ORDINANCE
AN ORDINANCE TO INITIATE A CHARTER AMENDMENT REGARDING THE
ESTABLISHMENT OF A GENERAL FUND EXPENDITURE CEILING.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:

SECTION 1. Purpose. The purpose of this ordinance is to
establish a general fund expenditure ceiling for the County of
Hawaii. Escalating costs of government operations are increasing at
a much greater rate than the growth of county fiscal resources. The
Hawaii County Council finds that measures to limit and control
government expenditures are in order.
SECTION 2. The Hawaii County Charter is amended by adding a new
section to be appropriately numbered by the Corporation Counsel and
to read as follows:
"Section General Fund Expenditure Ceiling
Notwithstanding any other provision to the contrary, the
County Council shall establish a general fund expenditure
ceiling which shall limit the rate of growth of general fund
appropriations excluding debt service obligations, and State and
Federal funds received. General fund expenditures shall not
exceed 1 percent of the certified real property assessed
valuations for the affected year nor exceed the average per
capita personal income growth rate (%) for the County of Hawaii
based upon the most recent three years data issued by the
U. S. Department of Commerce. No appropriations in excess of
such ceiling shall be authorized during any fiscal year unless
the Council shall, by a two-thirds vote of its members, set
forth the dollar amount and the rate by which the ceiling will
be exceeded and the reasons therefor.
SECTION 3. Upon adoption of this ordinance, this Council, by
appropriate resolution, shall provide that this amendment be
submitted to the electorate of the county for approval at the next
general election.
