ORDINANCE NO.
AN ORDINANCE AMENDING THE COUNTY OF HAWAII GENERAL PLAN, ORDINANCE
NO. 439, BY INCORPORATING TWO (2) AMENDMENTS TO THE GENERAL PLAN
LAND USE PATTERN ALLOCATION MAP AND ONE (1) AMENDMENT TO THE
GENERAL PLAN POLICY DOCUMENT INITIATED BY THE PLANNING DIRECTOR,
AS REFLECTED IN HIS REPORT ENTITLED, "COUNTY OF HAWAII GENERAL
PLAN REVISION PROGRAM, NOVEMBER, 1978".
BE IT ORDAINED BY THE COUNTY COUNCIL OF THE COUNTY OF HAWAII,
STATE OF HAWAII:
SECTION 1. The County of Hawaii General Plan, Ordinance
No. 439, is hereby amended by incorporating two (2) amendments to
the General Plan Land Use Pattern Allocation map and one (1)
amendment to the General Plan policy :document initiated by the
Planning Director, as reflected in his report entitled, "County of
Hawaii General Plan Revision Program, November 1978". The
specific, amendments to the General. Plan Land Use Pattern
Allocation map are:
A. Puna District
1. Low Density Urban Development/Orchards to Resort :
Kalapana further mauka of the Kaimu Beach in the
vicinity of the proposed Kalapana By-pass Road.
2. Resort. to Low Density Urban Development : Kalapana -
mauka of the Kaimu Beach and along the shoreline.
The specific amendment to the General Plan policy document is :
1. Amend the Kalapana Resort designation from
Intermediate Resort to Minor Resort.
SECTION 2. Severability. If any provision of this ordinance
or the application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions or
applications of the ordinance which can be given effect without
the invalid provision or application, and to this end the
provisions of this ordinance are declared to be severable.
411SECTION 3. This ordinance shall take effect upon its approval.

AN ORDINANCE AMENDING THE COUNTY OF HAWAII GENERAL PLAN
ORDINANCE NO. 439 AS AMENDED, BY INCORPORATING TWO (2)
AMENDMENTS TO THE GENERAL PLAN LAND USE PATTERN ALLOCATION MAP
AND DELETING THE "KALAPANA (INTERMEDIATE) RESORT AREA" FROM THE
GENERAL PLAN POLICY DOCUMENT.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1. Findings and determinations. The County Council
finds that the General Plan be amended to change the placement
of the resort designation for the Kalapana area. This amendment •
integrates the research and findings of the Planning Director,
Planning Commission and the County Council' s Committee on
Planning. In addition, its conclusions are based on
communications and testimony received at public hearings and
meetings . Upon considering the impact of economic trends , the
shifting emphasis of tourist destinations, citizen posture, and
government decisions, it has been determined that medium density
use is an achievable goal promoting the general welfare and
prosperity of the people of the County of Hawaii. The
feasibility of "resort" development in the near future is in
question due to conflicting community goals and financial
uncertainties. "Medium density urban use" offers the citizens
of the County, the property owners and the county government
more realistic options and objectives. Such use does not
preclude growth potential nor does it ignore the fact that
Kalapana offers a climate that is distinct to East Hawaii.
Finally, the county Council, recognizes the need to preserve the
shoreline, its natural resources and historic sites by reducing
density in this uniquely beautiful area.
SECTION 2. The County of Hawaii General Plan Policy
document, Ordinance No. 439, is amended as follows :
Delete the Kalapana (Intermediate) Resort area.

SECTION 3. The County of Hawaii General Plan Land Use
Pattern Allocation Guide Map, Ordinance No. 439 is amended as
follows :
1. Resort to Medium Density Urban Development :
Kaimu, on the Mauka side of Kaimu Bay.
2. Resort to Low Density Urban Development :
Kalapana, near the Canoe Landing/Painted Church.
SECTION 4. Severability. If any provisions of this
ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect
other provisions or applications of the ordinance which can be
given effect without the invalid provision or application, and
to this end the provisions of this ordinance are declared to be
severable.
SECTION 5. This ordinance shall take effect upon its
approval.
