My OPPOSITION for the County Council meeting; Res. 28-17-Transfer of$2,666. to Malama Kai
Foundation.
It is well documented that Kawaihae is a uniquely significant location in Hawaiian history. It is also
not efficiently inventoried
in the archives of the State Historic Preservation Division of the State Department of Land and
Natural Resources. The
Kawaihae community has always had a funding deficiency to survey and "jump through the hoops" of
governmental process
to acquire the necessary documentation to preserve and protect the many historical information
needed to satisfy the protection
of historical resources in Kawaihae.
One of the many features of Historic Kawaihae is to preserve and protect the coastline ko'a (fish
spawning areas and opelu
gathering areas) from mooring devices that Malama Kai Foundation has sought to install in the
past. Archaeology records
show that this ko'a originally began in Pelekane Bay, through what is now the Kawaihae Commercial
Harbor, toward north
Kohala. This was and still is the food sustainability resource of this community. It is a culturally
practiced tradition, still. It
is a teaching tool since the days of King Kamehameha I, and before him.
Currently, in Kai Opae Bay (located in front of the Kawaihae Hawaiian Homes subdivisions) there are
unwanted and illegal
mooring devices mostly used by the diving and tour groups. Other vessels seem encouraged to use
this area seeing these
dive charters in the Bay. These vessels that have no permits and cannot acquire permits to moor in
the TWO Small

Boat Harbors in Kawaihae; have been asked to move because they drop anchor on the coral and the
Rules are defficult to
implement. Anchoring damages the marine environment.
In the thirty years that I have used my lease in Kawaihae Homestead, we have battled proposals to
install moorings. We
have been successful in educating the Coast Guard in keeping their buoys aligned so the barges and
timber ships and
other large vessels do not impact the Ko'a. We have been successful in watching the fish inventory
grow; even though
the population has grown here. We have tried to protect the Watershed and streams from impacting
the coastline areas.
It is getting challenging; but allowing Malama Kai to install mooring in Kai Opae Bay is not an option.
My suggestion estion to amend this Resolution is: 1) to prohibit using mooring devices in Kai Opae Bay, 2)
prohibit Malama Kai
and others from installing mooring devices in Kai Opae Bay, and 3) now that the Council has been
informed of the location of
the ko'a, that a Resolution be issued to exempt Kai Opae Bay and Recognize the significance of this
area. Hopefully, the
West Hawaii Fishing Council and the Division of Aquatic Resources will follow through soon and work
with this community to
create Rules to make an exception to current Rules.
