ORDINANCE NO.
AN ORDINANCE AMENDING CHAPTER 8 (ZONING CODE) OF THE HAWAII
COUNTY CODE TO ADD A NEW ARTICLE AND TO AMEND ARTICLES 1, 5,
9, 22, AND 27, RELATING TO TIME SHARING AND TRANSIENT
VACATION RENTALS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII:
SECTION 1 . Chapter 8 of the Hawaii County Code is
amended to add a new article to read as follows :
"ARTICLE 19
REGULATIONS FOR TIME SHARING
AND TRANSIENT VACATION RENTALS
Sec. 1 Purpose and applicability.
The purpose of this article is to describe where "time
sharing, " "time share plans , " and "transient vacation
rentals, " as defined in article 1, section 3, of this
chapter, shall be restricted pursuant to County authority
under Act 186, Session Laws of Hawaii. The intent of this
provision is to restrict time sharing and transient vacation
rentals to areas which are planned for the accommodation of
the visitor segment of the community, rather than permanent
residents. Such areas shall accommodate visitors who
purchase or rent dwelling units in a hotel , apartment,
condominium, or other residential building for temporary use
under time sharing, time share plans, or transient vacation
rentals. Time sharing and transient vacation rentals shall

developments . ] hotels, condominiums, time share units, or
transient vacation rentals. "
SECTION 11. Chapter 8, article 27, section H-2-f , of
the Hawaii County Code is amended to read as follows :
"f . If the [Planning Commission] planning commission
determines that the proposed hotel [and/or] , condominium,
time sharing, or transient vacation rental use will conform
to the intent of the General Plan and other related
ordinances, it shall grant the [Planned Development Permit]
planned development permit ; provided that no structure or
improvement pertaining to the proposed use shall be
permitted until [ "]plan approval ["] has been secured. "
SECTION 12. Material to be repealed is bracketed. New
material is underscored. In printing this ordinance, the
brackets, bracketed material, and underscoring need not be
included.
SECTION 13. In the event any portion of this ordinance
is declared invalid, such invalidity shall not affect other
parts of this ordinance.
SECTION 14 . This ordinance shall take effect upon its
approval.
