HIPSIS Task Force: Final Report November 1, 2016 Page 1 of 3 I. EXECUTIVE SUMMARY The Hawai`i Island Packaging Sustainability Initiative Stakeholders Task Force, which hereinafter shall be referred to as HIPSIS Task Force, recommends prioritizing what can be done within the timeframe established for the HIPSIS Task Force. Thus, stakeholders agreed that more time is necessary to focus on prioritizing 1-2 tasks for each matter indicated in Appendix B: Kuleana Matrix. At its Third Session meeting, there was a consensus of five resolutions to be introduced as recommended by the HIPSIS Task Force. II. DISCUSSION The purpose of the HIPSIS Task Force was established via Resolution 565-16, Draft 3, adopted unanimously by the Hawai`i County Council on August 17, 2016, during a Council meeting held in the Kona Council Chambers at the West Hawai`i Civic Center(WHCC). The HIPSIS Task Force held their third session on October 6, 2016, from 10:00 a.m. until 2:30 p.m. in the Hilo Council Chambers located on 25 Aupuni Street, Hilo; via videoconference in the Kona Conference Room at the WHCC located on 74-5044 Ane Keohokalole Highway, Kailua-Kona; and via phone conference. The third session agenda is as follows: 10:00-10:30 AM Welcome and Introductions 10:30—10:50 AM Review and approve minutes from 2nd session,kuleana matrix 10:50—11:00 AM Break(10 minutes) 11:00—12:00 PM Member's presentations:focusing on the solutions to this HIPSIS 1) HWF&Sustainable Island Products:Powerpoint focusing on education,source reduction&solution 2) Margaret Wille sponsored bill requiring use of reusable or compostable food packaging and food service ware by the County of Hawaii and its county food vendors and county facility users, other than in the case of specified exceptions(restricting use of non-recyclable or non-compostable food packaging and food service ware),by July 1 2018,inclusive of educational components. 12:00—2:30 PM (lunch will be provided)Open discussion about member's presentations A. Review suggestions listed in the Midrange report(2nd meeting report-that will be reported and discuss which one members would support and work on after the Task Force concluded. B. Discuss how funding can be obtained to manufacture compostable products here in Hawaii,and other funding needs to pursue task force suggestions. C. Prolong the Task Force?Discuss language for resolution .44 Prior to lunch recess, HIPSIS Task Force held a round table discussion revisiting the purpose and intent of the HIPSIS Task Force, sharing with one another where each entity is currently at and where they would like to see action implemented. Moving on, Co-Chair Wille shared a bill prohibiting the use of polystyrene containers and food service ware at County facilities, which will appear before the Council, requesting recommendation by the HIPSIS Task Force. After a brief discussion, it was decided, with respect to Sunshine Law,to allow the process provided when said matter appears before the Committee on Environmental Management and referred to the Council with either a positive or negative recommendation at First Reading. HIPSIS Task Force members further discussed the extension of said Task Force. Chair Paleka called for a vote by a raise of hands as staff recorded votes on a flipchart easel in front of Task Force members present in the Hilo Council Chambers. Please refer to VOTE#1 in the Third Session Minutes provided in the Appendices of this report. HIPSIS Task Force: Final Report November 1, 2016 Page 3 of 3 Chair Paleka continued to follow the agenda and redirected the discussion to focus on the four major focus points decided by the members at its Second Session meeting: 1) Source Reduction, 2) Education, 3) Litter Management, and 4) Study by DRD/DEM. Before getting into the heavy discussion, members decided to break for lunch and hash out solutions and priorities upon reconvening at 11:55 a.m. After lunch, stakeholders heard a presentation by Megan Lamson of Hawaii Wildlife Fund, Elizabeth Elkjer of Sustainable Island Products, and Victoria Haili of Recycle Hawaii shared a PowerPoint presentation on Source Reduction, Education and Litter Control. The PowerPoint presentation is provided in the Appendices of this report, as well as a brochure created to provide awareness of recycling and waste management. Following the presentation, members discussed title language for resolutions to address the 4 focus points. Members voted on four resolution titles. Please see page 12 of the Third Session Minutes under `Final Verdict'. CM -MW: We are all here trying to work together and contribute at the same time as opposed to saying that we are here to find what we can all agree to and get down to the lowest common denominator and a continuum on it and work on how we can work on HIPSIS TASK FORCE THIRD SESSION MINUTES Page 2 of 12 CM -MW: compromise and work together and something we can all agree to and cut out half the (cont`d) people. With that discussion and looking at different tracks and skills and support it moving forward and what we all can do to promote better environment and minimize cost and convenience. It might be (beneficial) looking at, for a couple minutes, as to what is our mission? It's largely, marine health and don't want litter, but how do we make this environment in term aid packaging in the most ecofriendly alternatives without unduly costly and for me we all care environment cost and convenience but should not trump harm to environment. Very much working tog there and first focused on Styrofoam issues and this should be a first step and no longer doing but coming out with something that we could ban Styrofoam with the exception of liquid over 165 degrees which seems to be ..maybe improvements whether an increase of expense after listening last meeting, I dropped that and moved towards drafting that the county vendors and county facility uses to act as an example rather an immediate imposition to the common public and give them timing in terms when things have to get in but given the timing I did submit and now is a public record basically restrict county vendors and users of the facilities and the July 1, 2018, be an example. Working on project with Kohala Elementary teacher and Richard Ha with litter and resource production is in. CRF came to testify and why they think is important also giving money to the fisheries. Project approach that will go towards to marine health. CHAIR -DP: I understand CM -MW but with bill itself, we can hammer in front of council. Possibility with task force recommending it. RH-PB: I agree with Co -Chair Wille's proposal to revise her proposed Bill so that the County of Hawaii should take the lead in adopting a ban of single -use EPS non-compostable dinner ware at County facilities and functions, in essence, leading by example in emphasizing the importance of reducing the use of products derived from fossil fuels. The Kona Kohala Chamber of Commerce is unique among all statewide Chambers of Commerce in that for over ten years it has been running a Sustainability Committee for West Hawaii businesses (originally called the Kuleana Green Business Committee) putting emphasis on `aina in sustAINAbility. Initiatives include adopting the Hawaii State Aloha Plus Challenge (six targets to be reached by 2030 in sustainability, renewable energy and preservation of natural resources), Earth & Ocean Festivals, environmentally conscious investing, etc. There are a number of environmental groups working locally to adopt these types of initiatives which are no less important than extending the survival rate on the planet. The International Geological Congress is proposing a new geologic epoch -- the Anthropocene epoch to have started circa 1950 with, among other human -caused factors affecting the global environment, the proliferation of petro -chem -- see httns://www.thesivardian.com/environment/2016/auv/29/declare-anthroDocene-enoch- experts-urge-_geological-congress-human-impact-earth. One concept that has made significant inroads with businesses and governments in Canada, Europe and mainland states is EPR - Extended Producer Responsibility - which includes focus on the entire life cycle of any product, including packaging and the reduction/recycling/reuse thereof. HIPSIS TASK FORCE THIRD SESSION MINUTES Page 3 of 12 HFIA-TK: The goal of this task force is to reduce marine debris, but this goal is only possible through efforts that create quantifiable reductions in trash of all types that could enter the ocean. Assuming that a compost facility designed mainly for green waste, with technology that has been used in very different environment than Hilo, can handle rotting food waste could prove to be a very expensive mistake. Bottom line for reducing marine debris is reducing all types of trash in the environment. Banning PS foam for only those least able to have their voices heard, namely local families who use county parks and the seniors who depend on the County meals program, is not fair. There should be a full review of public impacts of the county ban. Post -consumer food waste including compostable food containers should not be added to the planned compost facility until the facility proves to be composting green waste effectively and selling all the end product quickly. The County should consider not adding post -consumer food waste into the compost facility until proven that it is actually working. Decisions on foodservice containers should be based on feasibility and science while keeping in mind that failure is a real possibility. HRA: Thank you to allow myself to join by phone and try to participate as much as possible and I would like to add to the committee by saying to urge to be careful on decisions a little concerned of the lack of the research and information as a task force maybe have not been able to conduct. Assumptions composting facility viability is an example as far as what may exist in the fire work my experiences serving on the TF as well as dialogue in Honolulu county I think it's important and the facts is critical to the decision to make any major commitments