am entitled to live in a safe and healthy
neighborhood. I also believe that I, along with my family and
guests, am entitled to the enjoyment of my home which is highly
unlikely with re-zoning parcel 18 to commercial.
I sincerely hope that all of you here today will take my
concerns into consideration. As a long time resident of this
community, I would like to have the peace of mind that I and my
family will continue to live in a healthy and safe neighborhood.

Dear Councilman Chung:
My name is A. Stephen Woo, Jr., and I have lived on Halai Hill for
over 40 years.
In objecting to the zoning change of the property at 49 Punahele
Street (TMK 2-3-035:018) from Family Residential (RS-7.5) to
Neighborhood Commercial (CN-7.5), the Halai Kumiai offers three
points for consideration:
1. Residential remains the best use of this parcel.
Punahele Street, a narrow street with marginal shoulders, is
suitable only for residential and not commercial traffic. Moreover it
• lacks sidewalks which forces students to walk on the roadway to attend
Hilo Intermediate School nearby.
2. Loss of residential (RS-7.5) zoning will profoundly
affect the neighborhood.
The Single Family Residential zoning provides homeowners a
certain degree of safety and security for their families. Stripping this
protection from the area would introduce activities and enterprises of
uncertain nature and present new and complex problems for those
living there.
even then, residential zoning is not always protective. For
example, one of our Kumiai members lives next to the lot in question.
She and her husband, now deceased, built their home forty-five years
ago when the area was semi-rural and tranquil. But a few years ago the
lot was put into use as parking lot for the benefit of personnel working
nearby.
This was in clear violation of the residential zoning code.
For years the poor woman suffered from exhaust fumes and noisy
diesels as drivers reverse parked their vehicles just a few feet from her
bedroom window.

• Only after a complaint was filed in 2011 did the activity stop.
(Planning Department file 2011-036E) Sad to say, this was not the
first complaint of violation,for the Notice of Violation records a
similar violation in 2006. The lot owner callously ignored that NOV
at the cost of the poor widow's quality of life.
3. Why is there a parking problem?
The answer is taken directly from the "Notice of Submittal" from
the Hilo Medical Center:
"While there is on-site parking that satisfies the minimum
requirements of the Zoning Code, HMC believes that additional parking
proximate to these buildings is still needed."
To be blunt, the term minimum requirements, means "do the least
you can get away with."
Quite obviously a fundamental shortage of spaces existed from the
very start!
Even worse, there is poor planning regarding the convenience and
location of parking areas. The large building at 73 Pu'u Honua Place
offers only eleven parking spaces in front (three of which are for
• disabled). When these are full, patients must walk up hill and cross a
busy driveway (which incidentally has no designated crosswalk) to
reach their cars in stalls carved out of foot of Halai Hill. Ironically, an
orthopedic surgeon has his office in the facility!
In summary, inadequate planning and poor design are the
fundamental cause of the problem, and adding a few spaces helter-
skelter to the detriment of the safety and well-being of the
neighborhood is not a just or practical solution.

• Dear Council Members,
Thank you for taking the time to review our resource data in
support of this denial request. Some of the information was
taken from a similar but larger submission in November,
2011, which also requested and received a denial of this
same rezoning issue.
I apologize that we were not able to reproduce enough
copies of that submission but do have a copy available for
your perusal if you desire it. I would also appreciate the
return of the folders for possible future use.

The main points at issue in asking for the denial of
this rezoning request are the rezoning conditions that
have been continually violated since the Ordinance
granting them took effect in 1994 and continue to the
present.
• Use of the "subject property" as ingress/egress to
Punahele Street.
• Use of the "subject property" as an unpermitted
parking lot.
• Failure to maintain a planting buffer screen across the
rear boundary of the Gushiken home

• proposal for a parking lot restricted to employees of 72
Puuhonu Place, commonly known as Punahele Surgery
Center. It appears to have changed to an application for
commercial zoning which might, as an apparent
afterthought, include a parking lot that was so urgent and
we have been battling against for 22 years!

