Initiates a charter amendment regarding initiative and referendum;
(Delete Section 11-9 of the County Charter and replace with the
following: "Section 11.9. Results of Election.
A proposed initiative ordinance shall become an ordinance onlyif
approved at the general election by at least fifty-one percent of
all voters voting at the election shall thereupon be repealed;
The phase "voters voting at the election: means all persons who cast
a valid ballot for any candidate or any question at the general
election, whether or not such person cast a valid ballot for the
proposed initiate ordinance or referred ordinance".

ORDINANCE NO.
AN ORDINANCE TO INITIATE A CHARTER AMENDMENT REGARDING 'INITIATIVE
AND REFERENDUM.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Purpose.
It is the purpose of this ordinance to define, the term,
"majority of the voters," as used in the initiative and referendum
process. The Hawaii County Charter is the basic document
establishing the.or'ganization and operation of our county
government. The initiative and referendum powers.may have
far-reaching effects upon government organization's and operations
and, as such, should not be treated lightly.
The Council hereby finds that each proposed initiative ordinance
presented to the.electorate should'be de(cided,upon by at least
fifty-one percent of all the votes cast at the election.
SECTION 2. Section 11-9 of, the County Charter of the County of
Hawaii is.hereby deleted and replaced with the following:
"Section ll -9. Results'of Election.,
A proposed initiative ordinance shall become an ordinance of the

referred ordinance which is disapproved by-at,'least fifty-one
percent of all voters voting. at the election'shall thereupon be
repealed. The phrase "voters voting at the election" means all.
persons who cast a valid ballot for any candidate or on any
question at the general election, whether or not such person
cast a valid ballot for the proposed initiative ordinance or
referred ordinance."
SECTION 3. Upon adoption of this ordinance, this Council, by
appropriate resolution, shall provide that this amendment be
submitted to the electorate of the county for approval at the next
general election.
