COUNTY OF HAWAII STATE OF HAWAII • �OFN►� , RESOLUTION NO. 707 16 A RESOLUTION URGING THE 2017 HAWAII STATE LEGISLATURE TO PREVENT ANIMAL CRUELTY BY PROHIBITING THE UNSAFE TETHERING OF DOGS. WHEREAS, the improper use of tethers on dogs can cause deficiencies in meeting the physical and behavioral needs of dogs and lead to injury or death. Tethers can become tangled or caught resulting in a risk of strangulation. They are sometimes very heavy or short, or both, limiting a dog's mobility to a small area that also may be the site of the dog's own waste; and WHEREAS, there continue to be reports of improper tethering by dog owners in this state; and WHEREAS, the Council believes, that to ensure that dog owners care for their dogs in a safe and humane manner using best practices in the tethering of their dogs, current state law on this subject, found in paragraph 711-1109(1)(g), Hawaii Revised Statutes, should be amended to read (material to be added is underscored, material to be repealed is bracketed and stricken): "(1) A person commits the offense of cruelty to animals in the second degree if the person intentionally, knowingly, or recklessly: , , , (g) Tethers, fastens, ties, or restrains a dog to a doghouse, tree, fence, or any other stationary object [by-means]: (i) By means of a choke collar, pinch collar, or prong collar; provided that a person is not prohibited from using such restraints when walking a dog with a hand-held leash or while a dog is engaged in a supervised activity; [or] (ii) In a configuration that: (A) Entangles and endangers a dog; (B) Limits a dog's movement in an unsafe or unsanitary condition; or (C) Causes injury to a dog; or (iii) By use of a restraint that is shorter than three times the length of the dog, as measured from the tip of the dog's nose to the base of the dog's tail, or five feet, whichever is greater; or. . . ," ; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the members of the Hawaii State Senate and the Hawai`i State House of Representatives are encouraged to introduce legislation to amend section 711-1109 as provided herein. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable Governor David Y. Ige, the Honorable Speaker of the Hawai`i State House of Representatives, the Honorable President of the Hawai`i State Senate, the Honorable Mayor William P.