parking lot on the "subject property".
Although I feel for them on the parking issue, I believe that
it is not our sacrifice to make. We live here!
The planned lot has a capacity of 25+ vehicles with a
minimum of 2 possibly even 4 or more trips, traveling on
Punahele to and from the proposed parking lot, realistically
may translate to 50 or possibly 100 vehicle trips every day.
• This doesn't even include family members, car repairs and

other intrusions which we've already experienced. We
• novices didn't realize the peripheral activities associated with
every component of development such as maintenance, use,
etc. The violations then became our education.
We also tried initially before the Surgery Center was
comleted to get the Takases to agree to "no reverse parking
or running engines while parked" and we were refused by
Dr. Takase saying that "he couldn't tell people how to park.
We know from experience that rezoning conditions can be
and have been violated. Therefore, the applicant's request
for an unrestricted rezoning condition means we could have
a repeat of the Surgery Center or worse -7 eleven, a cocktail
lounge, etc. I'm sorry, but I thought for decades that they
didn't have enough parking for their staff and now it's not
apparently a compelling concern.
Initial landscaping plans gave us a continuous planting
buffer zone for both dust/exhaust mitigation and privacy
from the traffic at the Surgery Center. A complaint was
made by the neighbors to the Board of Appeals to force
compliance with the required landscaping plan
implementation, (another rezoning condition violation) along
the common border with the Surgery Center's parking lot
and our adjoining homes. Without it, we were stripped of
privacy, dust and noise mitigation and safety. The vinyl
fencing (we ultimately agreed to because "termites" were
attacking the existing podocarpus, or the root system was
disturbing their retaining wall), did nothing to mitigate the
impact of the parking lot. It actually exacerbated the safety
issue with errant drivers crashing through the fence as
illustrated in Exhibit 2 in the photo folder before you.
This latest was also a Toyota. The previous Toyota while
reversing, hit a podocarpus tree without making to the chain
link fence. Every day, Coke, Hawaiian Waters, Suisan, Fire
Department ladder truck/rescue unit, Office Depot travel
that same traffic pattern as that Toyota. That's not the kind
• of surprise that I would like to find in my bedroom anytime!

A required rezoning condition of a continuous planting of
podocarpus was replaced, with our approval as "good
neighbors" because the termites were eating them and/or
their root system was creating problems with their retaining
wall.
That continuous planting was to have spanned the entire
hamakua boundary but never made it across the intended
access to the "subject property" and more recently, was cut
down across the Gushiken's boundary with Rehab of the
Pacific. Mrs. Gushiken, directly below, and Mrs.
Andrade across Mrs. Gushiken on Punahele Street
have no privacy. Ex.3 & 4
By County Ordinance, rezoning conditions were to be
followed when they received approval for the development in
1994. Yet, the only time any remediation occurred was
when we complained till the next time.
• Haitsuka Brothers used it as their baseyard during the
County Ainako sewer alignment project from 1994 to
the end of 1996. Approximately 77,000 cubic yards of
material was excavated from the base of Halai Hill
(a/k/a Termite Hill) where the the former Straub Clinic
parking lot and Rehab of the Pacific now sit, by several
construction companies using again prohibited access
onto Punahele Street, and trucked it all over the city of
Hilo. No permit obtained till I asked about it. This
occurred from 1994 to 1996 and was allowed to
continue by the County in spite of our numerous
complaints to Public Works and Department of Health.
Jiro Sumada, then head of DPW talked to Gerald
Takase, part owner of the subject property, who was
then first Deputy Corporation Counsel. Each respite
was short-lived until we made the next complaint.
• All construction of the Surgery Center used the "subject
property as ingress/egress from Punahele Street in
continued, unbroken violation of the rezoning condition
prohibiting it. We complained almost daily and it
• continued for years.

