Re: Budget Ordinance (FY 1992-1993 )
Dear Mayor Inouye :
I am transmitting the enclosed ordinance which
was passed by the county council last week. For
your information , I have sent out several notes in the
past regarding the practice in the county to affix the
stamp or endorsement "APPROVED AS TO FORM AND LEGALITY"
on county documents , including legislation.
The county charter requires an opinion (which may
be verbal , written or endorsement ) on the legality of
contracts. The charter is silent on all other documents ,
including legislation . My concern has been that the
use of the endorsement on all documents in essence
calls us to provide a single line opinion that a bill
or other document is valid in terms of legal require-
ments.
When our office endorses documents using the stamp,
we only give a facial review of the item. The budget
contains many appropriations and we do not express any
opinion on the legality of any program or the manner of
its execution by our endorsement . We do certify that
the bill on its face meets the requirements of the char-
ter and state law as to its format , its wording and its
adoption . Thank you .

Dear Chairman Kokubun & Members :
I have transmitted Ordinance Bill number 577 (Draft 2) to the
County Clerk unsigned.
While I do not believe a veto is warranted, I disagree with
several amendments adopted by Council.
The recycling program deserves our support as this effort is
an essential ingredient for reducing the waste flow into our
landfills. Solid waste represents one of the critical
challenges for our County and our commitment to recycling
should be strong.
Several positions were eliminated such as the risk manager,
procurement specialist, mass transit assistant and public
works clerk typist for Kona. The intent for requesting these
positions were to improve efficiency in providing government
services and to minimize liability expense in the performance
of such services. We will continue to strive to provide the
best services possible with the available resources .
The County continues to be self' insured and we believe it
prudent to provide adequate reserves for any unforeseen
claims or expenditures. Cuts in the area of self insurance
reserve, claims and judgement, and contingency are of concern
to me and the accounts will need to be well-monitored to
assure adequacy throughout the year.
