PC - 1/29/82 PC Defer and refer to Legislative Committee to get clari- fication from the State Legislature at its next session on the legislative intent and the definition of "time sharing" and "transient vacation rentals" of HRS Chapter 514-E. - 2/24/82 110 BILL NO. 820 COUNTY OF HAWAII - STATE OF HAWAII ORDINANCE NO. AN ORDINANCE AMENDING ARTICLE 2 , CHAPTER 8 (ZONING CODE) OF THE HAWAII COUNTY CODE, AS AMENDED, TO DESIGNATE CERTAIN MULTIPLE FAMILY RESIDENTIAL (RM) DISTRICTS WHERE TIME SHARING AND TRANSIENT VACATION RENTALS ARE PERMITTED. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII : SECTION 1. Section 7 .04 , Article 2 , Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is further amended to add a new subsection, to read as follows: "7 .04 ( ) . The district classification of the existing Multiple Family Residential districts (RM-1 and RM-1.5) situated south (makai) of the Old Kailua Airport Road and west (makai) of Kuakini Highway at Lanihau and Puaa, North Kona in the Kailua resort area as shown on the Kailua Urban Zone Map on file with the Planning Department, shall be Multiple Family - Time Sharing and Transient Vacation Rentals (RM-T-1 and RM-T-1.5) . " SECTION 2 . Section 7 .05 , Article 2 , Chapter 8 (Zoning Code) of the Hawaii , County Code, as amended, is further amended to add a new subsection, to read as follows: "7 .05 ( ) . The district classification of the existing Multiple Family Residential districts (RM- .75 , RM-1.5 , RM-2 , and RM-3) situated west (makai) of the proposed Alii Drive Realignment and the presently existing portion of the new Alii Highway in the Holualoa and Keauhou - Kahaluu resort area, as shown on the Kailua-Honalo Urban Zone Map on file with the Planning Department, shall be Multiple Family Residential - Time Sharing and Transient Vacation Rentals (RM-T- .75 , RM-T-1,5 , RM-T-2 , and RM-T-3) . " SECTION 3 . Section 7 .06 , Article 2 , Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is further amended to add a new subsection, to read as follows: "7 .06 ( ) . The district classification of the existing Multiple Family Residential district (RM-1.5 and RM-3) situated in the Puako-Honokaope Bay resort area as shown on the Puako-Anaehoomalu Supplemental Zone map on file with the Planning Department, shall be Multiple Family Residential - Time Sharing and Transient Vacation Rentals (RM-T-1.5) and RM-T-3) . " SECTION 4 . Section 7 .10 , Article 2 , Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is further amended to add a • new subsection, to read as follows: "7 .10 ( ) . The district classification of the existing Multiple Family Residential district (RM-1.5) situated south of •• Kaunaoa Bay and north of Hapuna Bay in the Kawaihae-Hapuna resort area as shown on the Kawaihae-Puako Zone Map on file with the Planning Department, shall be Multiple Family Residential - Time Sharing Transient Vacation Rentals (RM-T-1.5) . " SECTION 5., Section 7 .24 , Article 2 , Chapter 8 (Zoning Code) of the Hawaii County Code, as amended, is further amended to add a new subsection, to read as follows: "7 .24 ( ) . The district classification of the existing Multiple Family Residential districts (RM-2) situated south (makai) of the Hawaii Belt Road and west of Punaluu Road in the Ninole-Punaluu resort area, Punaluu Kau, as shown on the Kau District Zone Map on file with the Planning Department shall be Multiple Family Residential - Time Sharing and Transient • Vacation Rentals (RM-T-2) . " SECTION 6 . In the event that any portion of this ordinance is declared invalid, such invalidity shall not affect the other parts of this ordinance. -2- ® S SECTION 7 .
