Recent events occurring at the Hilo Walmart have been brought to our attention: Unpermitted Construction Activity PRP has recently been made aware of an ongoing renovation project at the Hilo Walmart, located at 325 E Makaala St. Since July 2016, Walmart, California based general contractor Austin/Jones Corp., and numerous subcontractors have been performing work without the appropriate building permits for this $1 million (est. value) renovation project_ A search of the county's building department website has shown that there is currently no permit issued by Hawaii County for the work being performed. A recent call (8/10/16) to the Building Department's Hilo Office also confirmed that the work being performed at the Walmart lacks the proper building permit(s). PRP has made numerous attempts to understand why construction activities have not ceased and why Walmart and its contractors continue to perform work without a building permit. Potential Licensing Violations In addition to the unpermitted work, we also have reasons to believe that several subcontractors on site are operating without the appropriate contractor's license and are not registered to do business in the state. Attached is a RICO complaint that was filed highlighting our concerns of aiding and abetting unlicensed activity on the project. In 2014, Austin/loses was subject to a $100,000 RICO fine to settle a licensing violation that requires its Responsible Managing Employees (IR ME) to be in residence within the State of Hawaii for the duration of a construction project(CLB-2014-01171). Safety Concerns Safety violations were also reported to HIOSH, alleging unsafe use of a scissor lift which posed an imminent danger risk for both the worker and nearby shoppers. According to a conversation between a union representative and the foreman overseeingthe project, Blade Bollman, the work is a $1,000,000 renovation by Austin/Jones Corporation. [Exhibit 2] Austin/Jones Corporation has a temporary office setup in a trailer outside of the Walmart with signage listing the management team as well as other information pertaining to the project. [Exhibit 31 A permit search ofthe Hawaii County building division website revealed no building permits issued for work being done at the Hilo Walmart, 325 E Makaala Street, TMK: 22047074 (08/10/2016). PRP also placed a call to the Hawaii County Building Division's Hilo office on 08/10/2016 confirming that the Building Division was aware of the renovation work occurring at the Walmart despite not having any building permits issued. There appeared to be no attempts made to stop the unpermitted work. Over the course of the month, workers from four mainland based companies have been observed performing various tasks around the project. [Exhibit 41 These companies are as follows: 1. WATG Electric—no contractor's license' and business registration 2. Pacific Acoustic—no contractor's license and business registration 3. Full Court Floors—business registration only, no contractor's license 4. Pacific Refrigeration —possibly no contractor's license and business registration-- -Don egistration"*Don Lesueur (), listed as the electrician on the trailer poster, maintains an electrician's license in Hawaii. We have not been able to confirm his presence on the job site or his connection to WATG Electric as he is licensed as a sale -owner attached to no company. "Our union representative spoke to an employee of Pacific Refrigeration and the worker stated that they were based out of San Diego. However, there exists a Pacific Refrigeration based in Oahu that maintains a valid contractor's license and business registration, but we have not been able to confirm which company is performing the work. We believe that Austin/]ones Corporation, as the general contractor, may be allowing unlicensed contractors to perform work in the state of Hawaii. According to Hawaii Revised Statutes, 4444-9.3, Aiding or abetting: "Aiding or abetting on unlicensed person to evade this chapter or knowingly combining or conspiring with an unlicensed person, or allowing one's license to be used by an unlicensed person, or acting as agent or partner or associate, or otherwise, of an unlicensed person, with rhe intent to evade this chapter, shall be a misdemeanor." If there is unlicensed contracting activity, this raises a question if other laws are being violated such as "failure to withhold State income tax (HRS Chapter 235) and nonpayment of unemployment contributions to the state of Hawaii (HRS Chapter 383). While monitoring the project through July and August, we have not been able to locate the three RME's on site that Austin/Jones has listed on the Professional & Vocational Licensing website: Randall Austin, Dixon Hyde, or Ivan McIver. Requests to speak to a Responsible Manager have been forwarded to Randall Hale, the Senior Project Manager. PRP believes that contractors who do not follow our industry laws and regulations and participate in unlawful business practices create an unfair competitive environment, depresses the local workforce and wages, and creates a potentially unsafe project for the public consumer. The work was observed at 325 E Makaala St, Hilo, Hawaii 96720 and is are cause for concern as the existence of imminent danger for the safety of the workers purnari'Vona to disregard of fall safety and unsafe use of maconery around the public, please find attached picture. The potential unsafe work environment and safety violations are as follows_ Alleged Contractor WATG Electric 615 Bull River Rd, Highland, UT 84003 We have not been able to find a valid electricians license or business registration in Hawaii's database for this company.
