HomeMy WebLinkAboutREP PC 076 11/17/1993 1992-1994�,.'A REPORT OF THE COMMITTEE ON PLANNING DATE: November 2, 1993 PLACE: Councilroom TIME: 2:10 p.m. Chairman and Members Hawaii County Council Hilo, Hawaii 96720 Re: C-652 Your Committee on Planning, to which was referred Bill No. 150, regarding the change of zone request by Maryl Development, Inc., at Lanihau 1st, North Kona, Hawaii, TMK: 7-5-04:54 (previously a portion of Parcel 29), reports as follows: Bill No. 150 amends Section 25-87 (North Kona Zone Map), Article 3, Chapter 25 (Zoning Code) of the Hawaii County Code, by changing the district classification for approximately 6.629 acres of land from an Agricultural -one acre (A -la) to a General Commercial -20,000 square foot (CG -20) zoned district. The property, presently vacant and periodically utilized for cattle grazing, is located approximately 980 feet south from the Palani Road/Queen Kaahumanu Highway intersection in Kailua-Kona. The subject property is one of three subdivided lots, the others being the Ololi Road remnant and Parcel 19, for which the applicant is requesting the General Commercial (CG -20) zoning and the concurrent Urban boundary amendment in order to develop a commercial subdivision into various lot sizes with a minimum of 20,000 square feet. Water is available to the project site but the applicant must obtain a water commitment from the Department of Water Supply, subject to a determination on the anticipated maximum daily water usage for the proposed development. Although the property is within the State Land Use Agricultural district and the County's Agricultural one -acre zone district, it is not currently used for active agricultural purposes. The Agricultural Lands of Importance to the State of Hawaii (ALISH) map does not classify the subject area in any category, and the Land Use Study Bureau's Overall Master Productivity Rating for the soils in the area is E or Very Poor. PC REPORT N0, 76 ADOPTED: NOV. 1 7 199 It 0 ..r PC -76 Page 2 November 2, 1993 The property has no severe geological or topographical problems which cannot be properly rectified or which would render the land unusable. The subject property is not within the boundaries of the Kailua Village Special District but surrounding lando uses include Lanihau Shopping Center, Kailua-Kona Post Office, Kona Coast Shopping Center and vacant lands. The Planning Commission concurs with the following Planning Director's reasons for recommending favorable consideration of the change of zone request: (1) The zone request is consistent with the goals, policies and standards of the County General Plan and the Kona Regional Plan which recommends the area be developed for General Commercial uses. (2) The change of zone request conforms with the General Plan Land Use Pattern Allocation Guide (LUPAG) map which designates the area for high density urban development. (3) The property is or will be provided with all utilities and services which are essential to accommodate urban development. Since it was determined by Corporation Counsel that the Ololi Road remnant is a county road, your Committee expressed a desire that the the Ololi Road remnant should be considered for payment of a monetary fee or an exchange for other portions of the applicant's land. This matter will be considered at the appropriate time. Your Committee on Planning is in accord with the intent and purpose of Bill No. 150 and recommends that it pass first reading and be sent back to the Planning Committee for further deliberation.
