Funds will be used towards providing salary and other costs associated with hiring an agricultural investigator at the Office of the Prosecuting Attorney for one year. Enclosed is a resolution authorizing the Mayor to enter into an agreement with the State of Hawai`i Department of Agriculture to allow the County to receive funds for this program. Also enclosed is a bill for an ordinance amending the Operating Budget by appropriating this $91,891 to the Office of the Prosecuting Attorney's Agricultural Crimes Project account. The Office of the Prosecuting Attorney requests that this bill and resolution be waived from the Finance Committee and be placed on the March 8, 2017 Council agenda in order to expedite the receipt of these funds. REQUEST: We are requesting the Council's permission to receive State funds in the total of $91,891 for the period one year, starting approximately April 1, 2017. The funds would come from the Agricultural Development and Food Security Special fund of the Hawaii Department of Agriculture. The funds would be used to fund an Investigator V at the Office of the Prosecutor to investigate and prepare cases for prosecution. This would include ammending the budget to appropriate the funds to the project and creating a general ledger account and revenue account for the funds. We are requesting the waiving of further reading so as to expedite this process as time is an issue for this project. B. BACKGROUND AND JUSTIFICATION (USE ADDITIONAL SHEETS AS NEEDED): The State of Hawaii, Department of Agriculture wants to provide funds to the Hawaii County Office of the Prosecutor to pay for the salary of one Investigator V including fringe benefits, supplies, travel and equipment for one year. This Investigator would: 1) Conduct investigations of the most complex, confidential, and diverse civil/criminal cases being considered and/or readied for court action and prosecution; obtain additional information, evidence, and facts to clarify or substantiate findings of law enforcement agencies; and performs other related duties as required. 2) Investigate and re-investigate the most complex, confidential, and diverse cases being considered and/or readied for court action and prosecution. 3) Educate persons, inspect agricultural commodities and enforce regulations as defined in, and in accordance with, Hawaii Revised Statutes (HRS), Chapter 145- Regulation of Farm Produce. The Hawaii Department of Agriculture would use State funds from the Agricultural Development and Food Security Special Fund to award to the County of Hawaii $91,891. These funds will be received in the current fiscal year and subsequent fiscal year, and spent during the current fiscal year and the subsequent fiscal year. Bill No. 16 : An Ordinance to Amend Ordinance No. 16-72, as amended, the Operating Budget for the County of Hawai`i for the Fiscal Year ending June 30, 2017. Pursuant to Section 2(g) of Rule 4 of the Rules of Procedure of the Council of the County of Hawaii, this written request is submitted with my approval that the above-referenced matter be waived from the Committee on Finance to the full Council for immediate action. In reviewing this matter, timely approval is crucial. It is therefore advantageous that approval is granted and the matter be placed onto the next Council agenda for review.