• The `subject property" was graded (permit?), then
• filled with gravel and became an illegal parking lot with
literally anyone parking there - the Center's employees,
patients, HCCC guards with permission from Dr. Takase
(which they told us and police), HCCC visitors, lunch,
cell phone conversations, "talking story", picnics in
diesel trucks running engines for 30 to 60 minutes as
they sat in the lot in air conditioned comfort while we
got their exhaust. HCCC weekenders waited in vehicles
engaging in activities better suited to a hotel room,
drank beer, smoked the last marijuana joint, urinated
and littered along the fences bordering both Gushiken
and Reis homes. This included people setting up lawn
chairs, both at the paved edge of the Surgery Center
lot and in the graveled "subject property "to surveil
high profile inmates without the guards' knowledge till
we told them. Most reverse parked with their exhaust
facing our homes. This was 24/7/365 until we
complained yet again.
0 • Several years after the Surgery was completed and
occupied, we began hearing construction noise in or
near the building on separate occasions after 9PM,
sometimes midnight or 3AM. When I went up to
investigate and found contractors demolishing parts of
offices with a jackhammer, or renovating an office or
changing furniture. They were asked to stop and on
their refusal I called the police. Only then did they stop
and one returned about 2AM and I called the police
again.
• Thomas and Louisa Yamauchi, 73 Punahele, submitted
a support letter citing that the "visitors need parking
and this would prevent them from parking in our yards
and driveways". The only "visitors" are to the HCCC on
weekends and providing transport at any time bail is
made, sentences served, day or night and weekends -
in on Fridays by 6PM and out on Sundays around 6PM.
• HCCC's two driveways are on either side of the
• proposed commercial lot. Their traffic alone is a

substantial burden on Punahele. Their parking is also
inadequate for both staff, attorneys, visitors and other
professionals.
• Visitors usually arrive around 6AM on weekends,
parking in front of the "subject property's" gate.
During the week HCCC staff and visitors park in the
same location. It should be noted that neither 73
Punahele nor us at 65 can see down the street to
emerge from our driveways with vehicles parked there.
Mrs. Gushiken at 41 Punahele cannot see up the street
to emerge from her driveway. Former Councilman J
Yoshimoto had "no parking" signs posted on our side of
the street to alleviate the problem. If vehicles park
below Mrs. Gushiken's as they still sometimes do, the
can't see down the street to exit her driveway. She is
87 Years old and is still a great driver! Mrs. Andrade at
44 Punahele (and across the street from Mrs.
Gushiken), sometimes has vehicles on her shoulder
that obstruct her exit view from the lower side of
Punahele.
• HCCC visitors parking in the "subject property"
driveway continually leave their rubbish in the area and
since HCCC will not take responsibility for "anything off
their property whether on HCCC business or not, the
neighborhood catches the "fallout" as it did when the
lot is used for illegal parking by anyone including HCCC
staff, visitors or Surgery Center employees. Nothing in
the application, the Memorandum of Agreement or any
of the meetings with Mr. Fuke mentions the possible
addition of HCCC parking.
• The "subject property" isn't maintained and the
albezias on the property have fallen on Mrs. Gushiken's
home three times during the last wind storm and after
dark. Gerald Takase was called immediately by Mrs.
Gushiken's son, to remove the trees once. Another
time, during the same period, Gerald responded after
we called police that an albezia had fallen on the

"property's fence and was obstructing one lane of
• Punahele
• The "diurnal operating hours only" didn't cover the
Smithsonian personnel who occupied the building for
approximately 2 years, 24/7/365.
The Gushikens and us were now bordered on 3 sides of our
homes, by parking lots!
For decades now, the Takases have been adamant about
the parking shortage. In testimony before the previous
County Council we were labeled by Surgery Center
physicians as "selfish" for not giving up our homes for the
parking lot and, "that's why, Hilo has no doctors".
The Surgery Center has always housed a lunch shop with a
lot of people coming from off the property to buy lunch and
eat in their vehicles in the Center's parking lot. Could the
"non-medical" business account for the parking shortage?
And suddenly, they don't want to be restricted to a rezoning
condition of being only a parking lot and might do another
"commercial venture" — perhaps a marijuana dispensary?
We didn't initiate the Memorandum of Agreement idea
written by Gerald Takase, part owner of the subject property
and would never sign such a contract because we know, that
the experiences we have endured cannot be mitigated. We
know, again from experience that, no matter how many
times we "complain" about the violations, there will be little
relief until the next complaint unless there is change. The
applicant wants "no restrictions" on his future development.
Now 22 years later, we're still policing violations.
It should be noted that