and legislation because of certain uncertainties and business models that may work in other countries. Our remote location is a big factored regardless of any county. SIP -JE: There are a number of things we can and cannot. We all have opportunities to do a number of things. Would really like to address some things ... and help us understand a little better and hopefully move on and come a constructive end and let's knock this out and be constructive if that's okay with everyone else here (HIPSIS Task Force members present nodded heads in agreement) HFIA-TK: EPR ... MARINE DEBRIS ISSUES agree these products not designed to degrade Confusion between paper and plastic products and what the end of it will look like for all of these show and tell products and explain plant based vs petroleum based. Of course it's not the goal the fact is they will have a different response. HFIA-LZ: I would echo the statements that this should be our last meeting. It is not viable for business owners to dedicate their entire day to this task force. We have already dedicated three full days. We should focus on issues of consensus. We should attempt to not fight over issues we know that we disagree about. Joy will review the statements that we presented to the council regarding our concerns with taxes, bans and fees. All business representatives that signed the letter agree that we oppose EPR and bans. Many of these individuals are unable to attend and vote today which make this task force unrepresentative of its members. We would like to know that our edits to the minutes were accepted, as that HIPSIS TASK FORCE THIRD SESSION MINUTES Page 4 of 12 is not shown in the document that was made available for us. As such, I am wondering if we can vote about how to approve minutes. CHAIR -DP: We didn't have to approve. CM -MW: Everyone had changes in terms of Joy's response, which will be part of the third report. Those other changes that came in were incorporated in said bill and revised accordingly. HWF: I am not ok with settling with lowest common denominator. Let's shoot for the stars and speak honestly; nothing new just moving more mindful. Oppose comment by HFIA-TK regarding factual information. Marine debris is 35% of what is recycled in the US. Let's focus more on source reduction prevention and education. KYD-DY: Like HFIA-TK and HRA pointed out, its being cautious of what we go through I have experience in production end and know more than most present. I want to shoot for sky but I have had a lot of experiences where it doesn't happen the way you think, especially regarding the info on composting as well as production. I'd like to partake in viability production study and think to that extent of both sides there is always an issue of how much water you have and electricity is part of it as well. Need to look at as a whole to make as a viable study and to partake in this kind of area. RH-VH: Environmental evaluations study and who is paying and make more of a fair way and a lot of ways to help spread fairly. How much we pay to maintain a closed landfill? Essential we are paying to store and look at who is paying and county gets ...revenue and expenditures. External cost not captured in market costs. DEM: Know their legislation if there is a good resource or end place then the law gives waiver and business; does not have to comply argument needs to rethink looking ahead and knows regarding the implementation example plastic bag law, it's about timing as operations for DEM. DRD-JD: I have no comment to save time. SUISAN: In business with service to customers, if there is no demand then will not be in business very long and can educate community in what is good, right or wrong. Not here to judge but if can get community buy in to behave as a whole and business will respond to meet that and can see that being a win-win for everybody. We focus on what we can agree to so that we can come out with a feeling of progress. SFHC: Glad to be here. As environmentalist like to have more of a positive outlook and to keep progression and keep business going. We see with many differ... propose in future to have similar and see ... good idea...protect and be a model. Continue to do this. CHAIR -DP: Make it so they don't have to travel HIPSIS TASK FORCE THIRD SESSION MINUTES Page 5 of 12 RH-PB: Stipulation of continuation VOTE #1: Regarding a Resolution Requesting a One -Year Extension for the Hawaii Island Packaging Sustainability Initiative Stakeholders Task Force. (By raise of hands of Task Force members present, the vote went as followed: 7 ayes, 4 noes, 3 absent, Chair -DP and CM -MW abstained; by a majority vote, the HIPSIS TF shall be extended one-year with those respective entities who agreed to continue) DOH: Let's focus on different things; electronic recycling industry, government, nonprofits, environmentalist ... don't know how productive of which container is better. The least common will not get us far. If we continued it would be good if we have a study, just different opinions on the table we come ...viability study and externality studies while considering the convenience of recycling. CM -MW: Reflects 2nd report and make a list of all suggestions wouldn't mind going through them let's run through systematically. Appreciate weigh in. Disagree with assuming. Already doing mulch program. In terms of cost, Racing to Zero is costly to remove Styrofoam. Agree with Suisan is the marketing buy in and going to IUCN forums is that it's too late for that luxury. I would like input on things working on and try to lead on things... education focus on July 1, 2017, our next budget year so doing the things we are all talking about without eliminating the whole intent how we can make this doable. I would embrace some of the things that may say that Wille can help or weigh in on. Whether agree or not it's moving the conversation forward make it most successful by minimizing food scraps and make successful and be happy to talk about this App. Most meaningful conversation in moving forward. Ahupua`a. No more arguing. CHAIR -DP: Lets focus on: 1) Source Reduction; 2) Education; 3) Study by DRD/EM: Feasibility of manufacturing compostable products; external costs; and 4) Specific values through natural resources DRD-JD: I do believe study is critical there should be consideration that DEM is better to do it and look at contracting experts on this field instead of own staff. SIP -JE: Study can but private sector can do as well, especially with regard to extenuating cost. KYD-DY: If it's KYD's money, we as business owners take the loss. If government does it, it's my money too (via paid taxes). Caution in proceeding is needed. Future generations may end up paying ---Honolulu's rail is an example of that. DEM: Bringing your own containers encourages reusable a rather than disposables. Create a standard message CM -MW: Design curriculum at school onsite learning. Sent an email of what each knows what's going on or able to do. HIPSIS TASK FORCE THIRD SESSION MINUTES Page 6 of 12 HWF: Brochure of local vendors of alternatives available. CM -MW: Need to focus on environmental well-being generally and don't know killing birds and how to become more environmentally conscious. Encourage carrots then sticks. Zero waste education rather an ordinance than a resolution. Prioritize compost program. New compostable products being traced. Take home box. Litter management programs: Malama 808 and Litterati. Adopt a Highway/shoreline. Straw wars problem areas and need more trash containers and Kohala students are working on identifying marine waste and making it convenient and fun. Expansion of partnership programs (Matson). Private grants. At 11:30 a.m. Task Force members took a lunch recess and reconvened at 11:55 a.m. DRD-JD: Concerned of further through business education or nurturing environment In recent months this office has been approached because state is both initiatives in area of sustainability and environment. 6 target goals of the Aloha plus challenge have adopted initiative. No one else has unified with initiative except for HI to achieve by 2045. Tesla has been in touch to have HI Island pioneer another group is united power developed in Europe is now coming to HI Island. Great value in establishing high standards in the view of sustainability. We need to partner with these folks. (PowerPoint Presentation by HWF, SIP -EE, and RH slides available in Appendices) HWF/SIP-EE: Supporting and endorsing those already there with education mahalo CM -MW for Bill which aligns with initiatives based on information shared on Zero Waste Hawaii website, i.e. COH IRSWMP. Would like to hear more about EPR green dot program adding tax or fee on every to -go product container. RH-VH: External cost: Recycle Hawaii briefly tax rate and determine size then what should be taxed. Tax incentives. Give straws upon request. Grants writing more effectively of cost analysis. HWF/SIP-EE: Is there any zero waste curriculum and created a share folder and see what goes on and recent brochures and not reinventing the wheel and already created curriculum and focusing on education as one of main priorities we do want to see COH to increase funding to zero waste curriculum in school and focusing on those as education outreach tools; and one of the big take home is a brochure we have been working on. Drafted brochure that shows alternatives to single use plastic. Basically hold the foam so it would stand out and eye catching. 