Poindexter, Council Chair FROM: Michael Yee, Planning Director SUBJECT: Acceptance of Grants of Public Access Easements from: Charles Anderson and Lisa Anderson, TMK: (3) 5-3-006:027 (por.); and Surety Kohala, TMKs: (3) 5-3-007:015 (por) & (3) 5-3-007:016 (por.). Transmitted by this memorandum are two executed grants of public access easements from the subject landowners and properties. These grants of public access easements are the result of a 2002 Settlement Agreement between the County of Hawai`i and Surety Kohala Corporation (formerly Chalon International), which settled public access obligations over and across several subdivisions in North Kohala pursuant to Chapter 34 of the Hawai`i County Code. These easements will provide vehicular and pedestrian public access to and laterally along the coastline of the subject properties. The Planning Department has prepared the enclosed resolutions for acceptance of the public access easements by the County. The applicants' representative has requested a waiver from committee.
