AN ORDINANCE AMENDING ARTICLE 7 , CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, RELATING TO AGRICULTURAL USES. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Section 3 , Article 7 , Chapter 8 of the Hawaii County Code is amended to read as follows: "Sec. 3. PERMITTED USES A. Single family dwellings (only one per building site) . B . All forms of agriculture; the growing and gathering of crops , fruits , vegetables , flowers , trees , and other plants; the raising and keeping of animals and fowls except as listed in [Item 9 ; ] Items I and M of this section; the physical processing , storage and sale of the products produced on the premises [ . ] under the provisions of Item N of this section. C. Golf courses , country clubs , parks , playgrounds , tennis courts and other similar recreational areas that are essentially open lands and where none of the recreational features are entirely enclosed in a building . D. Private clubs or lodges , hunting or fishing lodges , and fraternal or social orders. E. Trailer parks with density of 3 ,500 square feet of land area per trailer and with "Plan Approval" of the Director. (NOTE: Bill revised to amend Hawaii County Code 1983) F. Home occupations. G. Dormitories and additional single family dwellings for persons employed on the premises when found to be necessary to the conduct of an agricultural use by the Director. H. Public dumps. I. Piggeries, apiaries , and pen feeding of livestock when not closer than 1 ,000 feet to any major public road or to any district other than a "U" on sites approved by the Department of Health and the Director. J. Airfields , heliports , and private landing strips. K. Commercial fertilizer yard utilizing only manure and soil. L. The killing , slaughtering or dressing for market of animals produced on the premises [ . ] , provided that the site or building for such activities is located at least one hundred feet from any property line. M. [Fish and poultry hatcheries. ] The raising of fish and poultry , provided that the buildings housing poultry animals are located at least one hundred feet from any property line. N. [Processing , storage , packing , shipping and sale of products produced on the premises provided the site or building used for such activity shall be at least one hundred (100) feet from any property line. ] -2- Processing , storing , packing , shipping , and selling of agricultural products grown on the same premises , provided that where noise or odor impacts on neighboring properties are anticipated or where the form of the product is changed , such as by peeling , crushing , slicing , mixing , cooking , canning or other alteration of their harvested form , the site or building used for such activity shall be at least one hundred feet from any property line. O. Riding academies , rental or boarding stables , dog kennels and catteries. P. Animal hospitals. Q. Commercial excavation or removal of natural building material or minerals. R. Guest ranches. S. Hunting and fishing lodges and preserves. T. Use and buildings normally considered accessory to the above permitted uses subject to approval of the Director . " SECTION 2. Material to be repealed is bracketed. New material is underscored. In printing this ordinance , the brackets, bracketed material and underscoring need not be included. SECTION 3. In the event that any portion of this ordinance is declared invalid , such invalidity shall not affect the other parts of this ordinance. -3- SECTION 4. AN ORDINANCE AMENDING SECTION 25-152, ARTICLE 8, CHAPTER 25 (ZONING CODE) OF THE HAWAII COUNTY CODE 1983, AS AMENDED, RELATING TO PERMITTED USES IN AGRICULTURAL DISTRICTS. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII : SECTION 1. Section 25-152, Article 8, Chapter 25 of the Hawaii County Code 1983 is amended to read as follows : "Section 25-152. PERMITTED USES . (a ) The permitted uses in A districts shall be as follows : (1 ) One single family dwelling per building site . (2) All forms of agriculture ; the growing and gathering of crops , fruits , vegetables , flowers, trees, and other plants ; the raising and keeping of animals and fowls except as limited in paragraphs (9) and (13) of this section ; the physical processing , storage and sale of the products produced on the premises subject to the limitations in paragraph ( 14) of this section . (3) Golf courses, country clubs, parks, playgrounds , tennis courts, and other similar recreational areas that are essentially open lands and where none of the recreational features are entirely enclosed in a building . (4) Private clubs or lodges , hunting or fishing lodges , and fraternal and social orders .