2nd page to show what products are available and made out of. Educational brochure. Open to suggestions. Add logo here. Identify all vendors and use as a resource. HIPSIS TASK FORCE THIRD SESSION MINUTES Page 7 of 12 HWF/SIP-EE: Annual clean up events at bare minimum. Potential use of date to support legislation and (cont `d) need data to identify the need. Litterati app that has a filter mechanism and search in any area. 4th tier government support and county implementation. CM -MW: Suggested in using the HIPSIS shared drive folder. Bring up IUCN experience on conservation and environment. Address head of groups that are multinational. Panamas are pushing as well as cook island. Will submit copies to HIPSIS Google folder. A lot of voluntary certification. Ty for presentation. RH-PB: Mahalo, Vicki, for bringing up the Litterati "App" which can be used by Keep Hawaii Beautiful members in conducting its annual Community Appearance Indices, where one driver and one or two other members do litter assessment surveys along sections of community highways or streets. This would be a great tool for folks going out there to perform the litter surveys on the Island. Recycle Hawaii is researching a possible pilot study using a machine that reduces the bulk of foam packaging used inside boxes that TVs and computers come in by breaking down to various grades of less dense EPS material. The Hilo Recycling/Reuse Center would be a good venue for us to purchase the machine and use clean Styrofoam packaging materials in a pilot project by grading and mixing it with old latex paint and/or other polymers to produce decorative bricks, ceiling tiles, etc., as a possible local recycling/reuse enterprise. Unfortunately the project would be unable to use food contaminated foam. If any "processing" permits that may be required by the Hawaii Department of Health (DOH) could be obtained for such a pilot project at the Hilo transfer station, then Recycle Hawaii would consider applying for a grant to go forward with the idea possibly with support from County R&D. HFIA-TK: In terms of education that assumption of plastics are bad. A political assumption. To decide that one thing is bad is not education rather a sharing of opinions. HFIA-LZ: I would not agree with or unsure if others would support it. CM -MW: Increase county budget for recycling which would mean to urge at the next county budget. Recycle Hawaii has been for over ten years teaching and promoting home composting to literally thousands of families. The worms and other organisms that break down organics will break down compostable, food contaminated packaging in home composting units, but not EPS plate lunch clamshell packaging. We should be taking steps to ensure the maximum amount of organics are diverted from the island's landfills and eventually diverted to the County's planned 2018 commercial scale composting operation. A reduction in single -use foam containers by replacing them with compostable alternatives will work towards achieving the goal of removing organics from the landfills. CM -MW: DRD to encourage on HI ISLAND. Sustainable business practices which is in the Aloha plus challenge. (An idea of COH to adopt initiative but give...) in to what can be done now. Could be made from a variety of resources including: cardboard, paper, straw, bagasse, eucalyptus, banana leaf, palm leaf. More review is needed. Prevent litter from blowing into the ocean (see last item) by education and easy access infrastructure Encourage purchase of recyclable and compostable products and packaging (which assumes a recycle/composting infrastructure exists) Provide information on what "environmentally friendly" means (a term prohibited by the FTC) and ensure that life cycle impacts, including the true cost of recycling off island; for oceans this could mean readily biodegradable (NOT the same as compostable) Provide education and networking support for local use of recycled/recovered material and "greener" materials in manufacturing new products Reducing marine debris is a goal that all Task Force participants can agree upon, particularly when the origins of marine debris appear to be land-based as indicated from the mentioned studies. This means that irresponsible disposal of trash can be targeted for public education, bolstered by programs like Malama 808, in which local food establishments, businesses and others pledge and engage in active litter management and disposal. A framework for the cost of such a program can be based on the Oahu Malama 808 program, which is private sector driven, and includes window clings, trash can stickers. Hawaii County would need to provide baseline information about leakage from existing waste sites and proposed solutions. Hawaii Wildlife Foundation, Matson and other Hawaii Nets -to -Energy program partners already remove derelict and abandoned fishing nets and transport at no cost processed debris to Honolulu's HPower to produce electricity. Until Hawaii Island's BioEnergy Hawaii, Hu Honua and compositing facility are on- line and the feedstock needs are identified, exploration of expanding this program is proposed. Possible partners for an expanded program or development of new recyclable programs can include Oahu's Pacific Allied Products, which is the State's only foam recycling facility, partnering with CS Wo and Servco Home and Appliance. Packaging foam is recycled into material that can be used to make cafeteria trays, video and audio tape bodies and cases, rulers, desktop accessories, picture frames, etc. Wal-Mart could be a possible partner as it piloted a closed loop recycling plan at its Las Vegas distribution center, and quickly expanded it to Texas; recycled material is used to make picture frames sold at Wal-Mart. It's suggested that Hawaii Wildlife Foundation or existing Hawaii Nets -to -Energy partner take the lead to explore the suggested expansion or creation of a new program. This exploration, if parties are willing, can then establish cost and implementation framework. This section appears to cover two separate areas: (A) Production and distribution of environmental [sic] friendly products and packaging, and (B) prevention of packaging waste entering our ocean. KULEANA MATRIX A I Page I of 12 HAWAII ISLAND PACKAGING SUSTAINABILITY INITIATIVE STAKEHOLDERS TASK FORCE KULEANA MATRIX A A) There are few packaging manufacturers in Hawaii. Most packaging is sourced by local distributors, and It was just announced that Papersource Hawaii, the largest wholesale distributor of paper products in the state, is shutting down after 18 years in business. The manufacture of packaging may not be an economically feasible industry in Hawaii. Extended Producer Responsibility Section 3.5.9 of the 2009 County of Hawaii Integrated Resources and Solid Waste Management Plan Update introduces Extended Producer Responsibility policies in place around the world. The report notes: "Given its relatively small size and geographic isolation, it would be difficult for Hawaii County to effectively implement and EPR program on its own. However, the County could prepare and adopt resolutions stating its support for EPR, and could work to lobby state and federal lawmakers to advance EPR initiatives. It could collect and review various city/county resolutions related to EPR and state its strong support for EPR to its citizens and state and federal officials." What: Establish Extended Producer Responsibility Policy at the State Level. Why: Shift burden of waste management costs to producers. How: See section 3.5.9 of the Integrated Resources and Solid Waste Management Plan. Who: Legislators. Cost: $30, 000 to $70, 000 per 2009 plan. The same section describes the Green Dot program that began in Germany in the 1990s. An explanation of the program is included in its online guidance: Definition: The "Green Dot" trademark on packaging means that for such packaging, a financial contribution has been paid to a national packaging recovery company that has been set up in accordance with the principles defined in European Directive No. 94/62 and the corresponding national law. " The cost of a North America license for calendar year 2016 is $1,350. This program is similar to purchasing carbon offsets, which is a widely used measure of sustainability. At the local level, this program is unlikely to reduce waste. B) To prevent packaging waste from entering our ocean, it would be helpful to identify the kinds the of waste that enters our ocean, and their points of entry. Is the waste land-based (including wastewater treatment overflow) or sea -based (from vessels or from other islands), and what is the source of the waste (e.g., food containers, fishing equipment, metal beverage cans, etc.)? With a baseline measure, a more targeted approach could be made. A marine debris study or a litter study or a combination of both using protocols established by Keep America Beautiful and the Ocean Conservancy could help to set that baseline. What: Marine debris litter study. Why: Document what kinds of debris are entering the ocean and their paths of entry. How: Follow established survey protocols. We need to understand that living on an island with a huge changing tourist population means that all stakeholders — on and off -island importers, exporters, resort communities, residents, businesses (including retailers, manufacturers, transporters and service providers), environmentalists, government, academia - need to continually work together to minimize adverse impacts and to make progress toward sustainability. Think "steps, not "solutions" — sustainability is process and a way of doing things, not an end state. The 2009 Integrated Resources and Solid Waste Management Plan Update contains a comprehensive collection of strategies, including implementation cost estimates, that may be revisited depending on the specific area of concern. KULEANA MATRIX A I Page 3 of 12 HAWAII ISLAND PACKAGING SUSTAINABILITY INITIATIVE STAKEHOLDERS TASK FORCE KULEANA MATRIX A ❖ IDENTIFIED safety performance measures of retailers' and producers' product and packaging: When products are determined to be detrimental to the `aina and marine environment, alternative forms of packaging must be promoted whatever the costs. Boycotting products that are proven to be detrimental to the environment is an effective tool in forcing needed changes. Compostables are as safe as plastics o Thermally safe o Leak safe Reusables cleanliness a concern. Are there Dept. of Health requirements? Not sure what is meant by "safety." Products should not cause injury to users and should be able to be disposed or recycled in a manner to prevent significant adverse environmental and health injury. Several