From Assistant Corporation Counsel Stephen G. Bess
dated November 1, 1976, transmitting for acceptance
the Dedication of Roadway Deed for the roadway within
the Queen Liliuokalani Village. Informs the description
of the roadway has been checked and found to be accept-
able for dedication by the Department of Public Works;
also that the subdivision roadway has been constructed
according to County standards.

THE WAIKOLOA BEACH RESORT AND ADJACENT AREAS OF WAIKOLOA

Home & Land Corporation, dated March 23, 1976, sub-
mitting a petition for the formation of an Improvement
District at the Waikoloa Beach Resort and adjacent
areas of Waikoloa. The Improvement District is
designed to cover the utilities of the resort,
specifically water, sewer and electrical installations.

Home & Land Corporation, dated October 4, 1976,
submitting preliminary financial information which
illustrate estimated total capital costs as an addition
to the previously submitted Petition for Improvements
to be Acquired and Constructed Pursuant to Chapter 16,
County of Hawaii Code, Waikoloa Beach Resort, Improve-
ment District No. 1 dated March 23, 1976.

(Res. 666) informing, having reviewed the petition filed on
March 23, 1976 for the creation of the subject
improvement district, they have found the document to
be in order and submits for adoption a proposed reso-
lution calling for the submittal of the preliminary
report bythe Chief Engineer.

No. 2002 : REPAIR OF DAMAGED ROADS
From Councilman Kawahara dated August 30, 1976,
requesting investigation and immediate steps to repair
and restore public roads damaged by contractors and
other permittees in the process of digging up roads
for purposes of laying pipes and other utilities.
2002. 1: From Mayor Herbert T. Matayoshi dated November 12, 1976,
responding to C-2002. Informs the Department of
Public Works will, within staffing limitations,
endeavor to require of contractors and individuals
compliance with regulations and standards to provide
minimum of inconvenience to the public.

No. 2004: SECOND ACCESS AT GLENWOOD
From Councilman Kawahara dated August 30, 1976,
informing that the back road serving the community
in Glenwood from the main Volcano Highway entrance at
Captain' s Road needs a second access at the Hilo end.

iNo. 2005 : HOLUALOA FLOODING
From Councilman Kawahara dated August 30, 1976,
informing of a suggestion made by property owners
affected by the constant flooding at Holualoa that
the problem may be corrected by channeling the mauka
flood waters back into the regular drainage ditch
adjacent to Holualoa School.

�No. 2050: SOUTH KOHALA WATER SYSTEM
From Harold W. Adams , Public Affairs Chairman, Puako
Community Association, dated September 21, 1976,
informing as taxpaying residents of South Kohala that
the water department should be required to make public
its calculations
of "safe yield" for the South Kohala
system and show the probability of water shortages for
dry, average, and wetter than average years; these
figures should be shown to be consistent with the
actual figures for the past four years.

No. 2078. 1 : IMPROVEMENT DISTRICT AMENDMENT (BILL 251)
From Virginia C. Lee, President-Elect, Hui Kahakai
(The Hawaiian Beaches Community Association) , dated
November 19, 1976, requesting the present County
Council to act upon Bill 251 and that the matter not
be deferred for action by the new Council which will
necessitate a duplication of everyone ' s efforts thus
far, and result in unnecessary delay and expense in
reaching a determination.

`No. 2099 : subdivision. Advises the description of the easement
(con' t. ) has been checked by the Department of Public Works
and found to be acceptable for dedication; also the
subdivision has received recordation approval from
the Planning Department.

Pet. 31. 1 : REQUEST FOR STREET LIGHT
VOLCANO ROAD & GLENWOOD HOMESTEAD ROAD INTERSECTION
From Chas L. Schuster, District Engineer, State
Highways Division, dated November 9, 1976, informing
that the installation of street lights on the State
Highways requires legislative authorization and
funding which they do, not have; however, they have
no objections should the County install the light at
its expense.
Receive and file; and request administration
to install street light on the makai side
of the intersection of Mamalahoa Highway
and Glenwood Homestead Road.
'Pet. 32 : PETITION AGAINST BILL 251
From Leslie W. Brown submitting petition from resident
owners in a substandard subdivision requesting the
Council to vote down Bill 251 but should it be passed
over their objections , asks that Orchid Land Estates
be exempted.

ORDINANCES
Bill 251 : IMPROVEMENT DISTRICT AMENDMENT (C-2078)
(Amended) Amends Chapter 16, Article 3, relating to improvements
by assessments. (Intr. by: Mrs. Yadao)
Amend Section 3. 02 of Bill 251 to change
the petition requirement from 30 percent to
20 percent and to include language speaking
to a state of emergency; and recommend
adoption of said bill, as amended, on second
and final reading.
