HomeMy WebLinkAboutREP PC 119 05/27/1986 1984-1988e REPORT OF THE COMMITTEE ON PLANNING DATE: May 27, 1986 PLACE: Councilroom TIME: 1:30 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Your Committee on Planning, to which was regarding the rezoning request of Oceanic North Kohala, Hawaii, TMK: 5-3-06:18 and follows: Re: Comm. 477 referred Bill No. 154, Properties, Ainakea, portion of 21, reports as Bill No. 154 amends Section 25-91 (North and South Kohala Districts Zone Map), Article 3, Chapter 25 of the Hawaii County Code, by changing the district classification of approximately 74 acres of land from Agricultural 20 -acres (A -20a) to Single Family Residential (RS -10), Multiple Family Residential (RM -4) and Village Commercial (CV -10). The General Plan designates the property for Alternate Urban Expansion, which may allow single and multiple family residential and commercial uses as proposed. The residential usage of the property also conforms to the Kohala Community Development Plan which designates the majority of the property as RES -4 or four units per acre. The area proposed for Village Commercial and Multiple Residential are designated for Village Commercial by the Kohala Community Development Plan. On May 21, 1985, the State Land Use Commission granted a boundary amendment for the property from Agricultural to Urban subject to a condition that Oceanic Properties shall offer for sale, on a preferential basis, single-family lots to be developed on a 5.3 acre portion of the property to residents of the State of Hawaii of low and moderate family income or dedicate a 5.3 acre portion of the property to the County of Hawaii for the development of an elderly multi -family housing project. Condition (C) of Bill 154 requires Oceanic Properties to sell, on a preferential basis, single family lots to be developed on a 5.3 acre parcel, or in another area as may be mutually agreed to by the Hawaii County Housing Agency, the Planning Department and the petitioner; however, it does not make any reference to the Land Use Commission's alternative condition of dedicating the 5.3 acre parcel to the County for an elderly housing project. (Note: the property referred to by the Land Use Commission and Condition (C) as being 5.3 acres in size, should be 5.47 acres. This parcel is identified as Parcel "B" in Exhibit A of the bill.) PC REPORT NO 119 ADOPTED: JUN 4 1986 PC -119 Page 2 May 27, 1986 While Condition (C) does not make any reference to the dedicating of land to the County, Communication No. 477.2 makes reference to this condition. Communication No. 477.2 is a letter from Scott Leithead, Administrator of the County Housing Agency, to James Steinwascher of Oceanic Properties. The letter states that Oceanic Properties agrees to dedicate the 5.47 acre parcel to the County for an elderly housing project and that the "dedication of this parcel shall be independent of the SLU boundary amendment and the change of zone application and any housing condition attached thereto." The letter also states that Oceanic Properties shall sell 10% of the improved lots, on a preferential basis, to families of low and moderate income. Your Committee on Planning is in accord with the intent and purpose of Bill No. 154 and recommends that it pass first reading and be recommitted to the Committee on Planning.