federal and state laws address product safety concerns: OSHA workplace standards; FDA for food, rug and medical devices; CPSC for consumer products; TSCA for chemical E&H risks; Clean Air Act, Safe Drinking Water, RCRA, various Transportation laws and regulations for land and marine safety, etc. Packaging should protect the integrity of a product during transportation, storage and distribution to end users and should be able to be disposed of or recycled in a manner to prevent significant adverse environmental and health injury. Most of the laws above apply to packaging as well as product. The last thing we should do is to limit packaging options so that more product waste is generated from breakage and spoilage. Compliance records for the above are collected by state and federal agencies. There are also some voluntary standards that include metrics for compliance and beyond compliance efforts by companies such as ISO 14000, GRI, NSF/ANSI 355, Responsible Care®, as well as various "Green" label programs, etc. It would seem duplicative for the county to collect this information and certainly prohibitive to require their use by product suppliers. Too many products already do not ship to Hawaii because of transportation costs. Let's not load on more reporting costs. It may be possible to ask retailers who sell to Hawaii County to report general information on the recyclability/recycled content of packaging they use, but it may be difficult to separate National data for County sales and smaller retailers may have limited knowledge or access. It may be possible to try a pilot survey, but we should be sensitive that filling out unique forms is resource -intensive for businesses. The information in this guide could be used in several ways: 1) Educate foodservice operators on the best practices through published guides. 2) Offer a trash receptacle buying program to allow foodservice operators to purchase receptacles at a discount. 3) Require dispensers for straws and napkins. 4) Since food safety is related to trash management practices, the County could collaborate with the State Department of Health to educate foodservice operators about litter management best practices. 5) Make trash receptacle location and quantity a part of the planning approval process for new foodservice operations. A complete description of the recycling process, including a description of the source of the recyclable plastic and a description of any source controls in place intended to ensure that only plastic that initially complied with the applicable regulations is recycled. Also, a description of any steps that are taken to ensure that the recyclable plastic is not contaminated at some point, either before collection for recycling, or during the recycling process. 2. The results of any tests performed to show that the recycling process removes possible contaminants. For use of the recycled material as a substitute for plastic made from virgin materials, it would be necessary to either show that there has been no possibility of contamination with substances other than food orto demonstrate, through surrogate contaminant testing and, if appropriate, additional migration testing, that your recycling process successfully removes possible contaminants. However, surrogate contaminant testing is no longer considered necessary to demonstrate that post -consumer recycled (PCR) polyethylene terephthalate (PET) or polyethylene naphthalate (PEN) produced by a tertiary recycling process is suitable for food -contact use. Because FDA has determined that tertiary recycling processes produce PCR -PET or PEN of suitable purity for food - contact use, the Agency no longer sees a need to evaluate tertiary recycling processes for PET or PEN or to issue individual opinion letters for them. 3. A description of the proposed conditions of use of the plastic (e.g., information on intended temperature of use, type of food with which the plastic will come into contact, the duration of the contact, and whether the food -contact plastic will be for repeated or single -use applications.) Prescription Drug Packaging Per FDA regulations, pharmaceutical packaging must: • Provide protection against exposure to light, moisture, oxygen and variations in temperature as each of these can adversely alter the medication's quality. Containers must be well closed and remain airtight if repeatedly reopened/closed. • Provide protection against physical damage through handling, shipping, and storage processes. • Provide protection against biological contamination. The container and its materials cannot have any adverse interaction physically or chemically with the medication or allow for leaks, diffusion, and permeation. Packaging can in no way contribute to the altering of the medication's properties, function, or effectiveness. This means materials used to package pharmaceutical products must be subject to stringent quality assurance requirements. • Package labeling must clearly identify the product, patient's name, the name and address of the dispenser, the prescribing doctor's information and recommended dosage, the medication's dosage/strength, quantity, cautionary warnings or storage instructions, and expiration date. Consideration of source materials and the energy, water inputs needed to manufacture the packaging product, carbon footprint of transporting it to Hawaii and end -of -life options such as reuse, recycle and energy recovery are important criteria. Energy recovery is increasingly used as a method to recover value from packaging materials. Safe incineration with energy recovery, waste to energy facilities, and the use of plastic and paper as an alternative fuel are all energy recovery methods. These technologies represent conversion of material to energy. While energy recovery does not represent a sustainable use of non-renewable packaging materials (e.g., fossil fuel based plastics), it is a preferable alternative to landfills, litter, or uncontrolled burning. (August 2011, "Definition of Sustainable Packaging" Sustainable Packaging Coalition) In past years, waste -to -energy has been viewed negatively by persons concerned about the environmental effects of incinerations. As technology has improved, however, modern incinerators have become a safe and effective method of handling many post -consumer materials. According to Franklin Associates, Ltd., a leading solid waste consulting firm, "At some point after 2000, the use of finite resources, e.g. fossil fuels, may lead to a more welcoming climate for expansion of waste -to -energy as an alternative solid waste management technique." (Franklin Associates, Ltd., Solid Waste Management at the Crossroads, December 1997, p. 1-24.) To be clear, KYD believes that expanded polystyrene (EPS) used in food -grade containers and STYROFOAMT"', a DOW trademark material which is used for protective packaging for fragile items during shipment, as custom insulation in building applications or other items like bicycle helmets, are environmentally friendly. STYROFOAM TM is not to be confused with food -grade EPS, which has been approved for more than 50 years by the U.S. Food and Drug for foodservice products. Polystyrene foodservice products offer a sanitary way to serve fresh food and to help prevent the spread of disease at school, restaurants, hospitals ... even at home.(http://www.plasticfoodservicefacts.com/main/Safety/Safety-of-PS- Foodservice-Products ) Foam food service products represent less than 1% of the US municipal solid waste stream (2012 EPA) Both STYROFOAMTm and food -grade EPS for disposable food containers meet five of eight criteria for sustainable packaging: 1) Safe & Healthy Throughout Its Life Cycle, 2) Meets Performance & Cost Market Criteria; 3) Maximizes Renewable or Recycled Source Materials; 4) Uses Clean Production Technologies & Best Practices; and 5) Physically Designed to Optimize Energy & Materials. Further, if all EPS packaging were replaced with corrugated cardboard, paper, wood, molded fiber, etc, compared with current figures raw material requirements would rise to 560%, power consumption to 215% and the landfill volume to 150%. (http://www.epspackaging.org/images/stories/EPS Sustainability small.pdf ) Ocean Debris Litter is a pervasive problem in Hawaii as well as across the nation. Refuse may be blown out of overflowing trash bins, inexcusably tossed by consumers onto streets and into yards, or illegally dumped into waterways. The role of foodservice packaging in the litter stream is often perceived to be greater than reality. For example, a 2009 study conducted for Keep America Beautiful found that the fast food packaging contributed to less than 6% to total litter. (www.fpi.org, Foodservice Packaging and Litter Prevention) NOAA (National Ocean and Atmospheric Administration) states that the 5 most common items found during the International Coastal Cleanup are plastic cigarette butts, food wrappers, plastic beverage bottles, plastic bottle caps, and plastic straws and drink stirrers. Plastics can enter into the ocean through ineffective or improper waste management, intentional or accidental dumping and littering on shorelines or at sea, or through storm water runoff. (Trash Talk: Marine Debris and Plastics, NOAA, Sept. 17, 2015) Of the few studies conducted to look at the composition of plastic in the marine environment, foam has never been found to be a primary contributor. In a 2011 South Pacific expedition, foam was 0% of the recovered plastic debris. Analysis of data collected from 1991 - 2007 in the Atlantic found that foam was 0 —15% of total plastic found. In the North Pacific, spectroscopic analysis of an assortment of plastic particles showed that only 8% were polystyrene. Efforts to protect our oceans should strongly consider carbon content and greenhouse gas emissions that would result from bans and resultant product substitutions. Life cycle studies indicate that a ban on polystyrene foam food service materials could result in significant increases of greenhouse gas emissions, use of non-renewable energy and waste generation. (Comments on Amendments to Statewide Water Quality Control Plans to Control Trash, Dr. Angelique White, August 1, 2014.) The cost of plastic marine debris arising from the consumer goods sector is over $4.7 billion per annum, and despite the greater biodegradability of many alternative materials (Ocean Conservancy, 2010), the ocean cost of alternatives is estimated to be 150% greater than this due to the sheer quantity of alternative materials needed to replace plastic. The greatest opportunities to reduce the ocean cost of plastic may lie in investments in waste collection systems in Asia. (Trucost Report, Plastics and Sustainability: A Valuation of Environmental Benefits, Costs and Opportunities for Continuous Improvement, July 2016) The Ocean Conservancy Report (September 30, 2015) finds that: 5 Countries contribute 55-60% of plastic -waste leakage entering the ocean: China, Indonesia, Philippines, Thailand and Vietnam. More than 80% of ocean plastic comes from land-based sources. Once plastic is discarded, it is not well managed and leaks into the ocean. 