Home My WebLink AboutRES 635 Draft 01 2014-2016 • �J�YY OFN COUNTY OF HAWAII •f •!- STATE OF HAWAII �TE.OF%4 RESOLUTION NO. 635 16 A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM THE MANAWALEA STREET EXTENSION WITHIN TAX MAP KEYS 7-4-021:041 AND 7-4-021:048 FOR KAMAKANA VILLAGES AT KEAHUOLU, AT NORTH KONA, HAWAII, FOR FOREST CITY. WHEREAS, applicant Forest City has requested to extend the sewer in accordance with Section 21-26, Hawai`i County Code within Tax Map Keys 7-4-021:041 and 7-4-021:48, which is owned by FHT Kamakana LLC, for development of the Kamakana Villages; and WHEREAS, applicant Forest City will construct and bear the full cost of the extension and will be eligible to exercise conditions under Section 21-28(a), Hawaii County Code, granting reimbursement to the applicant for 10 years after completion of the extension of one- half of all monies for sewer charges collected by the County from other properties connecting to the extension provided that the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension; and WHEREAS, the Director of Environmental Management has recommended approval of the extension according to Section 21-27, Hawaii County Code; and Attachment "A" is an application for sewer extension from Forest City with a location map; and WHEREAS, sewer extensions are beneficial to the community by eliminating existing cesspools and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, Section 21-26, Hawai`i County Code, requires that the Council approve all sewer extensions; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that the sewer extension with the Manawalea Street extension for Kamakana Villages at Keahuolu within Tax Map Keys 7-4-021:041 and 7-4-021:048 for Forest City is hereby approved. BE IT FURTHER RESOLVED that the request of the applicant to be reimbursed for the cost of the sewer extension in accordance with Section 21-28(a) is hereby approved. BE IT FINALLY RESOLVED that the Clerk of the County of Hawaii transmits copies of this resolution to the Departments of Finance, Public Works, and Environmental Management.
