The following are the recommendations of the Finance Committee
which were considered at its meeting of December 26, 1972:
COMMUNICATIONS
No. 2: EMPLOYEES ' RETIREMENT SYSTEM
From K. T. Lee, Secretary, State Employees'
Retirement System, dated November 14, 1972,
transmitting a resolution adopted by the Board
of Trustees of the Employees ' Retirement System
certifying the amount required for normal and
accrued liability contributions from the County
of Hawaii for the fiscal year July 1, :L973 to
June 30, 1974. The total requirements due to the
System for the fiscal year 1973-1974 for the
various funds are $1, 239 ,916.
�No. 4: FIRE DEPARTMENT - REVIEW OF ACCOUNTS
From Director of Finance dated November 27, 1972 ,
informing that pursuant. to Section 10-13 (post-audit)
of the County Charter, they have reviewed the
accounts of the Fire Department under the adminis-
tration of Julius K. Wery, who retired on September 1,
1972 , and find the accounts to have been in order.
The Committee recommends receiving
and filing of the letters which are
for information only.

No. 3: CLAIM - ANTHONY A. ARRUDA, JR.
From Anthony A. Arruda, Jr. , dated November 22,
1972, filing a claim for damages to his car when
he hit a large hole on Kinoole Street heading
toward Puna near Olona Street on November 18, 1972.
b,„ 0,- No. 13: CLAIM - STANLEY ASEJO, JR.
From Wallace J. Melick, Hilo Claims Manager, Hawaiian
Insurance Companies , dated December 6, 1972, serving
notice of subrogation rights due to the payment of a
claim made as a result of an accident on November 21, 1972.
The amount of damage ($1, 325) includes their insured' s
deductible.
The Committee has referred these
claims to the Corporation Counsel
for his investigation, review and
appropriate disposition. 1
,CL _ No. 24: REAPPOINTMENT OF CORPORATION COUNSEL
From Mayor Kimura dated December 4, 1972 , submitting
for approval the reappointment of Mr. Clifford Lum
as Corporation Counsel.
The Committee welcomed the opportunity
of reviewing Mr. Lum' s qualifications
and past performances and recommends
the confirmation of Mr. Clifford Lum
as Corporation Counsel.
,,, C - No. 34: MORAL OBLIGATION
HAROLD LEITE CLAIM
From Corporation Counsel dated December 18, 1972 ,
informing that on or about March 10, 1972, Mr. Leite' s
claim for damages was reported to their office. The
incident occurred on February 9, 1972 in Papaikou.
On August 30, 1972 , their office received invoices
for $80.47 which represented Mr. Leite" s actual cost
for materials to repair the damages and settled the
claim for that amount. Since there was no compliance
with Charter Section 13-18, the County would not be
legally liable. However, a basis on which settlement
might be made is that of a moral obligation.

No. 34: It is their opinion that any determination as to whether
or not a moral obligation exists on the part of the
part of the County to pay the Leite claim their office
has settled rests solely with the Council, subject to
judicial control only where action is a clear abuse of
discretion. Therefore, asks for the Council' s favorable
determination as to the existence of a moral obligation
upon the County.
The Committee finds that there is
a moral obligation on the part of
the County and recommends payment of
the claim of Mr. Harold Leite.
-No. 41: FEDERAL FUNDS
From Mayor Kimura dated December 18 , 1972, reporting
the receipt of $910 ,485 in federal funds for the
first entitlement period from January :L, 1972 to
June 30, 1972 under the State and Local Fiscal
Assistance Act of 1972. These funds must be placed
in a trust fund for proper accounting, and therefore
submits the following ordinance bills for the
Council' s consideration:
(1) Bill to create a special trust fund entitled
the "Federal Revenue Sharing Fund. "
(2) Bill to amend Ordinance No. 474 (Appropriation
Ordinances for FY 1973) by increasing revenues
by $910,485 in the Federal Revenue Sharing Fund.
The Committee wishes to report that
the purpose of these bills are to receive
the County of Hawaii' s share from the
Federal Government of the Revenue Sharing
funds and to create a Special Trust Fund
for proper accounting (Bill 952) and to
increase the revenues in the Federal
Revenue Sharing Fund (Bill 953) by $910,485.
The Committee is in accord with the
intent and purpose of Bills 952 and 953
and recommends passage on first reading.