25% of land-based leakage is from within the waste management system due to improper dumping, poorly located dumping sites, and poor control of dumping sites. http://www.oceanconservancy.org/our-work/marine-debris/mckinsey-report-files/full-report- stemming-the.pdf Marine debris of all types accumulates in and around the islands of Hawai'i due to oceanic currents and winds in the North Pacific. Much of the debris is made up of fishing nets, a type of gear not used by Hawaii's fisheries that have been lost, abandoned, or discarded. Fishermen, communities, and trained divers remove these derelict nets from the environment. Instead of adding the nets to already congested landfills, in 2002, Hawaii's multi -partner marine debris group devised a unique program to use this marine debris to create usable electricity. The nets are transported to a Schnitzer Steel Corporation, which is a mainland -based scrap metal recycler, facility in Hawai'i. There, the nets are chopped into small pieces suitable for combustion at the City and County of Honolulu's H -Power energy from waste facility run by Covanta Energy. Schnitzer Steel Hawai'i Corporation transports the chopped net pieces to the H -Power facility. The nets are then burned, producing steam which drives a turbine that creates usable electricity. All services (transport included) are donated free of charge. The Hawai'i Nets -To -Energy program is possible only through the partnership and support of Hawaii's multi -organizational marine debris group. Since 2002, over 800 tons of derelict nets have been used to create electricity—enough to power nearly 350 Hawai'i homes for a year. (https://marinedebris.noaa.gov/solutions/hawaii-nets-energy-program ) Solution Concept #1: Reducing Marine Debris Reducing marine debris is a goal that all Task Force participants can agree upon, particularly when the origins of marine debris appear to be land-based as indicated from the mentioned studies. This means that irresponsible disposal of trash can be targeted for public education, bolstered by programs like Malama 808, in which local food establishments, businesses and others pledge and engage in active litter management and disposal. A framework for the cost of such a program can be based on the Oahu Malama 808 program, which is private sector driven, and includes window clings, trash can stickers. Hawaii County would need to provide baseline information about leakage from existing waste sites and proposed solutions. Solution Concept #2: Reducing Marine Debris Hawaii Wildlife Foundation, Matson and other Hawaii Nets -to -Energy program partners already remove derelict and abandoned fishing nets and transport at no cost processed debris to Honolulu's HPower to produce electricity. Until Hawaii Island's BioEnergy Hawaii, Hu Honua and compositing facility are on- line and the feedstock needs are identified, exploration of expanding this program is proposed. Possible partners for an expanded program or development of new recyclable programs can include Oahu's Pacific Allied Products, which is the State's only foam recycling facility, partnering with CS Wo and Servco Home and Appliance. Packaging foam is recycled into material that can be used to make cafeteria trays, video and audio tape bodies and cases, rulers, desktop accessories, picture frames, etc. Wal-Mart could be a possible partner as it piloted a closed loop recycling plan at its Las Vegas distribution center, and quickly expanded it to Texas; recycled material is used to make picture frames sold at Wal-Mart. It's suggested that Hawaii Wildlife Foundation or existing Hawaii Nets -to -Energy partner take the lead to explore the suggested expansion or creation of a new program. This exploration, if parties are willing, can then establish cost and implementation framework. to the tsox 41: Identify Solutions Addressing T e roduction And istri ution f nvironmental Friendly roducts And ac aging To Im rove And Reduce roduct And ac aging Waste From ntering ur cean We will start our analysis by considering some facts and principles that should guide our decision-making: Food is an essential commodity. Almost half of Hawaii's residents live paycheck to paycheck.' Increasing the price of all food that comes in a package will impact the amount of food people can afford to buy and eat. This will materially impact heath and physical well being of many of our residents. There is no more regressive tax, than a tax on food. It's not something that should be seriously considered. Requiring residents who live paycheck to paycheck to foot the cost of projects, which are universally uneconomic, is bad public policy. Developing a recycling center just for the recyclable items produced on the island of Hawaii would be tremendously expensive. Mainland recyclers, even those operating with very large volume, struggle financially and operate with large losses year over year.2 "...Recycling has become a money -sucking enterprise. The District, Baltimore and many counties in between are contributing millions annually to prop up one of the nation's busiest facilities in Elkridge, Md. but it is still losing money. Almost every facility similar to it in the country is running in the red. Waste Management and other recyclers say that more than 2,000 municipalities are paying to dispose of their recyclables instead of the other way around."3 To pass this tremendous cost onto the price of food is inhumane and irresponsible. The definition of "environmentally friendly product" is a subject of tremendous debate. What is the standard used here? Do the products break down in the marine environment? The ocean is salty and filled with life that is affected when plastics enter the water. The compost process does not occur there. Additionally, there is more and more research all the time showing the harmful effects of plastics in the ocean, including the impacts on birds that often mistake plastics for fish and eat them. Please help keep our oceans and waterways free of litter and plastic and dispose of any waste responsibly." Are the products recyclable? Here is the answer provided by the manufacturers of compostable products on their websites: "Are your products recyclable? In short, probably not. Here's why: We have 2 lines of products; our GreenStripe® items that are made with renewable resources and our B1ueStripeTM items that are made with recycled content materials. Not all of these materials can be recycled most places in the US." So according to the manufacturer of compostable foodservice containers their products do not compost in the ocean and they are not recyclable. In the County of Hawaii, there is currently no facility for them to be composted. So they are not compostable in the County of Hawaii. Many counties including Oahu have had working composting sites for upwards of a decade, yet have not successfully transitioned to accepting post consumer compostable products because it is not financially possible. Until there is an existing composting facility that takes these products in the County of Hawaii the truthful answer to the question, "Are these products being composted?" is "No". Considering these facts, we fail to see how there can be any reasonable argument that the more expensive compostable products currently sold in Hawaii are more environmentally friendly. One drawback is that the cultivation of corn requires more nitrogen fertilizer, more herbicides and more insecticides than almost any other U.S. crop, and that practice contributes to soil erosion and water pollution when nitrogen runs off fields into streams and rivers.' One must acknowledge the environmental trade-offs associated with the use of any packaging material and whether a mandate to use one particular type of container or product will have the desired result of reducing litter and/or marine debris. All foodservice products — regardless of the material from which they are made — require the use of various natural resources, i.e. energy, water, etc. A 2006 Life Cycle Inventory study by Franklin Associates showed that polystyrene, when compared to other food service containers, is very efficient in terms of minimizing air emissions and energy used in the manufacturing process and in reducing the s http://www.ecoproducts.com/faqs-composting_and recycling.html 6 http://psep.cce.comell.edu/facts-slides-self/facts/mod-ag-grw85.aspx amount of waterborne waste generated during the manufacturing process! A Harvard study reported that styrene is naturally present in food such as strawberries, beef, and spices, and is naturally produced in the processing of foods such as wine and cheese. The study noted that "federal regulations also permit low concentrations of styrene in food" as an additive. The scientists reviewed all of the published data on the quantity of styrene contributed to the diet due to migration from food contact packaging. The scientists concluded that there is no cause for concern from exposure to styrene from food or from polystyrene used in food contact applications, such