Receive and file. 4 C-No. 1723 . 3 : KEAUKAHA HAWAIIAN HOME LANDS From Kwai Wah Lee, President, Keaukaha Panaewa Community Association, dated February 10, 1972, requesting immediate action to rectify an illegal. zoning designation placed upon the Keaukaha Hawaiian Home Lands area in 1968 by the County of Hawaii. Request the Planning Director to make the zoning changes to comply with the opinion of the Corporation Counsel as contained. in Communication 1723 .1. 19 • No. 1794 : From Planning Director dated January 13 , 1972, transmitting a report of their study and recommen- dations for the Keaukaha area in the city of Hilo Which has been reviewed with the Department of Parks &- 'Recreation and have received its concurrence on the entire report. ADOPTED: March 1, 1972 Report No. 7 .... II File No. P 0 ... M. B. No. NIAR 11972 4IP 411 PEDLC-73 -2- February 24, 1972 Concur with the recommendations and attendant justifications of the Planning Director for land use and expansion of County parks in the area between Banyan Street (Hukilau Hotel) and King's Landing as enumerated in Communication 1794, namely proposals (a) , (b) , (c) , (d-alter- native) , (e) and (f) , and authorize the administration to proceed with the acqui- sition of the properties involved through negotiations or condemnation. Further recommends that the Finance Director and the Chairman of the Finance Committee work together to set up the funds for this purpose immediately and if unexpended funds are unavailable at this time, transfers be made to accomplish the goal. Also recommends that no building moratorium or downzoning of properties be considered in the area except for the downzoning of the lands in proposal (c) which is now designated for low density urban develop- ment under the recently passed General Plan. Lre.C- No. 1782 : MORATORIUM ON ANY/ALL NEW CONSTRUCTION OF HOTEL CONDOMINIUM APARTMENT BUILDINGS FROM HILO HARBOR DOCK TO KING'S LANDING From Keaukaha Panaewa Community Association dated January 6, 1972 , requesting a moratorium on any and all new construction of hotel, condominium, apartment buildings from the Hilo Harbor Dock to King's Landing (Puumaile) to Shipman's Ranch for the duration of one year to gain time to accomplish the purposes as listed in the communication. 1782.1 : From Kwai Wah Lee, President, Keaukaha Panaewa Community Association, dated January 18, 1972 , S • PEDLC-73 -3- February 24, 1972 cont°d 'N64:2_1782.1 : informing that by E. 0. 267, land was set aside for public purposes to be known as the Leleiwi Beach Park, however, today it has been relegated to a position of survival of an area originally designated for park use. Requests that the land area be returned to the original intention as given the County of Hawaii in 1927 for the purpose of park use for the public. No. 1794.1 : From Parks & Recreation Director dated January 18, 1972 , informing that their recommendation regarding addition to James Kealoha Park was included in the report submitted by the Planning Department and requests that the report be considered as their reply to the Committee 's request. 1794. 2 : From Byron M. Fox, Vice President, The Hawaii Land Corporation, dated February 1, 1972, informing that their basic position remains unchanged that additional park land seems unwarranted and comes at great expense. However, they are willing to enter negotiations with the County for the purpose of deriving a Purchase Agreement satisfactory to the interest of all parties . Requests a decisive action to settle the issue as quickly as possible to allow them to move in the future with certainty. 1794. 3 : From Robert Kim, Chairman, Youth Advocates , dated January 31, 1972, requesting that the Council acquire the backup spaces on the Schwartz property and the Richardson area as recommended by the Planning Director. Requests also that the Council declare a building moratorium on the parcels and that an PEDLC-73 -4- February 24, 1972 cont'd 'No. 1794.3 : official request be sent to the Parks & Recreation Director requesting him to look into the possibility of getting Federal funds to acquire the land. The moratorium would end when the Council acts after the Parks & Recreation Director give a report on federal funding. 1794.4: From Dr. Ernest Schwartz dated February 8, 1972, requesting an early determination by the Council as to a decision regarding his property. 1794.5 : From Hilo Jaycees dated February 23, 1972, recom- mending the' following to preserve and increase recreational swimming areas in Keaukaha for local populace use: 1. Retaining the coastline properties from Hilo Wharf to Old Puumaile Hospital by the County and/or State for future developments of parks, recreational facilities and swimming areas. 2. Have public accesses to coastline if properties cannot be purchased. 3. Develop pond across James Kealoha Park for picnic areas, walking and/or bicycle trails; 'No. 1820: TESTIMONY OF DR. JANE FORD REGARDING KEAUKAHA AREA From Council Chairman Matayoshi dated February 2, 1972, transmitting for disposition, the testimony of Dr. Jane Ford which was presented at the Council meeting of February 2. No. 1852 : '1701" PLANNING GRANT From Planning Director dated February 17, 1972, transmitting for approval a resolution requesting Federal assistance to fund two-thirds of the study of downtown Hilo under a 1170111 Planning Grant: Approve and recommend adoption of Resolution 469. 'Pet. 29 : Petition of November 24, 1971, opposing resort development in South Kona, the proposed scenic roads and present planning of the area. Requests that the County of Hawaii take necessary action to implement and insure the proposals as mentioned in the petition. RECOMMENDATION No. 1: Request the Planning Director to investigate the establishment of bicycle and pedestrian trails along historical and populated coastal areas and between resort and business areas . (Edwards/Hisaoka) PEDLC-73 -8- February 24, 1972 LEGISLATIVE MATTERS SB 1334-72 : Relating to further plans for a mass transit system. Council take no position at this present time. SB 1469-72 : Relating to authorizing the Land Use Commission to impose conditions to assureccompliance with boundary change requests . Council support the concept of SB 1469-72. (Opposed: Mr. Edwards ) SB 1632-72 : Proposing an amendment to Article XIV, Section 5, of the Hawaii Constitution, to provide that the Legislature shall pass one code of ethics to govern both state and county appointed and elected officers and employees . Council take no position since the County of Hawaii has its own Code of Ethics . SR 18 : Requesting the Senate Committee on Ecology, Environment, and Recreation to conduct hearings on the merger of sewer programs into the Boards of Water Supply.
