Location and Description of the Property: The irregular shaped Property, being Lot
11-A, being portions of Royal Patent Number 2237, Land Commission Award Number
8518-B, Apana 1 to Kanehoa(Certificate of Boundaries No. 63), and Land Patent Grant
Number 12546, Part 4, to Richard Smart, is situate at Ouli, Waimea, District of South
Kohala, County and Island of Hawaii, Hawaii. The Property consists of approximately
+208.191 acres and is located makai of the Queen Ka'ahumanu Highway, and forms the
heart of the Mauna Kea Resort ("Resort")development (Exhibit A - Tax Map). The
Mauna Kea Beach Hotel is located along the Property's western boundary and is
surrounded by the 18-hole Mauna Kea Golf Course. The Property is classified Urban by
the State Land Use Commission, zoned Resort-Hotel (V-1.25), Single Family Residential
(RS-20)and Open (0) along the shoreline under the Hawaii County Zoning Code,
designated primarily Resort Node with a slim band of Open along the shoreline on the
County's General Plan LUPAG map, and is located entirely within the SMA.
II. Purpose of the Request: The Property is currently split-zoned Resort-Hotel (V-1.25),
Single-Family Residential (RS-20) and Open(0). This zoning configuration reflects the
original zoning upon the initial adoption of the Zoning Code, as well as subsequent
zoning established under the various Zoning Ordinances' approved to implement the
Resort Master Plan. The Resort marked its Golden 50th Anniversary in 2015, and
although the Resort remains timeless, a comprehensive upgrade effort is being
implemented to keep up with current global market trends. The Applicant is seeking a
non-significant adjustment of the zoning boundaries that will conform to existing uses
and provide appropriate zoning designations for new Resort elements proposed under the
pending Master SMA Use Permit application("proposed action") (Exhibit B -NZC
Maps and metes/bounds descriptions).
III. Calculation of Land Area and Percentages: As summarized in the table below, the
Property is+208.191 acres in size. The areas sought for the proposed zoning changes
would result in: (1) a minuscule decrease in the Open zoned designation by -0.495 acre or
0.002%of the Property, (2)with a comparable minor increase in the Resort-Hotel
designation by+0.495 acre or 0.002%of the Property, (3) a net zero change in the
Single-Family Residential designation, and (4) a 0.990 acre total area of change of the
Property. As a consequence,the proposed action does not affect more than 5%of the
Property or more than one-acre,whichever is less.

IV. Criteria for Determination: Pursuant to Section 25-2-45, HCC regarding Non-Significant
Zoning Changes,the Planning Director may administratively grant non-significant zoning
changes,provided however, that such zoning adjustments must comply with the
designations for the property set forth in the general plan and any development plan
adopted by ordinance, and must not result in an increase or decrease in any zoning
designation affecting more than five percent of the area, or one-acre, of any lot,
whichever is less.
The proposed action complies with the criteria set forth in Section 25-2-45(2), HCC for
determining non-significant zoning changes for the following reasons:
1. The County of Hawaii General Plan (2005) became effective on February 9,2005.
The Property is designated Resort Node2 and Open on the LUPAG Map.
Therefore, the proposed action is consistent with the General Plan designations
since appropriate zoning designations for the existing and proposed Resort
elements will continue to maintain the quality, ambiance and character of the
existing Resort;
2. The South Kohala CDP was adopted by the Hawaii County Council through •
Ordinance No. 08-159 on November 20, 2008. The Property is located within the
South Kohala CDP Kawaihae area. The proposed action for resort destination

3. The proposed action does not result in an increase or decrease in any zoning
designation:

change in the Open zoned district of-0.495 acre is 0.0002%of the
Property, (ii)the net area of change in the Resort-Hotel zoning district of
+0.495 acre is 0.0002% of the Property and (iii)the net area of change in
the Single-Family Residential zoning district is net zero, and
(b) affecting more than one-acre of the Property since the total area of change
is 0.990 acre.