as packaging and foodservice containers.' The FDA, Health Canada and Environment Canada concluded extensive studies that polystyrene is "non-toxic" and that styrene "does not constitute a danger to human life and health" and "does not constitute a danger to the environment on which human life depends."' The concept of growing corn on Hawaii Island, and processing that (GMO Corn that the current products are made from?10) into a food package by any reasonable analysis would result in a tremendously cost prohibitive item. The cost of land, water, labor, and building infrastructure in Hawaii are close to the highest in the world. Farmers who sell locally grown food have a hard time making a living in Hawaii. Selling crops as food is a much higher use than growing crops to be used in food packaging materials and commands a higher price by consumers. We need to increase the amount of food grown in Hawaii to feed people. Growing crops to be used for packaging material is the not the best use of agricultural land. Growing food for uses other than food consumption drives up the price of food." Specific Recommendations for part two of the question: To respond to the statement in box one which asks how to best, "reduce product and packaging waste from entering the ocean," we offer the guidelines set forth in the Malama 808 program. By singing onto this program the County of Hawaii will show that it is committed to preventing all types of plastics, including compostable plastics, from entering the ocean where they will do considerable harm. Preventing trash from entering the ocean is the best way to protect our marine environment. It comes in all shapes and sizes — single -use cups, containers, wraps, boxes, bags, lids, cutlery, straws, stirrers and more — and is made from a variety of materials, including paper, plastic and aluminum. Foodservice packaging allows restaurant operators to serve guests in a sanitary, convenient and economical manner. But it's not a benefit to the environment when it ends up as litter. Litter or trash of any kind can have harmful effects on roads and waterways, with consequences for the econo- my and public health. So how much do restaurants contribute to the litter stream? Keep America Beautiful reports that fast-food packaging — the largest component of all foodservice packaging — represents approximately 5 percent of all litter in the United States. However, it also accounts for roughly 19 percent of items in the "visible" litter stream, defined as items that measure more than 4 inches. The most frequently observed items of foodservice litter include food wrappers, containers, beverage cans, napkins and paper products such as straw wrappers, according to a 2009 Keep America Beautiful study con- ducted by Action Research. According to its 2009 "Littering Behavior in America" report, Keep America Beautiful researchers observed the vast majority of people properly disposing of trash in receptacles. But nearly one in five disposals — 17 percent — ended up as litter. Most of this was done intentionally, such as by dropping the litter (54 percent) or flicking/ flinging the item (20 percent). About 85 percent of littering is the result of people's attitudes, according to the research. Changing individual behaviors is the key to preventing litter — and environmental cues can make a difference. People who see litter are more likely to litter, for example. KAB research shows about 15 percent of littering is affected by the presence of existing litter. The location of trash receptacles also makes a difference. Where people were observed littering in public spaces, the nearest trash receptacles averaged about 29 feet away, according to the research. The rate decreased to 12 percent when people were within about 10 feet of a trash receptacle. This echoes research by Walt Disney Co., which studied customers at entertainment parks and shopping areas and found that trash receptacles must be placed at intervals of about 30 steps to ensure proper disposal. Change the environment to reduce littering Use these four tips to ensure customers avoid littering: 1. Make proper disposal convenient and accessible. Provide sufficient trash, ash, and recycling receptacles inside and outside your establishment. 2. Ensure consistent and ongoing clean- up. Littered environments attract more litter, so keep your foodservice estab- lishment clean and litter -free. 3. Use landscaping and maintenance to promote a sense of personal responsi- bility. Making an effort to "beautify" your establishment results in lower rates of littering behavior. 4. Make the most of motivational messag- ing. Encourage customers to properly dispose of litter through direct engage- ment or on -package messaging. You can encourage customers not to litter by where you place receptacles, the type of receptacles you use, the cleanliness and maintenance of your grounds, and direct messages to customers. Start with your employees. How your employees behave and interact with customers can help set the right tone. Employees who are trained in litter -prevention best practices and asked to demonstrate these practices develop a sense of ownership and responsibility. Consider the following ways to get employees involved. • Include litter education as part of employee training. Talk to your employees about the eco- nomic and environmental impacts of litter. Help them understand that the presence of litter affects a brand's reputation and may even result in fines to the business. • Incorporate litter prevention into regular em- ployee tasks. This could include grounds mainte- nance, customer interactions, transferring trash to outside storage areas, and using trash and ciga- rette ash receptacles. • Ask for employees' input. Employees are in the best position to identify day-to-day changes to help maintain a litter -free environment. You'll encourage a sense of ownership by asking them for input. Look at customer service. stop litter before it's even generated. • Look at how you distribute straws and condi- ments. Use single dispensers for straws and consider eliminating paper straw covers when possible. If you provide straws and condiments in takeout bags or on trays, train your employees to ask customers if they want them, and how many, rather than provide them automatically. • Question the need for receipts. Many businesses are eliminating customer receipts or providing them only on request. • Think about napkin delivery. A loose stack of napkins can encourage more napkin use and increase the potential for litter. The majority of our restaurants also post a "Be a Good Neighbor, Don't Litter" message at the exit of their drive -thrust' — Tim Hortons manager Being a Good Neighbor: A Guide to Reducing and Managing Litter 5 dispensers that offer a single napkin at time, and make sure the dispenser is filled correctly. These dispensers can reduce waste by up to 25 percent. When placing napkins in takeout bags or on trays, consider having employees ask the custom- er how many they need, or simply provide one per customer. 3. Look at your trash receptacles. Placing a sufficient number of trash, recycling and ash -tray receptacles in high -traffic areas is one of the best ways to help employees and customers eliminate litter. Identify the proper loca- tion and quantity. Most operators place trash and recycling receptacles inside or just outside entrance/exit doors. Some restaurants also put recep- tacles in outdoor seating areas and parking lots. Identify high -traffic areas and places where litter tends to accumulate. Make sure you have enough receptacles, that they're the right size, and that they're located where they are most convenient for customers. • Determine the best type of receptacle for your establishment. Most foodservice operators report using "open front/side (no flap)" or "front/side (push flap)" receptacles. OUTSIDE the restaurant: • Parking lots are the most common spots for litter, according to foodservice operators. Other trouble spots include around or near outdoor trash/recycling receptacles and on the streets/ sidewalks around the establishment. • Cigarette butts, beverage cups and lids, napkins and food wrappers were the most littered items outside the restaurant. Service receptacles regularly. Most foodservice establishments set a schedule for employees to regularly empty receptacles located inside and outside of the store. If you're accumulating litter around your trash receptacles, take a look at your service schedule. Train your employees to pick up any trash outside the receptacle as they empty it, and to replace the trash liners. Maintain your efforts. Managing litter is an ongoing effort. Consider the following best practices Incorporate litter cleanup into your maintenance schedule. Maintaining and emptying trash recepta- cles helps create an environment that discourages littering. Include litter pickup as part of maintaining your grounds, both inside and outside the estab- lishment. Consider a daily inspection of trash receptacles to ensure they don't overflow. • Ensure transfer to dumpsters is litter -free. Most foodservice establishments use liners in their trash and recycling receptacles and then remove, tie and transfer these liners to the dumpster area for hauling. Some regulations even require bags inside dumpsters to be tied or closed. Ensure the bags are tied tightly. Train employees to pick up any trash that spills out. Make sure storage is adequate to properly contain the trash bags. • Confirm haulers do not create litter during the pickup process. In your contracts with haulers, specify ways to reduce litter during the transfer from dumpster to truck. Monitor pickups to ensure any litter is cleaned up immediately. • Address border areas around property. Research shows that areas that are clean and litter -free are more likely to stay that way. If there is persistent litter around the periphery or entry to your property, try to identify the source of the litter. Then work with a local business improvement district, Keep America Beautiful affiliate, property manager, neighborhood