Your Committee on Public Works and Intergovernmental Relations, to which was referred
Communication No. 482, and attached Resolution No. 164-02, reports as follows:
Communication No. 482, dated January 7. 2002, is from Assistant Corporation Counsel Gerald Takase, transmitting for
Council's review and consideration Resolution No. 164-02, authorizing the acceptance of a donation of real property from
Ms. Kikuyu Kanemoto, and specifically identified as tax map key (3)2-3-019:018.
Resolution 164-02 states that the bulk of the property, which is located along the Alenaio Stream Flood Control Channel
in Kukuau, District of South Hilo, sits within the streambed. the property, as a result, has no present or foreseeable future
use and is of no value to her. Consequently. she no longer wishes to pay [axes on it and has graciously agreed to donate
the property to the County of I Iawai'i. A quitclaim deed. Exhibit "A" and the further delineation of the parcel, Exhibit
"B". are also attached to the resolution.
Cnntmunication No. 482.1. is a letter dated January 18, 2002, from Assistant Corporation Counsel Gerald Takase,
informing that he will not he present at today's Committee meeting, and further explaining that the acceptance of this real
property donation will alleviate the real property tax burden on Ms. Kanemoto. In the letter, he also asserts that the
Federal government, during the initial phases of the stream project, should have condemned the property.
At this meeting, members of the Committee questioned the exact location of the parcel, and whether other property
owners are facing the same dilemma, and whether or not accepting a donation rather than processing the item, as a
"taking" was constitutionally sound. Members of the Committee familiar with the parcel and the stream project,
encouraged other members to visit the area if they had not yet had the opportunity to do so.
For informational purposes, Committee Member J. Curtis Tyler, 111, voted kanalua, then yes.
Your Committee on Public Works and Intergovernmental Relations is in accord with the purpose and intent of Resolution
No. 164-02, and recommends its adoption.
