COUNTY OF HAWAII STATE OF HAWAII 'AEWl4'i' RESOLUTION NO. 67o 16 A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM THE MAKALA BOULEVARD EXTENSION WITHIN TAX MAP KEY 7-4-020:015 FOR THE KONA JUDICIARY COMPLEX AND FOR FUTURE IMPROVEMENTS AT KEAHUOLU, NORTH KONA, HAWAII, FOR QUEEN LILI`UOKALANI TRUST. WHEREAS, applicant Queen Lili`uokalani Trust has requested to extend the public sewer in accordance with Section 21-26, Hawai`i County Code 1983 (2005 Edition, as amended), within Tax Map Key 7-4-020:015, which is owned by Queen Lili`uokalani Trust, for development of the Kona Judiciary Complex and for future improvements; and WHEREAS, the planned sewer extension is approximately 56 feet in length, beginning at the intersection of Makala Boulevard and Kamakaeha Avenue running east, to provide service to the Kona Judiciary Complex and to allow flexibility for future development in the area; and WHEREAS, applicant Queen Lili`uokalani Trust will construct and bear the full cost of the extension and will be eligible to exercise conditions under Section 21-28(a), Hawai`i County Code 1983 (2005 Edition, as amended), granting reimbursement to the applicant for 10 years after completion of the extension of one-half of all monies for sewer charges collected by the County from other properties connecting to the extension, provided that the total of such reimbursement shall not exceed the cost incurred by the applicant to construct the extension; and WHEREAS, the Director of Environmental Management has recommended approval of the extension according to Section 21-27, Hawai`i County Code 1983 (2005 Edition, as amended); and Attachment"A" is an application for sewer extension from Queen Lili`uokalani Trust with a location map; and WHEREAS, sewer extensions are beneficial to the community by eliminating existing cesspools and reducing the amount of pollutants reaching the groundwater and the coastal waters, resulting in a cleaner, healthier environment; and WHEREAS, Section 21-26, Hawai`i County Code 1983 (2005 Edition, as amended), requires that the Council approve all sewer extensions; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the extension of the public sewer from the Makala Boulevard extension for the Queen Lili`uokalani Trust at Keahuolu,North Kona, within Tax Map Key 7-4-020:015, for the Kona Judiciary Complex and for future improvements, is hereby approved. BE IT FURTHER RESOLVED that the request of the applicant to be reimbursed for the cost of the sewer extension in accordance with Section 21-28(a), Hawai`i County Code 1983 (2005 Edition, as amended), is hereby approved. BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i transmits copies of this resolution to the Departments of Finance, Public Works, and Environmental Management.
