Rezoning Request - Oceanic Properties
Tax Map Key 5-3-06:18 and portion of 21
The Planning Commission, at its meeting on November 20, 1985
voted to recommend for your approval the proposed legislative bill
to change the district classification from an Agricultural 20 -acre
(A -20a) to Single Family Residential - 10,000 square foot (RS -10),
Multiple Residential - 4,000 square foot (RM -4) and Village
Commercial - 10,000 square foot (CV -10) zoned districts at Ainakea,
North Kohala, Hawaii.
The Commission concurs with the following findings as
recommended by the Planning Director:
The requested zone changes conform to the General Plan Land
Use Pattern Allocation Guide (LUPAG) Map which designates the
property for Alternate Urban Expansion (AUE). The AUE
designation may allow single and multiple family residential and
commercial uses as proposed.
The LUPAG Map component of the General Plan is a
representation of the document's goals, policies, standards, and
courses of action. It is also a graphic depiction of the
physical relationship between various land uses. The LUPAG map
establishes the basic urban and non -urban form for areas within
the county. The area under consideration is situated within the
urban form established for this section of the North Kohala
District as depicted on the LUPAG Map.

The residential usage of the property also conforms to the
Kohala Community Development Plan (CDP) which designates the
majority of the property as RES -4 or four units per acre. The
area proposed for Village Commercial (CV -10) and Multiple
Residential (RM -4) zoned districts are designated for CV uses by
the CDP. The Zoning Code allows multiple residential uses
within the CV zoned area at a density of 1,250 square feet of
land area per unit. Therefore, while a RM zoned district is
requested within the CDP's suggested CV zoned area, the proposed
density will still be well within the allowable limit.
The proposed Single Family Residential (RS -10) and RM -4
zoned districts would be consistent with the General Plan
Housing goals of providing a variety of housing choices, as well
as attaining a diversity of socio-economic housing mix within
this section of the North Kohala District. The provision of
10,000 -square foot sized lots and multiple residential units,
along with other existing and proposed 10,000- and 15,000 -square
foot lots, would provide a myriad of residential units in the
area. In addition, the housing requirement imposed by the State
Land Use Commission will ensure that the range and variety of
housing choices are broadened. Based on the above, it is
determined that by allowing the proposed development for the
types of potential clientele, the Housing goals of the General
Plan may be attained for this area of North Kohala.
With regard to the proposed CV zoned district, the purpose
is to retain the existing Kohala Health Center facility, as well
as to comply with the condition imposed by the State Land Use
Commission which states "To afford private doctors an
opportunity to continue to lease the existing Kohala Health
Center to community medical service."
Furthermore, the proposed rezoning action would complement
the existing and future land use make-up of the surrounding
properties; thus, provide for an orderly development of the area.
The property is situated adjacent to Kapaau Village. As
such, the request will also conform to the Land Use,
Residential, and Commercial elements of the General Plan which
basically state to zone urban -type uses in areas with ease of
access to community services and employment centers and with
adequate public utilities and facilities. The property is
provided with all essential utilities and facilities, including
water, which are essential to accommodate the proposed
development.
With the exception of those portions which are part of the
Pali Akamoa and Hapahapai gulches, the property has no severe

geologic or topographic problems which cannot be properly
rectified or which would render the land unusable for the
proposed uses.
Finally, while the majority of the property is classified
as prime agricultural land, we realize that such is the case for
the majority of lands in the habitable sections of the North
Kohala District between Upolu Point and Pololu Point. Lands
basically unsuitable for agricultural uses are situated further
to the south between the Upolu Point area and the North/South
Kohala boundary. However, besides not General Planned for urban
uses, these lands also lack the basic amenities and
infrastructures necessary for immediate urban -type development.
Therefore, rather than creating new residential communities in
isolated areas which lack these amenities, we must look towards
providing urban expansion areas adjacent to existing
communities. In this particular case, it is felt that the
granting of this request at its location will not be detrimental
to the existing and future agricultural activities within the
North Kohala District.
For your favorable consideration, an amendment to Section 25-91,
the North and South Kohala Districts Zone Map, of the County Zoning
Code is transmitted.

