This equipment will be used by the Department of Environmental Management to continue their program to collect used motor oil from island residents who change their own motor oil. The Department of Environmental Management is requesting that this resolution be waived from the Finance Committee and be placed on the November 16, 2016 Council agenda. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The State of Hawai'i Department of Health Solid & Hazardous Waste Branch (DOH) previously funded the County's Do-It-Yourself Used Motor Oil (UMO) Program ("Program"). Grant funding for this Program ended in FY2015 and the County has funded the continuation of this valuable recycling program to maintain service to the hundreds of residential DlYers on island. UMO containment units were purchased with DOH Grant funds and DOH has agreed to transfer ownership of those containment units to the County to continue providing the Program services. The Department of Environmental Management recommends acceptance of the equipment purchased with grant funds for the UMO Program. The equipment includes various containment units, totes, and other ancillary equipment which have been used to establish seven collection sites around the island. The total estimated value of the equipment is $28,000. Acceptance of the equipment would save the Solid Waste Division the cost of purchasing brand new equipment in order to continue providing this valuable recycling community service. In doing so, this will keep this reusable resource out of the landfill and provide a safe, convenient and environmentally-friendly means for DlYers to dispose of this potentially toxic material. Up until 2015, the Used Oil Do- st-Yourself Program operated by the counties was funded by grants provided by the state environmental response revolving fund (ERRF) under Hawaii Revised Statutes §128D-2, and administered through the Solid and Hazardous Waste Branch. With the recent legislative changes in the use of the ERRF, the Do-It-Yourself Program had been eliminated. The counties are requesting clarification on the disposition of the equipment purchased with Department of Health grant funds. Equipment may include drums, portable secondary containment,250-gallon totes, and other ancillary equipment. Can these items be transferred to the counties to use for their own used motor oil programs, or does the state want to retain ownership of these equipment? According to Hawaii Administrative Rules Section 3-130-10(a)(2)(E)(i), the state may donate surplus property to a city or county agency within the state.
