Bess, Assistant Corporation Counsel, dated December 12, 1974, informing that upon further investigation and receipt of new evidence, believes that the claims have some substance and a settlement for $500 was made in the best interest of the County. Receive and file. No. 665: CLAIM - MR. & MRS. STEVEN QUEROBIN From Roy K. Nakamoto, Attorney at Law, dated January 21, 1974, filing a claim of $4,971 on behalf of his clients, Mr. & Mrs. Steven Querobin, for damages to their residential property at 138 Laula Road, Hilo, due to flooding caused by the faulty design and construction of the improvements on Laula Road. 665. 1: From Terence T. Yoshioka dated June 19, 1974, modifying the original claim to include additional damages in the amount of $3,000 for the infliction of mental distress and suffering caused by the flood waters. No. 994. 3: COMPREHENSIVE EMPLOYMENT AND TRAINING ACT (CETA) From Mayor Herbert T. Matayoshi dated December 13, 1974, informing that they have received notice from the Governor' s office to anticipate a new increment of CETA grant for the 1976 calendar period, preliminarily estimated at $370,000. 994.4: From Mayor Matayoshi dated December 26, 1974, trans- mitting for information the news release regarding the CETA grant. No. 1004: ESTABLISHMENT OF A PRE-SCHOOL IN NORTH HILO Presentation by Maxine Mills, Education Committee, North Hilo Community Council, to the County Council at Laupahoehoe on September 25, 1974, endorsing the need for establishment of a pre-school. ,Sre,e-1004.1: From Stephen G. Bess, Assistant Corporation Counsel, dated December 23, 1974, submitting an opinion on whether the expenditure of public funds would be illegal if the payments were made to the North Hilo Community Council in order that a pre-school be established in North Hilo. Believes that the language of the State of Hawaii Constitution is clear in mandating, that public education is the responsibility of the State and not that of the several counties and advises that the County of Hawaii may not legally subsidize the establishment of a pre-school in North Hilo. Accept opinion of Corporation Counsel and transmit copy of C-1004.1 to Maxine Mills for her information. 4ec,C1- No. 1083: RADIO DISPATCHER POSITIONS From Mayor Bruce McCall dated November 18, 1974, recommending that five positions which were approved as fire fighting positions be reallocated to radio dispatchers as it is their belief that these duties can best be handled by non-fire fighting personnel so as to not adversely affect the fire fighting performance of the department. Upon completion of the Public Safety Building complex and communication center, it is planned to have both fire and police dispatchers located at the new communication center. Adi Ilir FC-37 -3- January 13, 1975 The additional CETA II grant opens the possibility of immediately hiring at least seven radio dispatchers at the entry grade level (SR 12) if it can be agreed that the dispatchers can be non-fighting personnel. By freezing the five regular employment positions in the budget until the CETA II program is terminated, the funds could be used toward filling the additional eight fire fighter positions included in the budget before its adoption. Accept recommendation. <4) No. 1093: PERIODIC MOTOR VEHICLE INSPECTION ADDED COSTS From Chief of Police Ernest J. Fergerstrom dated December 10, 1974, recommending that the inspection fees be raised from $3.00 to $3. 50 for the following reasons: 1. It will provide that the County recover its direct costs in processing the Periodic Motor Vehicle Inspection activity. 2. It will provide that all counties in the State have a uniform price for the inspection process. 3. It will provide an increase in return to the inspection stations. 1093. 1: From Alfred Jose Andrade, President, Service Stations and Garages Association of Hawaii, asking consideration of a new rate of $5.00 for motor vehicle inspections. Approve request of Service Stations and Garages Association of Hawaii and refer to the Corporation Counsel to prepare the proper amendment to Chapter 6, Traffic Code, Article 19, Sec. 3, establishing the inspection fee at $5.00. Further recommend that a public hearing be held on the rate increase, if required by the Administrative Procedure Act (APA) . �No. 1139: AUDIT REPORT OF OFFICE OF THE MAYOR From Stanley A. Nakamae, Director of Finance, dated December 12 , 1974, informing that in accordance with Section 10-13 of the County Charter, an audit and investigation of the accounts maintained by former Mayor Bruce McCall were performed by the Internal Control Auditor and the Inventory Clerk. They have found that the accounts and inventory of former Mayor Bruce McCall are in order and that he is not indebted to the County. Receive and file. III 110 FC-37 -4- January 13, 1975 RECOMMENDATION Rec. 1/RTC-36 BIG ISLAND GUN CLUB - REQUEST FOR APPROPRIATION W Recommend $12 ,000 be appropriated as requested by the Big Island Gun Club and refer to the Finance Committee for funding. Approve request of the Big Island Gun Club for $12,000 to refurbish facilities at the skeet and trap shooting range and refer to Director of Finance for funding.