business group or similar organization to reduce the source. The company trains employ- ees to ask customers if they want bags or other commonly littered items, and to give customers only what they need. 5. Use customer messaging. Many foodservice operators put prevention or anti -littering messaging on their takeout packaging. Some ask people directly to make a commitment not to litter. Consider the following opportunities for consumer - facing messaging on litter prevention. Ask employees to engage customers. Train staff to use appropriate opportunities to ask custom- ers to help reduce litter. For exam- ple, when providing takeout orders, employees can make customers aware that litter reduction is the reason for certain practices around dispensing condiments, napkins or straws. Communicate your anti -litter message on takeout packaging. Consider printed messaging on bags, napkins, tray liners and other packaging that asks customers not to litter. For example, White Castle places a "Do Not Litter" message on its paper carryout bags. Use in-store signage. Remind customers to use the proper recep- tacles. Are they in appropriate dispensers to encourage guests to take only what's needed? Are trash and recycling receptacles located at exits and other areas that help customers avoid littering? Do you provide a written schedule for employees to ensure frequent and regular maintenance of: receptacles self -serve counters common seating areas restrooms floors Is there appropriate/sufficient signage or other mes- saging to encourage customers to clear tables and dispose properly of their remaining items? Are ash trays and receptacles conveniently located if smoking is permitted on the premises? 2. Maintenance: ❑ Is the maintenance schedule based on usage or volume? Monitor to determine how frequently you need to collect to prevent overflowing dumpsters. ❑ Is there a written maintenance schedule? Receptacles may overflow during rush hours when team mem- bers are busiest elsewhere. 3. OUTSIDE AREAS: SERVICE/TRASH AREAS Bulk refuse container system: ❑ Does the dumpster/container have enough capacity to hold all refuse generated between collections? ❑ Do lids close tightly? ❑ Are overflows or spills cleaned up quickly? ❑ Are pickups scheduled to meet volume needs? ❑ When private trash haulers are used, does your contract specify use of covered trucks for collection? Deliveries: ❑ Are deliveries required to be stacked neatly in the loading area to prevent litter at the loading dock or back door? ❑ Are delivery -truck personnel encouraged to use trash/recycling receptacles? ❑ Do your employees compact shipping cartons and box- es and put them in recycling containers immediately? 4. Being a Good Neighbor: A Guide to Reducing and Managing Litter 8 Understanding I fitter haws Most jurisdictions have codes in place to help businesses reduce litter. Identifying and understanding your community's code for litter and solid waste and partnering with local officials can help you develop an effective litter -control program. Regulations related to litter and solid waste are usually found in fire, housing, building, health and public safety codes. Check with local officials or jurisdiction websites for information about applicable regulations. • Dumpster/bulk containers. Some municipalities specify an optimal size for dumpsters (6 to 8 cubic yards, for example) and prohibit other sizes. Dumpsters and containers should be big enough to completely contain all solid waste. • Collection schedules. What are the trash and recycling collection schedules? Are there any mandates related to food -waste collection? In your contracts with waste haulers, spell out procedures for weekends and holidays, when trash tends to accumulate more quickly. • Collection trucks and techniques. Some codes require businesses to locate their dumpsters in an enclosed area. Carefully review the requirements for enclosed areas, including main- tenance by the waste hauler and/or foodservice operator. Be aware of any procedures governing the transfer of waste from containers to collection trucks. • Sidewalk maintenance. Most communities require property owners to keep the sidewalks in front of their establishments clean. Most prohibit sweeping refuse into the gutter or drainage facilities. Work with employees to ensure litter doesn't enter waterways through those areas. • Parking lot maintenance. Many communities require foodservice operations to install a certain number of trash receptacles in parking lots, often based on the number of parking spaces. If you provide sufficient receptacles for disposal, you'll reduce both litter and parking -lot clean-up time. Take for example Philadelphia: In 2015, its city council approved a plan requiring corner stores and restaurants to place trash and recycling bins within 10 feet of their entrances in an effort to reduce litter. In addition to keeping your own operation litter -free, consider these opportunities: • Participate in annual neighborhood clean-ups. Partnering with a Keep America Beautiful affiliate during the "Great American Cleanup" held each spring or "America Recycles Day" (on November 15), or participate in a community or school initiative to create litter -prevention awareness. Take part in year-round cleanup programs. Ongoing engagement helps to expand your business's involvement. Consider "Adopt -a -School," "Adopt -a -High- way" or other "Adopt -a -Spot" programs sponsored by Keep America Beautiful affiliates or state and local groups. Engage other businesses to participate in litter -prevention activities. Recruit local businesses to join a litter -prevention or cleanup event. Issues That Impact the Credibility of the Task Force: • Participation in the TF was based on the Co -Chairs' promise to the Council as well as to the business community that the focus would be on all types of packaging, to include discussion about WTE and recycling, and that an EPS ban would not be the focus of discussion. Further, full discussion would occur before any group action is taken. - However, discussions at both Task Force meetings focused on the EPS ban, with little or no discussion about other packaging, WTE and recycling - CM Wille presented a proposed amended EPS ban bill at the HIPSIS TF Meeting #2 after she had already submitted it to the Council. While emphasis was placed on bringing in the experts, there was no fact -based discussion nor were the heads of relevant county and state departments brought into the discussion as requested. Sharing thoughts and comments comprised the discussions. Overall, the process is not geared for fact -based discussion about complex issues. For example, some of the key information requested and missing from the discussion includes: - Specific information on EPR and the Green Dot Program and its applicability to Hawaii - Potential sanitation issues of returning post -consumer use food service containers to restaurants and encouraging reusable food containers at food establishments While well intentioned, having a TF member prepare the minutes does not allow that member to fully participate or pay full attention to the discussion for recording the minutes, nor does it reflect objectivity in the minutes or an impartial relationship with the Co -Chair. What We Can Agree To: • Source reduction (not substitution) promotions. We can agree on an education campaign to get people to bring their own bag, straw or utensils if that is something the DOH says is safe. Almost half of Hawaii s residents live paycheck to paycheck.' Increasing the price of all food that comes in a package will impact the amount of food people can afford to buy and eat. This will materially impact heath and physical well being of many of our residents. There is no more regressive to , than a to on food. It s not something that should be seriously considered. Requiring residents who live paycheck to paycheck to foot the cost of projects, which are universally uneconomic, is bad public policy. Developing a recycling center just for the recyclable items produced on the island of Hawaii would be tremendously a pensive. Mainland recyclers, even those operating with very large volume, struggle financially and operate with large losses year over year .2 " Recycling has become a money -sucking enterprise. The District, altimore and many counties in between are contributing millions annually to prop up one of the nation s busiest facilities in Elkridge, Md. but it is still losing money. Almost every facility similar to it in the country is running in the red. Waste Management and other recyclers say that more than 2,000 municipalities are paying to dispose of their recyclables instead of the other way around. 