The Department of Public Works ("DPW") respectfully submits comments and information regarding Bill No. 245. This legislation seeks to ban all "toxic herbicides" which are defined as, [...]those agents used to dispose of unwanted plants that are not deemed to be eco-friendly, including but not limited to those containing glyphosate, 2,4 Dichlorophenoxyacctic, atrazine, dioxin, picloram, bipyridinium, diphenyl ether, and tyrosine breakdown products. All herbicide products that bear an Environmental Protection Agency signal word of"danger," "caution," or"warning," or state "toxic to fish," or"toxic to fish and wildlife," or that indicate a risk of groundwater contamination, are included as "toxic herbicides." While this legislation attempts to set forth a goal for vegetation control, it does raise several questions. DPW hereby comments that this legislation is: 1. unnecessary since DPW already utilizes a multi-method approach to vegetation control; 2. would eliminate the use of many"organic" or eco-friendly" herbicides; 3. would increase maintenance cycles and operational; 4. does not address a large sector of herbicide users. Dru Mamo Kanuha, Council Chair and Members of the County Council October 31, 2016 Page 2 This legislation is unnecessary since DPW already utilizes a multi-method approach to vegetation control. DPW currently utilizes multiple methods for vegetation control ranging from hand tools, to mechanical equipment, and herbicide products. Herbicide is not the only vegetation control method DPW utilizes. DPW cuts a majority of the approximately 2490 total miles of roadway maintained. DPW does its best to be sensitive to the concerns of the public while it provides a safe, functional, corridor of travel within the County. DPW vegetation management seeks to maintain a clear zone, recovery area, minimal sight distance requirements, and erosion control. Depending on the area being worked in and the working conditions, DPW utilizes: hand tools; weed whackers; chainsaws; push mowers; boom trucks; herbicides; tractor mowers; Truck Kats. DPW personnel place signs and area notifications of the herbicide use. Prior to herbicide use, DPW personnel utilize wind gauges to measure wind speed. If wind speeds are too high, then herbicide spraying is not done. DPW has considered alternative herbicides and will continue to consider using alternatives if they are equal to or better than current products in use. DPW has been studying the effectiveness of various products and methods (i.e. Weed B Gone; Avenger; SaltNVater/Vinegar/Dawn; Round Up; Aquamaster; Weed Whack) and the preliminary results have been that glyphosate based products not only are fast acting, they require less frequent re-treatment than other products tested. See Exhibits 1 and 2 attached. II. This legislation would eliminate the use of many"organic" or"eco-friendly" herbicides. A review online of several "organic" or"eco-friendly" herbicides, such as Mirimichi Green; Avenger; Weed Pharm; Weed Zap; A.D.I.O.S. indicates that they would be banned from use since they have labels with EPA signal words. See Exhibit 3 attached. III. This legislation would increase maintenance cycles and operational costs. The elimination of herbicide means DPW will need to do more maintenance by hand or fossil fuel burning machines which will require more time and cost more. Presently, to weed whack it costs approximately$960/day at .5 miles a day. Compare that to herbicide use that costs approximately$110/day at 6 miles a day. To make up for the loss of efficiency(i.e. amount of roadway that can be maintained and how frequently we need to go back to a specific area of roadway to cut again) DPW projects it would need to purchase additional equipment and hire additional personnel to maintain acceptable maintenance cycles. The estimated cost for 2019 is approximately$3.7 million dollars for additional personnel (35) and equipment (12). County of Hawai'i is an Equal Opportunity Provider and Employer. This legislation does not address a large sector of users. This legislation targets County government agencies and facilities and does not address the private sector that may continue to use "toxic herbicides" as necessary. V. This legislation, if necessary, may be more appropriate as a resolution. If this Council feels legislative action is absolutely necessary then legislation in the form of a Council resolution may be more appropriate than an ordinance. The resolution could urge the further study of the issues to find appropriate means and methods for vegetation control. A resolution does not diminish the importance of the issue (i.e. Resolution 674-16 Urging the Mayor for Containment of Ohia to Prevent the Spread of Ohia Wilt Disease). A resolution does not pre-suppose a conclusion and may be appropriate especially if it affects multiple departments. VI. Conclusion DPW has been considering alternative herbicides and would consider using alternatives if they are equal to or better than current products in use. To this point, none have been more effective or cost efficient. The projected effect of eliminating herbicide as a method for vegetation control is that maintenance cycles would be longer and it would cost more.
