Also deferred on January 8, 2003, Re: Bill 2; Comm. 17 (2002-2004 term; PC -2 (not adopted) (5 ayes, 4 noes at Committee: no discussion) REPORT OF I I If: C'OMMI I FF ON PLANNING DATE: December 17, 2002 RE: C-17 /Dill No. 2 PLACE: Councilroom IIMR: 2:31 p.m. Chair and Mcmbers Hawai'i County Council Hilo, Hawai'i 96720 Your Committee on Planning, to which was referred Dill No. 2. by Mayor Harry Kim per Communication No. 17, dated November 18, 2002, regarding the Planning Director initiated Zoning Code amendment relating to Kau-ili Street. TMK: 2-2-26 and 2-2-38. reports as follows: Bill No. 2 amends Section 25-8-33 (City off lilo Zone Map), Article 8. Chapter 25 (Zoning Code) of the Hawaii County Code by deleting the proposed 80 -foot Kawili Street right -of -wap bctwcen Kinoole Street and Kilauea Avenue. and amending it to 60 feet, the existing right-of- way. Due to the development within this arca. it -the road right-ot=way were to be widened, building and development restrictions may have to be placed on the parcels by the landowners. The 10 - toot future road widening restricts the landowner from utilizing or developing the parcel to its best use. reduces the parcel size and relocates the right-of-way closer to some of the existing dwellings, specifically the parcels on the Puna side of-Kawili Street. Also in order to construct the 80 -foot roadway. the County would need to either acquire or condennt a portion of each of the parcels, and/or relocate some of the existing dwellings and,,or families. According to the Planning Commission, the Department of Public Works indicated they had no objections to amending the City of I lilo Zone Map to delete the proposed Kawili Street 80 -trot right-of-way segment between Kinwole Street and Kilauea A% vane. The City of Hilo Zone Map, adopted by the Board of Supervisors on December 26. 1968, delineated the 80 -loot right-of-way between Kinwole Street and Manono Street. I knee. there is a proposed road widening from the existing 50 -font to an 90 -font right-ol-way between Kinoolc Street and Mauono- Kawili Street intersection. The General Plan with its Facilities Maps, adopted in December 1971. also indicate the proposed widening of Kawili Street to 80 feet. Committee Member Robert Jacobson mentioned that this is a high traffic arca. and before we reduce the right-ol way from the required size, we have to consider if there are any plans for bikeways, trails, etc. because once the 80 -foot right -of -wap is deleted. we cannot bring it back. For this reason, he stated that he would be voting against this measure. Committee Member,lames Arakaki then stated that we cannot move ahead with other projects if we have this lingering, because if it affects the Saddle Road extension, so we need to complete this project bet -ore we can move on with the Saddle Road project. Other members questioned this reasoning. to see how the two projects were related. but Arakaki continued that -it was there for smaller veins. now you are putting an artery through. so you have to extinguish what was there before. so that now you can plan this major thoroughfare, if not legally you cannot go through it." Communication 17 Bill Committee Member Robert Jacobson then responded -S0 you're saying we cannot move ahead on this project?-' To which Committee Member Arakaki replied "Can't move ahead on this project'. Then Committee Member Jacobson thanked Committee Member Arakaki for the clarification. Acting Chairman Curtis Tyler stated that we should move this measure up, and have someone from the Planning Department at the Council meeting to address the questions since we will be extinguishing the road. Your Committee did not entertain further discussion on this measure. For informational purposes only, Committee Member Curtis Tyler voted " kanalua. twice. Your Committee concurs with the Planning Commission and the Planning Director lot recommending a favorable consideration for the change of zone request. Based on the above. it is reasonable and fair to the public and to the private property owners to delete the proposed 80 -foot wide right-of-way between Kino'ole Street and Kilauea AYenue as reflected on the City of Hilo Zone Map. Your Committee on Planning is in accord with the intent and purpose of Rill No. 2, and recommends it pass first reading.