3 California has seen more than 20 percent of recycling centers statewide shut down in the past year due to the cost of recycling far a ceeding the value of the recovered materia ls4. To pass this tremendous cost onto the price of food is inhumane and irresponsible. The definition of "environmentally friendly product is a subject of tremendous debate. What is the standard used here Do the products break down in the marine environment Here is the answer provided by a manufacturer of compostable products on their websites: "Are your compostable products marine degradable No, our products are not certified as marine degradable and we strongly encourage everyone to keep all plastics out of oceans and waterways. Land-based commercial compost facilities have the ability to maintain ideal composting conditions and sustained heat and moisture needed for Ingeo to break down entirely with the appropriate soil bacteria, yeast, and fungi. The ocean is salty and filled with life that is affected when plastics enter the water. The compost process does not occur there. Additionally, there is more and more research all the time showing the harmful effects of plastics in the ocean, including the impacts on birds that often mistake plastics for fish and eat them. Here is the answer provided by the manufacturers of compostable products on their website6: "Are your products recyclable In short, probably not. Here s why: We have 2 lines of products our GreenStripe items that are made with renewable resources and our IueStripe items that are made with recycled content materials. Not all of these materials can be recycled most places in the US. So according to manufacturers of compostable foodservice containers their products do not compost in the ocean and they are not recyclable. In the County of Hawaii, there is currently no facility for them to be composted or recycled, so they are not compostable or recyclable in the County of Hawaii. Many counties including Oahu have had working composting sites for upwards of a decade, yet have not successfully transitioned to accepting post consumer food waste and compostable foodservice containers because of significant engineering and economic barriers. The latest large-scale attempt to compost post- consumer food waste ended in a massive failure that will now require a major environmental clean-up . Until there is an a isting composting facility that can prove that it is capable of succeeding where most attempts have failed, the truthful answer to the question, "Will these products be composted in the County of Hawaii is "No . Considering these facts that foodservice packaging is unlikely to be recycled or composted on -island, we fail to see how there can be any reasonable argument that the more a pensive compostable products currently sold in Hawaii are quantifiably "environmentally friendly. The production of all packaging involves environmental trade-offs, and the selection of the "best option requires a judgement call on which impacts are more acceptable. Substituting bio -based feedstocks in an industrial process to produce compostable containers does not necessarily mean that these products are "environmentally friendly or require less petroleum to produce and transport. In some cases, compostable materials may require environmental trade-offs that are incompatible with local opinion, such as the use of polylactic acid PLA -based plastics which are among the most commonly available type of compostable food containers. The cultivation of corn requires more nitrogen fertilizer, more herbicides and more insecticides than almost any other U.S. crop, and that practice contributes to soil erosion and water pollution when nitrogen runs off fields into streams and rivers." In addition, PLA is refined from GMO corn that has been genetically engineered to ma imi a the compounds that are a tracted to produce the needed feedstock chemicals. One must acknowledge the environmental trade-offs associated with the use of any packaging material and whether a mandate to use one particular type of container or product will have the desired result of reducing litter and or marine debris. A Harvard study reported that styrene is naturally present in food such as strawberries, beef, and spices, and is naturally produced in the processing of foods such as wine and cheese. The study noted that "federal regulations also permit low concentrations of styrene in food as an additive. The scientists reviewed all of the published data on the quantity of styrene contributed to the diet due to migration from food contact packaging. The scientists concluded that there is no cause for concern from exposure to styrene from food or from polystyrene used in food contact applications, such as packaging and foodservice containers.10 The FDA, Health Canada and Environment Canada concluded extensive studies that polystyrene is "non-toxic" and that styrene does not constitute a danger to human life and health and "does not constitute a danger to the environment on which human life depends."" The concept of growing corn on Hawaii Island, and processing that GMO corn into a food package by any reasonable analysis would result in a tremendously cost prohibitive item. If not corn, it would be another crop requiring industrial agricultural practices to produce enough feedstock for the manufacturing process. All this water, fertili er and land would not be used for food, but instead to recreate something that is already cheap and abundant. The cost of land, water, labor, and building infrastructure in Hawaii are close to the highest in the world. Farmers who sell locally grown food have a hard time making a living in Hawaii. Selling crops as food is a much higher use than growing crops to be used in food packaging materials and commands a higher price by consumers. We need to increase the amount of food grown in Hawaii to feed people. Growing crops to be used for packaging material is the not the best use of agricultural land. Encouraging industrial agricultural production of crops to be turned into food packaging is not good for the environment. The only truly "environmentally friendly foodservice packaging is one that is reusable. Reusable packaging is carbon neutral. ou don t have to use nitrogen fertili er to grow it or inflict a very high carbon footprint of shipping products from China to the mainland and then to Hawaii. Consumers can be encouraged to bring their own reusable packaging through public education campaigns at the county level. However, the state health department should first give their opinion on the potential public health risks before any decision is made by this task force. Having consumers hand unsaniti ed reusable containers across the counter into the food preparation area could create compliance issues with a isting health codes. We can t estimate the cost of the County of Hawaii signing onto Malama 0 and adopting best management practices for litter. The cost would have to be researched by the county. We also can t estimate the cost to the County of Hawaii engaging in a public education campaign about litter reduction and the promotion of reusable products. The cost would have to be studied at the County level. 3-304.17 Refilling Returnables. 1. (A) A take-home food container returned to a food establishment may not be refilled at a food establishment with a potentially hazardous food (time/temperature control for safety food). 2. (B) Except as specified in ¶ (C), a take-home food container refilled with food that is not potentially hazardous(time/temperature control for safety food) shall be cleaned as specified under ¶ 4-603.17(B). 3. (C) Personal take-out beverage containers, such as thermally insulated bottles, nonspill coffee cups, and promotional beverage glasses, may be refilled by employees or the consumer if refilling is a contamination -free process as specified under ¶¶ 4-204.13(A), (8), and (D). 4. When trash decomposes, it releases methane and other greenhouse gases that contribute to climate change causing health problems to humans and animals; and WHEREAS, University of Hawa`i at Hilo implemented this concept over a year ago and it has proven to be a highly effective approach to minimizing the use of plastic bottles by encouraging students to drink cool, clean, and safer water, in refillable water containers, such as Hydro Flasks; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it hereby requests the Department of Parks and Recreation to encourage minimizing the use of plastic water bottles by installing water bottle filling stations at County of Hawaii Parks and Recreation facilities island wide, as recommended unanimously by the Hawaii Island Packaging Sustainability Initiative Stakeholders Task Force. WHEREAS, the Hawaii Island Packaging Sustainability Initiative Stakeholders Task Force, hereinafter referred to as HIPSIS Task Force, is comprised of participants from divergent backgrounds and interests as designated in Resolution No. 565-16, Draft 3, adopted unanimously by the Hawai'i County Council on August 17, 2016; and WHEREAS, Resolution No. 356-07, Draft 2, a resolution to embrace and adopt the principles of zero waste as a long-term goal for Hawaii County and to incorporate the zero waste philosophy into the County of Hawaii Integrated Resources and Solid Waste Management Plan (IRSWMP), was adopted by the County Council, December 19, 2007; WHEREAS, at its third session held on October 6, 2016, members of the HIPSIS Task Force who attended in person at the Hilo Council Chambers, via Kona videoconference satellite, and via phone, voted unanimously on a solution that will reduce the amount of product and packaging waste that enters our ocean, which is detrimental to marine life; and WHEREAS, the solution is to encourage manufacturing packaging on Hawai'i Island that is aligned with the IRSWMP and zero waste policies; and WHEREAS, Section 3.2.2 of the County of Hawaii IRSWMP states, in part, "...one of the fundamental principles of zero waste is redesigning products and packaging, by taking into account the entire life -cycle of a product. In contrast to the current emphasis on disposability, products and packaging within the zero waste framework are designed with an emphasis on minimal use of materials, use of recycled and benign resources, longer product lives, and maximum potential for every product to be repaired, reused, or recycled...."; and WHEREAS, Section 4.5.11 `Maintain Active State and Regional Profile on Zero Waste Public Policy' of the County of Hawaii IRSWMP states, "The County could work with State and Federal legislators and encourage other communities in the region to adopt similar zero waste goals and plans. This effort could include a coordinated effort with regional cooperation, to support state and national efforts to adopt: • Extended producer responsibility. • Deposit programs. • Funding of zero waste initiatives through statewide or regional landfill surcharges and product charges. • Change school collection contracts to include recycling. • Full cost accounting for waste disposal. • Packaging levies (for example, on plastic bags). • Minimum recycled content standards for additional products. • Design for the environment programs. • Green procurement and green building guidelines for the public sector. • National measuring, monitoring and reporting in achieving zero waste goals. • New mechanisms for financial assurance for post -closure liabilities for landfills.