• County Building Department

• Hawaii County Council
All spent time trying to resolve these issues with this project
and now 22 years later, we're still at it.
I am a retired Hawaii Police Major and during my 27 years
of service and, in addition to investigative and command
positions, I participated in planning facilities and reviewing
development plans for our community from a police
perspective of traffic and public safety.
I have seen the impact of so many demands on the physical
infrastructure and quality of life issues on our citizens is
compelling and must be dealt with now before we suffer the
burdens of overcrowding presently affecting Oahu.
We have a new senior housing area on Mohouli extension.
There is Dr. Peter Matsuura's planned Wailana development
(formerly University Terrace) bordered by Sunrise
Ridge/Estates, Mohouli extension and a new subdivision,
homes on upper Punahele and Komohana Street.
Councilman Aaron Chung, during a previous term was able
to reduce the size of that development by almost half in
response to community concerns about congestion both
human and traffic, public safety and ambient noise. Still,
the anticipated size is possibly 350 single family homes,
medical/doctor office buildings, about 100 condo units in 3
buildings, 200
9 , senior housing units and a shopping center
about 2/3 the size of Prince Kuhio Plaza.
Ponahawai Street has a mix of residential and commercial
above Homelani and Veterans' cemeteries, topped by

Pohahawai Medical which adjoins 9 other buildings - 8 for
medical (including the Surgery Center) and 1 credit union.
All of this using Komohana and its immediate feeder
streets of Punahele. Waianuenue and Haiti.
Presently, Punahele and Haiti (and its feeder streets of Alae,
Laimana, Kapiolani, Ululani, Kinoole and downtown) serve as
the main arteries for Hilo High, Hilo Intermediate and Hilo
Union Schools both to and from school.
Komohana is the main route to the Hilo Medical for
ambulance travel. Over the years, we've seen this use
increase to an average of 15+ a day with sirens and urgency
mode.
HCCC occupies the block bounded by Punahele, Komohana
and Waianuenue. In one movement, with sometimes at
least 5 passenger vans full of inmates, once a week, a
convoy leaves HCCC for the airport, Kulani, etc.
Do we really need to add more traffic and hazards to
Punahele and Haiti?
The proposed Memorandum of Agreement was initiated by
Sidney Fuke even though I explained that mitigation of a
parking lot wasn't possible in our situation. He initially set
an escrow fund figure of $10,000 for 10 years and a system
where we could report infractions that we couldn't settle if
parking rules were violated. If disputed, the fund could be
used to retain an attorney to resolve the issue. When,
several months later, he transmitted the MOA to me and
Mrs. Gushiken by mail, the amount was $5,000 and 5 years.
This agreement was contingent on us supporting the
rezoning.
The Takases got their building approved and built with
safeguards by the County to protect our neighborhood and

our quality of life. I believe it to be unfair for the Takases to
• overreach and try to change the deal they agreed to after
they received the benefits. It's an Ordinance! It's the
law!
Our pedestrian, bicycle, school children, exercisers, dog
walkers have increased dramatically. The narrow shoulders
and speed humps have slowed some vehicles but still
present a challenge. Our neighbor, Danny Johnson and his
wife, both strong disability advocates, are very concerned
with safety issues on our street for everyone.
Developers need to "do the right thing" or don't do it at all!
This Council represents all of Hawaii Island. Please visit the
site on a regular work day. See the situation and the
negative impact of anything commercial, including a
parking lot will have on the neighborhood and our quality of
• life!