This is to acknowledge receipt of your letter of December 13,
1985, regarding your change of zone application.
As indicated in your letter, proposed Condition I applies only
to the areas proposed for Single Family Residential -10,000 square
foot (RS -10) zoned district. The provision of curbs, gutters, and
sidewalks will still be applicable for the areas proposed for
Village Commercial -10,000 square foot (CV -10) and Multiple
Residential -40,000 square foot (RM -4) zoned districts.
This letter will be made a part of the official record and will
be transmitted to the County Council along with the proposed
ordinance.
Please be informed, however, that we have yet to receive the
metes and bounds description and map of the property. The descrip-
tion and map are needed to prepare the draft ordinance. Your
attention on this matter will be greatly appreciated. Should you

CHANGE OF ZONE: OCEANIC PROPERTIES, INC.
Oceanic Properties, Inc. has submitted an application for a
change of zone for 74+ acres of land from Agricultural 20 -acre
(A -20a) to Single Family Residential -10,000 square foot (RS -10),
Multiple Residential -4,000 square foot (RM -4) and Village
Commercial -10,000 square foot (CV -10) zoned districts. The property
is located along the makai or north side of the Hawi-Niulii Road,
adjacent and to the east of the Kohala Hospital, Ainakea, North
Kohala, TMK: 5-3-6:18 and 21 (portion).
GENERAL INFORMATION
1. The petitioner is the owner of an option to purchase the
property from Kohala Corporation, Inc., who is the fee simple owner
of the property. The petitioner and Kohala Corporation, Inc. are
wholly-owned subsidiaries of'Castle & Cooke, Inc. Kohala
Corporation has authorized the petitioner to apply for this request.
PROPOSED DEVELOPMENT
2. The petitioner intends to rezone 66.8 acres into the RS -10
zoned district, 5.3 acres to RM -4, and 1.9 acres to CV -10.
3. The proposed RS -10 zoned area will be subdivided into 120
moderately -priced single family residential lots ranging in sizes
from 10,000 square feet to 30,000+ square feet. The proposed RM
zoned area will be set aside for an elderly or affordable housing
project. However, as a contingency, the petitioner stated that this
site may be used to develop ten to fifteen 10,000 square foot
sized lots. The proposed CV zoned area will be created to maintain
the existing Kohala Health Center.
4. The petitioner stated that this proposed residential
project ". . . is intended to satisfy the modest housing needs of
former Kohala plantation employees, present West Hawaii resort
employees and other Kohala area residents. A questionnaire survey
by Oceanic Properties indicated a great interest by present resort
employees and former Kohala plantation employees to purchase their
own single-family lot. This project also anticipates the new units
needed to fulfill the demands of new Kohala households due to
natural population increase."
5. At a hearing conducted by the State Land Use Commission,
the petitioner stated that the average -selling price of the
residential sized lots is estimated at $35,000 to $40,000 per lot
(1984 dollars).
COUNTY AND STATE PLANS
6. The General Plan Land Use Pattern Allocation Guide Map
(LUPAG Map) designates the property for Alternate Urban Expansion.
7. On May 21, 1985 (date of Decision and Order), the State
Land Use Commission granted a boundary amendment for the property
from the Agricultural to the Urban District subject to the following
conditions:
"1. Petitioner shall provide housing opportunities for low
and moderate income Hawaii residents (as defined below) in any
one or combination of the following manners prior to assigning
or transferring (except by way of mortgage or assignment as
security) its interest in the Property:

"a. To offer for sale, on a preferential basis, on
its own or in cooperation with either or both the Hawaii Housing
Authority or the County of Hawaii, single-family lots to be
developed on a 5.3 acre portion of the Property, to residents of
the State of Hawaii of low and moderate family income as
determined by the Hawaii Housing Authority of County of Hawaii
from time to time. The preferential lots shall be offered for
sale at prices not exceeding prices that enable such purchasers
to qualify for and obtain state -assisted financing (i.e., Act
104 or Hula Mae) or federally -insured or assisted financing
(i.e., FHA Section 245 program) intended to encourage home
ownership by low and moderate income families; or
"b. dedicate a 5.3 acre portion of the Property to
the County of Hawaii for the development of an elderly
multi -family housing.
"2. To afford private doctors an opportunity to continue
to lease the existing Kohala Health Center for community medical
services.
"These conditions may be fully or partially released by the
Commission as to all or any portion of the Property upon timely
motion and provision of adequate assurance of satisfaction of
these conditions by the petitioner."
The Planning Department went on record in support of the request.
8. The Kohala Community Development Plan adopted by the
Planning Commission on September 25, 1984 (PC Resolution No. 2)
suggests a RES -4 (4 units per acre) and a CV designation for the
property.

9. The property is not situated within the Special Management
Area (SMA). However, the makai portion of the TMK: 5-3-06:21 is
within the SMA.
DESCRIPTION OF THE PROPERTY
10. Parcel 18 is 0.7+ acre in size, while the total land area
of parcel 21 is 606.2 acres, of which, 73.3+ acres are within the
petitioned area.
11. According to the Soil Survey Report published by the
U.S.D.A., Soil Conservation Service, the property is of the Kohala
Series (KhA, KhC, KhE). The gulches within the property are
classified Rough Broken Land (RB), which is a miscellaneous land
type that consists of very steep, precipitous land broken by many
intermittent drainage channels. The Kohala soil series consists of
well -drained silty clays that formed in material from igneous rock
influence by volcanic rock. Permeability is rapid, runoff ranges
from slow to rapid,and the erosion hazard ranges from slight to
severe.
12. The Land Study Bureau's overall master productivity rating
for the gulches is Class "E" or Very Poor, while the majority of the
property is Class "C" or Fair. It should be noted that the majority
of lands in North Kohala between Upolu Airport and Pololu Point is
classified either "B" or "C."
13. The gulches are designated "Other Important Agricultural
Lands by the State Department of Agriculture's Agricultural Lands of
Importance to the State of Hawaii (ALISH) classification system.
The remainder of the property is classified "Prime Agricultural

Lands." Similar to the Land Study Bureau's report, the majority of
the lands between Upolu Point and Pololu Point are classified as
"Prime Agricultural Lands."
14. The elevations of the property range from about 390 feet at
the north end to about 480 feet at the southern portion. The
property has a 0 to 10 percent slope. The gulches, however, are
about 30 to 50 feet deep with sides having slopes of 20 percent or
more.
15. The area received about 50 to 60 inches of rainfall
annually.
16. The eastern and western portions of the property are part
of the Pali Akamoa Gulch and Hapahapai Gulch, respectively.
According to the Flood Insurance Rate Map (FIRM), only Pali Akamoa
Gulch is designated as Zone A (100 -year flood area). The remaining
portion of the property, including Hapahapai Gulch, is classified
Zone "C" (Area of minimal flooding).
17. An archaeological reconnaissance survey conducted by
Chiniago, Inc. concluded that there is no evidence of prehistoric
or historic utilization of the property.
18. The Kohala Health Center, which was the former plantation
dispensary, is located at the southwestern portion of the property.
Also on the property is the Hawaiian Telephone Company's radio
station site. The remainder of the property, which was formerly in
sugar cane, is used for short-term pasture use.
DESCRIPTION OF SURROUNDING AREA
19. Kapaau Village, which includes several commercial

establishments, the civic center complex and the Kohala Hospital, is
situated adjacent and to the west of the property. The lands within
the village are designated urban and are either zoned Single Family
Residential -15,000 square feet (RS -15) or Village Commercial -10,000
square feet (CV -10). Lands to the north, south and east, also owned
by Kohala Corporation, Inc., are within t'he State Land Use
Agricultural District and zoned Agricultural 20 -acre (A -20a). These
lands were formerly used for sugar cane production but are now used
for limited grazing activity.
UTILITIES AND SERVICES
20. Fire protection is provided by the 8 -hour fire station in
Kapaau Village. Additional 24-hour protection is provided by the
Waimea Fire Station.
21. Police service is provided by the police station at Kapaau
Village.
22. Electrical and telephone service are available to the area.
23. There is no public sewerage system in the area. Cesspools
are used as the method for sewage disposal.
24. Presently, the Hawi-Niulii Road serves to direct any
surface water runoff from the mauka areas into the adjacent Pali
Akamoa and Hapahapai gulches. The petitioner intends to dispose ail
surface water runoff generated by the proposed development either in
the gulches through storm drainage systems or through the use of
drywell sumps.
25. The Hawi-Niulii Road has right-of-way widths that vary from
100 to 30 feet. The section fronting the property has a
right-of-way width of about 30 feet with a 20 -foot wide pavement.
26. Water is available to accommodate the proposed development.
AGENCIES COMMENTS
27. Department of Water Supply:
"Please refer to our letter dated October 18, 1984 to
Mr. Kimo Steinwascher attached in the applicant's submittal.
The contents of said letter are current. Therefore, we have no
objections to the proposed request."
The October 18, 1984 letter states the following:
"This is to acknowledge receipt of the required $26,250.00
water commitment deposit for the proposed subdivision
development.
"In accordance with the Department's 'Water Commitment
Guidelines Policy,' a copy of which is attached, a water
commitment for 175 lots or units requested in the proposed
subdivision development in the amount of 0.1050 million gallons
per day is hereby granted until October 31, 1987 with the
following conditions:
"1. Submit plans for necessary water system improvements
as may be required for the Department's review and
approval at the appropriate time. Complete
construction of the required improvements. The
required improvements will include, but are not
limited to, the construction of an 8 -inch pipeline
connecting the Halaula and Kapaau water systems.
"2. Comply with all applicable policies and requirements
of the rules and regulations of the Department,

