HomeMy WebLinkAboutRES 665 Draft 01 2014-2016COUNTY OF HAWAI' I STATE OF HAWAI' I RESOLUTION NO. 665 16 A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM THE INTERSECTION OF LAIMI STREET AND ONOMEA STREET WITHIN TAX MAP KEYS 2-8-007:092 AND 093 FOR THE PU`U`ALALA VILLAGE MUTUAL SELF- HELP PROJECT AT PEPE'EKEO, SOUTH HILO, HAWAII FOR HAWAII ISLAND COMMUNITY DEVELOPMENT CORPORATION. WHEREAS, applicant Hawaii Island Community Development Corporation (HICDC) has requested to extend the public sewer in accordance with section 21-26, Hawaii County Code 1983 (2005 Edition, as amended), within Tax Map Keys 2-8-007:092 and 093, which is owned by HICDC, for the Pu`u`alala Village mutual self-help project; and WHEREAS, HICDC, a 501(c)(3) nonprofit housing development organization, is coordinating development of the Pu`u`alala Village mutual self-help project, a 30 -unit project whereby eligible applicants are supervised in making sweat equity contributions to construct each other's units; and WHEREAS, applicant HICDC will bear the total cost of the construction and in the future, will be eligible to exercise conditions under Section 21-28(a), Hawaii County Code 1983 (2005 Edition, as amended), pertaining to receipt for 10 years after completion of the extension one-half of all moneys for sewer charges collected by the County from other properties, if any, connecting to the extension, provided the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension; and WHEREAS, plans to reimburse the applicant for construction of the sewer extension shall require the approval of the County Council by resolution; and WHEREAS, the Director of Environmental Management has recommended approval of the extension according to section 21-27, Hawaii County Code 1983 (2005 Edition, as amended); and Attachment "A" is an application for sewer extension from HICDC, with a location map; and WHEREAS, sewer extensions are beneficial to the community by eliminating the need of alternative waste treatment options and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, section 21-26, Hawai' i County Code 1983 (2005 Edition, as amended), requires that the Council approve all sewer extensions; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the extension of the public sewer from the intersection of Laimi Street and Onomea Street for HICDC at Pepe`eke6, South Hilo, within Tax Map Keys 2-8-007:092 and 093, for the Pu`u`alala Village mutual self-help project, is hereby approved. BE IT FURTHER RESOLVED that the request of the applicant to be reimbursed for the cost of the sewer extension in accordance with Section 21-28(a), Hawaii County Code 1983 (2005 Edition, as amended), is hereby approved. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii transmits copies of this resolution to the Departments of Finance, Public Works and Environmental Management.
