Dear Honorable Chairman James Arakaki:
RE: Resolution No. 97 99, Tax Rates for the
County of Hawaii
This written testimony for the County Council meeting scheduled for June
8, 1999, respectfully request that the Hawaii County Council consider
those residential homeowners who had dedicated their homes under Hawaii
County's Non-Speculative Residential Use dedication in 1992 which states
essentially that residential homeowner property taxes would be fixed at
the time of dedication of a period of ten years. A copy of my dedication
is attached for your reference.
Since the dedication is a contract between the residential homeowners
and the County of Hawaii, any changes to it's terms and conditions would
essentially constitute a violation of this dedication.

All persons are hereby notified that the below named owner has applied
for a non-speculative residential use dedication and the foregoing
property is subject to the terms, conditions and restrictions of an
approved dedication on file with the Real Property Tax Division with the
County of Hawaii.

TYPE OF DEDICATION: Non-Speculative Residential Use

EFFECTIVE DATE: July 1, 1992 DEDICATION PERIOD: Ten (10) years
TERMS AND CONDITIONS
If, during any period of the dedication, any breach of the
dedication requirements should occur, the special Non-Speculative
Residential Use assessment privilege shall be cancelled and retroactive
[axes shall be imposed. Breach of the dedication shall occur in the
following instances:
1. Failure by the owner to maintain the home exemption status of
the property by its use as the primary residence.
2. Violation of the exclusive residential use provision, including
dedicating the property to a ranching or other agricultural use
or receiving the benefit of the agricultural use assessment.
3. Upon subdivision of the dedicated property into condominium
units or separate parcels or lots.
4. Upon sale of the dedicated property or any portion [hereof by
way of a conveyance which is subject to the conveyance tax
which is imposed under the terms of Chapter 247, Hawaii Revised
Statutes.
5. Failure by the owner to obtain required building permits for
the construction of new or additional improvements or
renovations of the dedicated property.
BREACH OF DEDICATION
Retroactive assessments shall be imposed upon breach of the
dedication. The retroactive assessment shall be calculated as [he
cumulative difference between the amount that should have been owed
without the dedication less the amount actually paid for each of the
years deemed to be in breach plus interest at the rate of ten percent per
year.
Contact the Real Property Tax Division, Department of Finance,
County of Hawaii, for further information.

taxpayer(s) covered by Certificates of Title shown below:
