This is to confirm the conversation of April 28, 1986, between yourself
and William Moore of any staff regarding the proposed affordable housing
rrdition for the Ainakea change of zone application, Ainakea, forth
Kohala.
Based on the discussion, our understanding is as follows:
1. That Oceanic Properties agrees to dedicate to the County of
Hawaii the 5.47 acre area identified as Parcel B on Exhibit A
for elderly housing activities. The dedication of this parcel
shall be independent of the SLU boundary amendment and the
change of zone application and any housing conditions attached
thereto.
2. That Oceanic Properties agrees to the following language for
proposed condition C of the change of zone:
The petitioner shall provide housing opportunities for low an -J
moderate income Hawaii residents in any one or combination of
the following manners as mutually agreed to by the Hawaii County
,lousing Agency, the Planning Department and the petitioner prior
to assigning or transferring (except by way of mortgage or
assignment as security) its interest in the subject property:
(1) to offer for sale, on a preferential basis, on its o -am or in
cooperation with the County of Hawaii and/or tr* Hawaii iiousing
Ajt)`tority 'a. ;cumber of lots equal to ten percent (10%) of the
single family improved lots and/or units to be developed on
Parcel A of Exhibit 1; on the subject property or in another
area as may be mutually agreed to by the Hawaii County Housing
Agency, the Planning Department and the petitioner, to residents
of the State of Hawaii of low and moderate family income as

determined by the County of Hawaii and/or Hawaii Housing
Authority. The lots shall be built according to specifications
and offered for sale at prices that enable such purchasers to
qualify for and obtain state and county assisted financing
(e.g., Act 105) or federally assisted financing (e.g., F%.4A)
intended to encourage home ownership by low and moderate income
families; or (2) to pay to tine County of lawai i for use in a
housing asssistance fund or for the benefit of low and moderate
inccoe residents of the County of Hawaii, a sun determined by
ithe County of Hawaii to be equal to the cost of the above.
Based on these understandings, we will rec owend to the County Council's
Planning Conani ttee that the proposed Ai naxea change of zone be placed
back on the Agenda.
Should you have any questions or concerns on the above agreeaxnts, please
call us ifxwdiately. In the meantime, we look forward to continue to
work with you in providing affordable housing for tine residents of the
County of Hawaii.