including, but not limited to, payment of prevailing
facilities and installation charges at the appropriate
time.
"3. Comply with all applicable governmental regulations
and conditions of necessary governmental approvals.
"4. Comply with the terms and conditions of the
Department's 'Water Commitment Guidelines Policy.'
"Please be informed that should our existing water system
facilities be damaged by grubbing or grading operations or
should the relocation of our water system facilities be
necessary to complete construction of the subdivision, the
subdivider shall bear full responsibility for all costs incurred
for repair or relocation of the existing water system facilities.
"Also, no water services shall be granted to the proposed
subdivision until the water system and all necessary easements
are conveyed to the Water Commission, County of Hawaii."
28. State Department of Health:
"An individual wastewater system may service a maximum of
800 gallons per day of sewage, which is generated from a single
or multiple dwelling unit complex, containing a total of only
four (4) bedrooms. A report describing the system is required
to be reviewed and accepted by the Department of Health prior to
occupancy of the building."
29. Real Property Tax Division:
"In reviewing our records it appears that the 74+ acres
which are being considered for rezoning would be subject to
rollback taxes if subdivided into parcels of 5.000 acres or
less."
30. Fire Department:
"No objections. Provide adequate fire hydrant system."
31. Mauna Kea Soil and Water Conservation District:
"(1) Most of the proposed development is classified as
prime ag land if irrigated with a dependable supply and of
adequate quality.
"(2) No soil or water related problems if runoff from the
development is properly disposed of."
32. Department of Public Works:
"1. Building shall conform to all requirements of code and
statutes pertaining to building construction.
"2. All development generated runoff shall be disposed
on-site and shall not be directed toward any adjacent
properties. Submit drainage study.
"3. Due to the proposed combination of zonings RS -10,
CV -10, RM- recommend curbs, gutters and sidewalks be
provided.
"4. Section III, B, 'Existing Uses' describes TMK
5-3-06:18 as in a gulch, yet Exhibit Map No. 2
proposes this same parcel to have a CV -10 zoning.
This proposed zoning does not appear to be compatible
with the described topography. Perhaps should
ascertain buildable area in order to evaluate the
feasibility of a CV -10 zone, as the report states that
the gulches would be left untouched.
"5. Section III, D, 'Conceptual Development Plan' l.b.
state that 'the facility would be convenient to the
cm
hospital and health center and have good pedestrian
access to the highway.' We do not believe the use of
the Akoni Pule highway should be used by pedestrians
if at all possible and that an internal
pedestrian/roadway system should be provided. This
matter should also be discussed with the State Highway
Department."
33. State Department of Transportation, Highways Division:
"We have no objections on the proposed action under the
subject application.
"No additional storm runoff due to the development of the
parcels shall be allowed on the State's right-of-way.
"All access shall be from interior roads. No direct access
shall be given to the State highway except at access permitted
location for collector road.
"Construction drawings shall be submitted for our review
and approval.
"Any existing or proposed road or driveway connecting to
the State highway shall meet the standards given in the 'Hawaii
Statewide Uniform Design Manual for Streets and Highways' of
October 1980 and the 'Specifications for Installation of
Miscellaneous Improvements within State Highways' of May 1, 1984
and both as revised."
