AN ORDINANCE NAMING THE NORTH KOHALA COURTHOUSE AND AMENDING CHAPTER 15, ARTICLE 8, SECTION 15-68.1 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO THE PARKS AND RECREATION FACILITY SCHEDULE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to name the North Kohala Courthouse Building in Kapa`au, located at 54-3900 Akoni Pule Highway, to "Hale Kealoha `o Kohala." The County of Hawai `i acquired the parcel from Kohala Sugar Company by deed recorded on March 31, 1920, and the Judiciary, State of Hawaii, built the North Kohala Courthouse on the County's parcel in or about 1975. The Judiciary on October 29, 2012, informed the County of its offer to donate the North Kohala Courthouse building to the County on an "AS IS" and "WHERE IS" basis with no cost to the County. The County recently began using this as a gathering place for numerous activities. The residents of North Kohala are proud that many of these activities will bring seniors together. It is time to move on from informally calling this building "the old courthouse building" by naming the building "Hale Kealoha `o Kohala," which can be roughly translated to "love of Kohala building" or "home of love of Kohala." SECTION 2. Pursuant to Section 15-67(a)(4)(A) of the Hawaii County Code 1983 (2005 Edition, as amended), which provides that structures within recreational facilities of the County shall be named for a "neighborhood, community, region, district, or other identifying geographic location," the North Kohala Courthouse Building in Kapa`au, located on that parcel specifically identified as Tax Map Key: (3)5-4-005-001, and situated at 54-3900 Akoni Pule Highway, Kapa`au, in the District of North Kohala, Countv and State of Hawaii is hereby named "Hale Kealoha `o Kohala." SECTION 3. Chapter 15, article 8, section 15-68.1 of the Hawaii County Code 1983 (2005 Edition, as amended), is amended by adding a new facility structure name to the "Kohala" section to be appropriately inserted and to read as follows: "Hale Kealoha `o Kohala" SECTION 4. New material is underscored. In printing this ordinance, the underscoring need not be included. SECTION 5. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end, the provisions of this ordinance are declared to be severable. SECTION 6.
