"Anaeho'omalu, South Kohata, Hawaii TMK: (3) 6-09-008: 030 I. BACKGROUND A. General Background Currently, there is one entrance from the Queen Ka'ahumanu Highway ("QKH") to the Waikoloa Beach Resort ("Resort"). A second one is currently under construction which, when completed, would be a fully channelized and signalized intersection. This new access is situated makai of the Highway, across of Waikoloa Road. This new access would result in Waikoloa Beach Drive forming a loop around the resort, thus facilitating ingress and egress movements in a much safer and more efficient manner. (Figure 1) In conjunction with this access improvement, a new directional sign is being planned at this intersection by the landowner, Waikoloa Development Co. ("Applicant"), on behalf of the Waikoloa Beach Resort Association. However, because the proposed sign exceeds the minimum size requirement within the Open zone, a variance must be secured from the County Council. This report is intended to describe the nature and justification of this request. B. Proiect Location As noted above, the proposed sign is planned for the new northern access into the Resort. Specifically, it would be situated on the southern end of the new access road (Waikoloa Beach Drive), providing visibility for both traffic traveling makai on Waikoloa Road and south along the QKH. The sign would be constructed within the road right-of-way on a property identified by TMK: 6-9-008: 030 and also owned by the applicant, Waikoloa Development Co. More specifically, it would be situated sixteen (16) feet three (3) inches from the road edge of Waikoloa Beach Drive and nearly sixteen (16) feet from the edge of the QKH right-of-way. (Figure 2) 1 II. NATURE AND PURPOSE OF REQUEST A. Proposed Sign The proposed structure or monument upon which the ground sign will be mounted upon has a width of sixteen (16)feet, and a height of eight(8)feet resulting in a total of one hundred twenty-eight (128) square feet. The actual sign itself will consist of the resort's logo consisting of twenty-two (22) square feet and the corresponding written description of the resort (Waikoloa Beach Resort) consisting of fourteen (14) square feet. The combined area of the logo and written description will consist of thirty-six (36) square feet. (Figure 3) B. Requested Variance The applicant is requesting a variance from Hawaii County Code, Chapter 3 (Sign), Article 1, Division 4, Section 3-12, Signs permitted in agricultural/open districts (RA, FA, A, IA, 0). Specifically, Section 3-12 reads: "(a) Ground sign. One ground sign not exceeding eight square feet in area, relating to a business conducted on the premises, provided that the building in fmnt of which the sign is displayed is set back not less than thirty feet from the street. In this situation, the applicant is proposing only a ground sign, which is permitted. The proposed sign will not front any building for which it is intended to introduce. Thus, that provision should not be applicable. However, the combined area of the logo and wording is thirty-six (36) square feet that would be mounted on a one hundred twenty-eight (128) square foot structure. As such, the thirty-six (36) square foot area would be considered the sign, one which exceeds the maximum of eight (8) square feet. The requested relief is from that requirement. III. JUSTIFICATIONS FOR REQUEST In considering a sign variance, Division 6, Section 3-22 of the Sign Code outlines the variance process as well as the criteria or guidelines for considering a variance. Generally, a variance may be granted by the County Council in "unique cases where strict enforcement of this chapter would result in unnecessary hardship or practical difficulty, and where desirable relief may be granted without detriment to the public interest, convenience, or welfare...." Section 3-23(a) amplifies this overall purpose by identifying 2 six (6) conditions under which a variance may be granted. The conditions and supportive rationale follow. A. Special and Unusual Circumstances This criterion notes that the variance is necessitated "by peculiar physical conditions not ordinarily found in most districts, because of the peculiarity of the business, or as a result of a special event or circumstance." In this case, there is no peculiar physical condition, such as landform or other structure that could obstruct the view of the sign resulting in the need for a larger sign. However, the size of this sign is somewhat unique or"peculiar", as it is designed not to identify a specific business but a major complex or area. In a sense it could be considered somewhat directional and all encompassing rather than a specific entity or business. It would be no different than the applicant's sign at the south end or even other resort complexes or major destinations such as the Hawaii Volcanoes National Park, as opposed to sign for a specific business like Starbucks. B. Impacts to Adjoining Properties In this case, the applicant owns the adjoining property, which is a part of the golf course. It would not visually impede the views of those adjoining properties. Equally important, since this is an overall identification sign, as opposed to one identifying a specific business, its approval would not be conferring any special or added benefit to one establishment over another. It should also be noted that the sign, including the mounting, will follow the motif of the other sign at the south end of the resort. Lava rock and other features will be used that will help not make the sign totally out of character with the surrounding natural landscape. C. Unreasonably Violate Public Interest,Safety, Convenience, or General Welfare The requested relief would not be inherently violative of the spirit and intent of the Sign Code, but would instead promote the public interest, safety, convenience and welfare. 3 The sign would have to be large enough so that people driving to this area along the QKH would clearly and safely know the location of the overall resort(and not necessarily a specific business establishment). Without such important directional sign, the unsuspecting visitor could easily pass the area. That would not only serve as an inconvenience, but because of the added movements, it could compromise traffic safety. Further, the sign needs to be reasonably and safely set back from the QKH and Waikoloa Resort Drive to avoid traffic conflicts. Because of the need for setbacks and to enhance visibility, the sign understandably should be a little larger than normal. D. Unnecessary Hardship and Practical Difficulty Upon Applicant and Community Having a smaller sign would provide not so much a hardship on the applicant but possibly more on the broader community. The applicant knows where the resort is; however, the community—more so the visiting one—may not and that is where the hardship would lie. As such, it is principally the visiting community that would be the primary beneficiary of this larger sign. E. Would Not Be A Grant Of Special or Personal Privilege Because the sign is designed to identify an entire resort or area (unlike a specific business), it does not fall under the realm of a typical sign. If it were for a specific business, then, it would have the appearance of a grant of special or personal privilege. As such, the nature of the sign makes this request not one falling under the "personal privilege" classification. F.
