Your Committee on Planning, to which was referred Bill No. 171,
regarding the rezoning request of Chalon International of Hawaii,
Ainakea, North Kohala, Hawaii, TMK: 5-3-11:105, reports as follows:
Bill No. 171 amends Section 25-95C, Article 3, Chapter 25 of the
Hawaii County Code, by changing the district classification of
29,999 square feet of land from Village Commercial (CV -10) to
Open (0).
The subject property is located in North Kohala, near the
Ainakea Subdivision. A large portion of the property is part of the
Hapahapai Gulch.
In requesting the rezoning, the applicant stated that "We are
submitting this rezoning request because the subject pacel is
basically a gulch and serves as the drainage area for mauka lands,
and thus has minimal commercial or any other development potential.
A reversion to an Open zoning would be consistent with the parcel's
natural geography and its current use."
The Planning Commission states that "The rezoning action would retain
the property in its natural open condition as a gulch since no
enclosed structures would be permitted within the Open district."
Your Committee on Planning is in accord with the intent and purpose
of Bill No. 171 and recommends that it pass first reading.
