ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 10, DIVISION 1, OF THE
HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO
SPEED LIMITS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. The purpose of this amendment is to address the simultaneous extension
of the 35 mile per hour speed limit on a portion of Kuakini Highway by setting the speed limit on
the subsequent portion of Kuakini Highway to a 45 mile per hour speed limit.
SECTION 2. Chapter 24, Article 10, Division 1, Section 24-260, Schedule 8, 45 mile
per hour limit, subsection (f), Kona, be amended by revising item (3) as follows:
(3) Kuakini Highway, [: - • . .. ' :.: . . ' : . - .]from the
property line between the parcels identified as Tax Map Key
Numbers (3) 7-5-017:005 and (3) 7-5-017:002 to Highway 11.
SECTION 3. Material to be repealed is bracketed and stricken. New material is
underscored. In printing this ordinance, the brackets, bracketed and stricken material and
underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end, the provisions of this ordinance are declared to be severable.
SECTION 5. This ordinance shall take effect upon its approval.
