Dear Chairperson Arakaki:
Subject: Resolution of the Council of the County of
Hawaii Authorizing the Mayor to Enter into a
Contract with the Kalapana Gardens Community
Association and to Enter into any Required
Agreements with the United States Government,
the State of Hawaii or other Governmental Sody
or Agency and for the Payment of Funds of a
Later Fiscal Year
Enclosed please find the above titled resolution. The
resolution will provide this office the authority to negotiate
and execute a contract with the Kalapana Gardens Community
Association (KGCA) whereby the County of Hawaii will become the
applicant to the Federal Emergency Management Agency (FEMA)
approved KGCA Damage Survey Reports and that the County of
Hawaii will agree to fund certain KGCA improvements at a later
date. This action is necessary since the on-going lava flow
poses a high risk to public safety and has halted attempts to
begin reconstruction of the infrastructure in that portion of
Lower Puna. The Federal Emergency Management Agency (FEMA) has
stated that the assumption of the DSRS by the County of Hawaii
and the construction of an alternate project is the only viable
option.

Your Committee on Finance, to which was referred Resolution No. 72-99, reports as follows:
Resolution No. 72-99, transmitted by Mayor Stephen K. Yamashiro, via Communication
No. 239, dated Apri17, 1999, authorizes the Mayor of the County of Hawaii to enter into a
contract with the Kalapana Gardens Community Association and to enter into any required
agreements with the United States Government, the State of Hawaii, or other governmental body
or agency and for the payment of funds of a later fiscal year.
Communication No. 239.01, transmitted by Mayor Stephen K. Yamashiro, dated Apri129, 1999,
states the Federal Emergency Management Agency through the State Civil Defense Division has
requested that the subject resolution be withdrawn.
Your Committee on Finance is not in accord with the purpose and intent of Resolution No. 72-99
and recommends that it be filed.
